The majority report of the Financial Crisis Inquiry Commisssion says Alan Greenspan and Ben Bernanke, regulators, and several financial institutions were responsible for what was an "avoidable disaster." The report criticizes Mr Greenspan for advocating deregulation and considers the failure to stem the flow of toxic mortgages under his leadership at the central bank as a "prime example" of negligence. The report also says that the New York Fed under Timothy Geithner, now Treasury Secretary, also missed signs of trouble at Citigroup and Lehman. There are 6 Democrats and 4 Republicans on the Commission. The fourth Republican has his dissent, calling policies to promote home ownership, the role of Fannie Mae and Freddie Mac a major cause. The panel was hobbled by internal divisions and staff turnover, which have made what should have been a report of major significance into one marred by partisan differences. The majority report itself was heavily shaped by Phil Angelides, the committee's chairman, and it has many literary phrases. Overleveraging was a critical factor in the crisis. For every $40 in assets, the US's 5 largest investment banks had only $1 in capital to cover losses. The banks hid their leveraging with derivatives, off-balance sheet entities and other devices. The banks relied heavily on short-term debt which worsened the crisis. The report also said the Clinton adminstration's decision to exempt over-the counter derivatives from regulation- made in the last year of Clinton's term- also helped set up the ground for later events leading to the crisis....

NYT's Landon Thomas gives this exceptional report on how Deutsche Bank changed from a lender to the German auto industry and safe banking practices to enter the derivatives business and other opaque financial products that led to taking on huge risks. Deutsche Bank has agreed on Dec. 22, 2016 to settle with the U.S. Justice Department paying a fine of $7.2 billion for practices relating to faulty mortgage securities. This report says the problems started in 1995 with Deutsche Bank's leadership hiring Edson Mitchell of Merrill Lynch to promote the investment banking business at Deutsche Bank. Mitchell hired two derivatives traders Broeksmit and Anshu Jain. Mr. Mitchell died in plane crash in 2000 when he was 47 years age, Mr. Broeksmit committed suicide in 2014, 58 years in age, Mr. Anshu Jain, 53 years old, is the only surviving person of the three. Under Mr. Jain Deutsche Bank assumed more and more risk, and was involved in complex and opaque financial products leading to the toxic mortgage crisis, and manipulation of the lending rate for London banks.  It also lent $300 million to Donald Trump's businesses. Most of the profits generated from this venture have evaporated, with analysts estimating $15 billion in fines and penalties owed of the $20 billion that these ventures generated. Not counting the serious damage to the bank's reputation in Germany and the U.S. This report points out the role played by the CEO from 2002 to 2012 of Deutsche Bank, Josef Ackermann, in encouraging these ventures converting the bank from its original loan as a contintental lender to business to a bank selling opaque financial products for most of its profits. Landon Thomas also describes the events and days leading up to the suicide by Broeksmit, including a visit to a psychiatrist and Broeksmit's facing enormous stress about the investigations underway in Germany and the U.S. looking into the opaque financial products and practices of Deutsche Bank. This is also a cautionary tale about what happened in banking from the late 1990's leading to the collapse in 2008, leading to the problems of today- the need to rescue the economy in 2008-2009 and the low rate world that ensued damaging the savings of ordinary people, the infrastructure that was never built, the parallel crisis of the hollowing out in manufacturing as a false prosperity boomed in banking and finance. In a sense it is also a story of everyday lives that were damaged in the high flying boardrooms of finance in New York, London and Frankfurt. The revolving door between regulators and the banks made it harder to monitor and control banking risk letting this story unfold over decades, damaging the credibility of governments and the established political parties without clear alternatives from outside; as the dominance of Wall Street executives in the new outsider Trump administration shows.  ...

Jim Tankersley in the NYT says administration officials point out that president Biden is determined not to repeat the political and economic mistakes of the Obama era. Economists now say that these economic mistakes slowed the recovery from the 2008 financial crisis caused by faulty mortgages of banks and excessive leveraging. Obama cut back on spending on education, on relief for workers and families affected by the financial crisis of 2008, and in investing in education and other public goods. Administration officials also point to polls that show the public increasingly sides with the president on this. Eric Holder Jr, the Attorney General of USA, told the Financial Crisis Inquiry Commisssion that the F.B.I. was investigating more than 2800 mortgage fraud cases. Of these 2800 cases, 1842 are classified as major cases, involving losses of more than $1 million. In addition federal charges are pending against 826 defendents. Lanny Breuer, assistant attorney general of the Justice Department's criminal division stated that the fraud cases included loan origination schemes, property flipping, foreclosure rescue schemes and loan modifications. Those accused of wrongdoing include real estate brokers, appraisers and bank insiders and "plain old fraudsters who gravitated to mortgage fraud." Sheila Bair in her opening remarks to the Financial Inquiry Commission, led by California state Treasurer Angelides, stated that it was necessary to find a way to breakup large banks without using the option of government support. Bair pointed out that the basic assumptions about financial supervision, credit availability and market discipline that were considered acceptable in the regulatory reform scheme for decades are now appearing seriously flawed. A whole reassessment was needed to change the existing mechanisms and methods. And she emphasized the serious distortions and imbalances in our national policies which moved away from savings to consumption, away from investment in our industrial base and public infrastructure toward housing, and away from real sectors of the economy towards the financial sector. A delicate balancing act for the Federal Reserve, in not withdrawing support to the debt securitization markets in a manner that throws the economy off balance, and leads to the collapse of credit markets still again. Lee Sachs, an advisor to Timothy Geithner, Treasury secretary, says that its important to do it incrementally, where and when you think you can, and not sooner. The debt securitization markets act as a shadow banking system, they finance mortgages for homes, corporate loans, student loans, credit card debt. Before the debt crisis in 2008, banks made loans for mortgages, and then sold these loans packaged into securities in the debt securtization markets. 60% of American credit has in recent years come from this process of debt securitization. This is how the markets look at this time in September 2009. 1. A thriving private market in securities packaged out of home mortgages, collapsed from $744 billion in 2005 at the peak, to $8 billion during first half 2009. THe Fed is almost the only buyer of mortgage backed securities, with $905 billion of these government guaranteed securities purchased through mid September, 80-85% of the market. 2. The market for bonds backed by consumer debt - credit card debt, auto loans and student loans - has recovered to before the crisis. But this is only because of the government's Term Asset Backed Securities Loan Facility or TALF, which provides attractive government financing to buyers. Hyun Song Shin, a Princeton University economist, who is an expert in this area, says the big question is what happens without TALF, can the market stand on its own two feet or is it permanently hobbled. 3. The market for securities in commercial real estate loans has not seen any securties issued in two years. Overall says Robert Shiller, a Yale University economist, the security markets are dead, we are stuck in a situation where no one knows what will happen when the government gets out of these markets. The Fed will continue to support the mortgage markets till it goes from the $905 billion now to $1.25 trillion. At that point it will have to make some tough decisions, and banks are not lending, making it tougher for business. On top of this banks liquidity requirements are being increased after the G20 agreement, and Britain's FSA has already taken the initiative on this. And a further $50 billion in corporate real estate securities are to be refinanced in 2010, says CALPERS, Arnold Phillips. If there is no mechanism to address support here, these properties will default, leading to bank losses and even tighter credit. ...

Zombrun describes the effect of low interest rates on savings for the bottom half of households in the U.S., the pressure to invest in stocks without the skills and experience of the better educated part of households in the top 20% of households by wealth and income. This resulted in a negative effect, a depletion of savings compared to an increase under a higher interest rates scenario with less pressure to take risks in a volatile stock market. This is the direct cost of the crises in stock and financial markets of 2000 caused by a internet bubble, and the larger crisis of 2008-2009 caused by the bubble in mortgages and housing. The secondary effects of the mortgage price bubble and faulty mortgage securities was in the millions of homeowners who went into foreclosure in 2009-2013, which further depleted wealth and savings of households in the bottom half lacking the experience and skills to navigate this type of housing market. The failure of the Obama administration to stem the foreclosures with practical steps which would have helped not hurt the banking sector, as suggested by FDIC's Sheila Bair and Harvard economist Martin Feldstein in many WSJ op-eds in 2010-2012, added to the erosion of savings and wealth of the bottom half. Minorities in particular were hit hard. A third effect is of communities across America that are feeling the effects of job migration to emerging markets such as China that has been underway as part of the globalization of the last three decades. A fourth effect in the rising cost of education, particularly since 2000, has reduced the opportunities for struggling working class people to enter the middle class and enjoy the higher incomes in precisely the very period when the divergence of incomes between less educated, less killed people and the more educated and better skilled people was taking place. The last two effects were neutral as part of the overall process of emergence of a globalized economy with a premium on more skills and education, requiring action by the government, universities and business for a concerted effort to mitigate in some places the negative effects and enhance in other places the positive effects. The first two effects were man made crises which required managing in constructive and positive ways for the entire American people, taking risks where necessary such as fears about the financial system if foreclosures did not go through. The risks of a long period of extremely low interest rates for savers and the middle as well as working class were poorly understood by the Fed since 2000. A similiar crisis is being faced in Europe with extremely low interest rates. Janet Yellen was only doing the honest thing by acknowledging how far and how different the situation is now compared to the period of three decades following 1945- a question not just of values cherished in America, also of the need for societies to advance through creation of wealth across all sectors of society or regress, as described by Smith in the Wealth of Nations....

As the US central bank, the Fed, considers cutting high interest rates that affect housing costs and mortgages this WSJ report looks at the consumer debt in September 2024. It says consumer debt is at $17 trillion in 2024. This is high except that when inflation adjusted it is only 3% above the consumer debt in 2019, the peak happened in 2008 before the banking induced financial crisis. Then there is the question of what the debt composition is. Here overall debt has grown by 4% yet credit card debt is up 11%, not a good sign when the interest rates charged by banks is 12%, by cards 22%. Households are paying off credit card debt by borrowing from sources with lower interest costs.

This is more evidence why many households are hurting as debt servicing remains as and additional cost of living issue for Americans.

Assistant U.S. Attorney at the Fresno office, Richard Elias, spots a JP Morgan Chase bank memo in 2012 after looking at many documents. This starts the process leading to the large settlements of $37 billion with U.S. banks in 2014. The memo used words such as "fallout," "kick" and other words clearly showing the banks were aware of the serious risks associated with the securities and the fallout expected. By 2012 the Obama administration felt the pressure from Democrats in Congress to show results in prosecution of banks for schemes related to packaging of highly risky mortgages into securities that led to the 2008 financial crisis. The Justice Department senior staff, Mr. West and Mr. Cole decided to focus on this incriminating evidence for JP Morgan Chase, Bank of America and Citigroup. Most of 2013 was used for preparation of the cases against the bank which were prosecuted using the Financial Institutions Recovery, Reform and Enforcement Act of 1989. Firrea has provisions not contained in other legislation, to get huge settlements as penalties, with extended time period for enforcement, when damage was done to financial institutions. The resulting effort led by Attorney General Holder led to the largest part of the total $128 billion paid in settlements by U.S. banks for cases related to the 2008 financial crisis....

The NYT Editorial on June 2, 2009, says the Obama anti-foreclosure plan is woefully inadequate, and can't stop the wave of foreclosures. The administration's foreclosure plan that went into effect in March 2009, offers upto $75 billion in incentives to lenders to reduce loan payments for homeowners facing foreclosure. Lender participation is largely voluntary under the Obama plan, making it weak. Since March about 100,000 homeowners have been offered a modification according to the Treasury Department. This is a small dent in the plan's intent of preventing 4 million foreclosures. And it continues the Bush administration's apathy and lack of effective action to prevent foreclosures. The Mortgage Bankers Association reported that in the first quarter 2009 5.4 million mortgages were delinquent or facing foreclosure. There are 15.4 million "underwater" homeowners, those who have no equity in their homes, and with average person deeply in credit card and other debt, these people have little to fall back on if they lose their jobs or have a medical crisis. The simple arithmetic of these 15.4 and the 5.4 million, adding upto 20.8 million households, shows that anywhere near a fifth of American households are in deep financial trouble. The same numbers, or another fifth of American households, are approaching foreclosure. Drawing concentric circles of these homeowners inside a circle showing all American households, and seeing these concentric circles increasing in size with every quarter of job losses, one can clearly see why this is the biggest problem facing the economy. Job losses in January 598,000, February 681,000, March 699,000, April 539,000, totalling 2.5 million for Jan-April 2009, and 8.9 million working parttime. The underemployment rate at 15.8%. Till this foreclosure situation exacerbated by rising under employment is addressed, the credit easing and the small recovery thats been managed since December 2009, is like a mirage in the desert. A false sense of comfort. The NYT editorial makes the point that the foreclosures prevention efforts focus entirely on reducing monthly payments. Even here it falls short, in not reducing the payments enough, or programs not big enough in scope to address the millions of homeowners needing help. But an even bigger problem remains unaddressed, says the NYT, and this is not reducing the principal. An effective anti- foreclosure plan has to reduce the principal for the 15.4 million homeowners under water. This as Martin Feldstein has argued repeatedly in the oped pages of the WSJ since early 2008- the homeowners under water or approaching that situation have no incentive to hold onto their homes- has to be addressed by government taking responsibility for loan principal reduction in a carefully designed plan requiring participation of lenders. NYT points out that the mortgage industry has resisted taking this approach, and the Obama plan does not emphasize this important part of an effective plan to reduce foreclosures. By opposing this, the banks with the toxic mortgage assets and the government by going along with this, are shooting themselves in the foot. This makes any recovery at best weak, and more likely a false hope lacking fundamental support, foresight and vision....

China's GDP growth accelerated slightly to 6.9 percent in the 1st quarter of 2017, after five consecutive quarters of GDP growth at 6.7-6.8%, according to government data. This reflected larger use of steel in the construction industry and more mortgages issued by the state controlled banking sector. Government officials say productivity is improving helping GDP growth, with closing of less efficient manufacturing plants. Industrial production increased 7.6% in March 2017, according to the National Bureau of Statistics. The government is trying to control higher lending and reduce the backlog of bad loans at banks. Higher growth helps to reduce the bad loans at banks from the earlier period after 2008 financial crisis, improving financial stability.

Sheila Bair, former head of the FDIC, says householders, business leaders, politicians and government leaders are all prone to looking at the short term, and refuse to make the short term sacrifices necessary to put the economy on a trajectory of long term growth. There is also a sense of short sightedness and resistance to any regulatory steps that would actually create a better framework for the financial industry for longer term growth. The financial industry opposes increases in capital requirements for reserves that would lead to a healthier balance sheet for the industry, and opposes any efforts to create amore stable financial system for the country that might sacrifice short term profits. She points to IBG-YBG sense that prevailed in the industry, I be gone- you be gone, leading to the mortgage crisis. The industry tolerated faulty ratings, faulty packaging of securities, and showed complete lack of attention to the long term consequences of such behaviour and excessive leveraging, as long as the short term profits could be made. To a large degree the situation remains the same today, says Bair. Bair and Feldstein were among the first to suggest the Obama administration tackle the huge number of bad mortgages, that were leading to a wave of foreclosures. Only if this problem was tackled head on could this be put behind and the economy be put on a path to steady growth. As it stands today the Obama administration has not tackled the problem, the financial industry still has bad mortgage debt on its books, foreclosures continue, housing prices face further declines, and this will hold back an economic recovery. She refers to the "rationalization" of the last crisis by leaders in the financial industry through the assertion that nobody saw the crisis coming, when she says some of us did see it coming, and a "rationalization" by the same leaders in saying they did nothing wrong. Bair says that the continuation of business practices that led to the financial crisis of 2008 create risks for a new crisis. And some people in government continue to support these same practices while claiming popular support. The President's focus every two years is on getting re-elected and raising funds for re-election, business is focussed on the short term, and this creates a pervasive sense of the short-term throughout out the system and society. ...

The issue says the New York Times is whether the financial meltdown was caused by one of these frequent crises of capitalism as bankers would have us believe or was there malfeasance involved. This is its comment on the SEC filing civil charges against Goldman Sachs in the Abacus case in which Goldman helped Paulson put together a batch of bad mortgage securities into a security that it sold to its institutional clients, without disclosing what Paulson had done and without disclosing that Paulson had structured these securities precisely so that he could bet against them. Peter Bernstein's says it is vital to address the household sector that is the root of the problem. And the only way to do this effectively is to change the terms of the mortgages themselves and stop the flow of foreclosures, with the government taking on some of the losses from these changes in the mortgage terms. First, he says, thats where the crisis has originated. Second, in the previous recessions the household sector was not the problem, in this one it is the problem. Without returning it to better health, America cannot reverse the devastating course of this recession. Households are the primary customers of American business, and the wave of foreclosures, dropping house prices and job losses, destroy the optimism and morale of millions of Amrericans. "The risk here is not just humanitarian. Indeed the risk is also the preservation of the social structure of democracy and the future progress of America, " says Bernstein. Essentially Bernstein is saying that President Obama should put campaign promises for health care reform, and other agenda after addressing this issue. Obama has extended unemployment insurance as afirst step, he has responded to Detroit's auto industry needs, and has set up the stimulus package. But in the household sector and on mortgages the response has ben weak, thus letting this problem grow and leaving the roots of the crisis unattended. "To intervene promptly, directly and powerfully to counter the home price debacle" has not happened. Something that the New York Times has repeatedly stated in its editorials, including one last week. And without this hope and optimism is not likely to be built on firm ground. A sudden recovery in the stock markets, as in the 2nd quarter 2009, cannot substitute. ...

A decade after a precipitious decline in its stock price during the global financial crisis of 2008 stemming from its GE Capital unit, GE struggles with faltering stock price and poor performance stemming from other strategy errors in its core infrastructure business.  GE Capital is being shut down. Now one of its subprime lending units is likely to be put into bankruptcy protection. WMC Mortgage had losses under its GE Capital parent  of $1 billion during the financial crisis in one year alone. It has since faced a series of legal settlements and investigations. GE Capital has turned out to be a poor investment and a huge distraction for management for a company which considered its core business as infrastructure related.

Foreclosures are shifting to the top third of the local housing values, up to 30% in June 2009 from 16% in 2006 when the foreclosure crisis began, according to Web site Zillow.com. The bottom one third by home values now represent 35% of foreclosures down from 55% in 2006. Blinder, a Professor of Economics at Princeton, and former Vice Chairman of the Fed, always supported Sheila Bair's efforts at FDIC to help reduce forclosures. He says, Secretary Paulson has released little of the TARP money for reducing foreclosures and helping homeowners and none of it went to buying up troubled mortgage assets. So he argues the nations mortgage crisis, which is at the root of its problems goes on. The government that gave us Katrina and the Iraq war will now give us the TARP program, which apart from supporting the banks has done little to address the other serious problems that it had been approved for. And no conditions were made with the banks that required them to continue lending, all it accomplished is unfreeze the credit markets, a serious objective but clearly not sufficient to address the underlying causes of this crisis. Martin Feldstein, Professor of Economics at Harvard, has also repeatedly this year, from the early months of 2008, called for help to homeowners to reduce foreclosures. Little in the way of his counsel is being heeded, even though he has represented Republican administrations including Reagan and Bush in the past. Clearly too many conflicting interests stalled any progress, and the repeated crises since summer left Secretary Paulson and Fed Chairman more of a role putting out fires or forestalling dangerous developments in financial markets, than setting serious policy measures in place. ...

The social security check being smaller for this group and its shorter life span means more of the social security pie is going to better off Americans who retire later, creating a uniquely American situation of widening economic inequality and unfair distribution of the economic benefits of society. The way in which the subprime mortgage crisis is affecting Germany. How mid sized German banks formed conduits like the larger banks in Europe and expanded them to the point where their conduits were as large as those of the large banks. Lacking the resources of the larger banks these banks were the first to fall in this crisis. Conduits are off balance sheet affiliates that borrow using short term commercial paper to invest in longer term securities. Its critical that they have access to capital borrowing because the commerical paper has to be renewed. In a crisis like this one if the borrowing ability vanishes because of perceived risk by lenders then the whole operation can blow up. So the German central bank had to intervene to support 2 of these institutions IKB Deutsche Industrie Bank and Sachsen LB and organize a rescue operation. Considering that weak consumer protection laws exacerbated the economic crisis by worsening the subprime crisis and weakening asset prices on the books of the banks, banks do not appear to have an understanding of where there deeper interests lie. Banking makes its best profits when it engages in prmoting the industrial activity, investment and growth of a country, and worst when it engages in the kind of mortgage activites that were common during the bubble in real estate.

Global imbalances in savings had alot to do with the current economic crisis, says Prof. Richard Portes of the London Business School, and president of the Centre for Economic Policy Research. See graph that shows net cross border flows doubled from 1997 the year ogf the Asian financial crisis to 2008. By 2008 these cross border flows from Asia to the West reached 3% of global GDP. This says Portes was what was ultimately the cause of the crisis, as it enabled bankers to be reckless and mortgage lenders to be reckless with all the extra money in the American banking system.

The recommendations of the President's Working Group on Financial Markets to be given today by Treasury Secretary Paulson. The Working Group includes the heads of the Federal Reserve and the Federal Reserve bank of New York, and the heads of SEC ad CFTC. The aim is to prevent the kind of crisis in mortgages and credit from happening again. There are other private-sector advisory panels also at work with Treasury with one focusseds on credit rating firms and Congress is working on this also. Much of it does not require legislation and some of it can be implemented immediately. Regulators are asked to work more closely with the Financial Accounting Standards Board to revisit accounting issues and make sure exposures are properly reflected.They are asked to make their independent assessments and not to rely on credit raings firms. Fannie Mae and Freddie Mac are asked to work on raising more capital and reduce dividends to conserve capital. New licensing standards are supported for mortgage brokers. The question is whether new storms in the economy and credit and financial markets will make this look not enough considering the situation facing the economy and financial markets....
