I mean, it seems that it might be directly applicable. You have a claimed source in IEEPA that had never before been used to justify tariffs. No one has argued that it does until this -- this particular case. Congress uses tariffs in other provisions but -- but not here. And yet -- and correct me on this if I'm not right about it -- the justification is being used for a power to impose tariffs on any product from any country for -- in any amount for any length of time. That seems like -- I'm not suggesting it's not there, but it does seem like that's major authority, and the basis for the claim seems to be a misfit. So why doesn't it apply again? GENERAL SAUER: Well, we agree that it's a major power, but it's in the context of a statute that is explicitly conferring major powers, that the point of the statute is to confer major powers to address major questions, which are emergencies. So it would be unusual... And another excerpt from the hearings on fentanyl- JUSTICE KAGAN: And, in fact, you know, we've had cases recently which deals with the President's emergency powers, and it turns out we're in emergencies everything all the time about, like, half the world. Andy Grove makes this passionate plea for the dignity of workers in America in 2010. It is worth reading in 2020 what this founder of Intel Corp and pioneering spirit of Silicon Valley has to say. Andy Grove of Intel says there is something seriously wrong when the unemployment rate in the Bay Area is higher than the 9.7% national average for the USA. American companies have added jobs like crazy in Asia, but things are sputtering back home. Hon Hai has 800,000 employees and makes most of the electronic and computer products for American companies. Grove says startups are not the answer, unless they scale up and create jobs the way Intel did starting back in 1968, with a $3 million capital infusion by investors. The move from the first production model to mass production is critical, as companies hire thousands of people. Innovation and scaling up have to go together. He makes his point clearly by pointing out that Apple has 25,000 employees. For every Apple employee there are 10 employees in China working on Apple iMacs, iPods, iPhones. And he adds that the same 10 to 1 relationship applies to other U.S. tech companies. And here Grove asks the tough question by first posing an answer. He says it sounds like- no big deal, we keep the high paying jobs, we keep most of the profits, but what kind of society are we going to have with highly paid professional workers and lots of people unemployed? And he doesn't mention that there are a lot more young people unemployed. He says the US has become very inefficient at creating tech jobs, and it would be a great mistake not to act decisively early on. And adds that the investments in such areas as solar power and electric car batteries have to be made early on to maintain leadership in these areas. Grove faults academics like Alan Blinder and others who say loss of manufacturing jobs and whole industries was no big deal. The U.S. has forgotten the value of manufacturing jobs. He wants to see America focus on jobs and rebuild its industrial base. And less of transferring engineering knowhow and new technologies overseas, technology that can help bring innovation and scaling up of factories at home. In his view individual companies doing their own thing, in a misguided fashion that jobs don't matter, is not the answer to the situation we face. The industrial economies of Asia, China at the present day, have focussed on jobs and technology, and scaled up. Grove reminds readers of the situation in America in 1932, when jobless veterans demonstrating outside the White House in large numbers were dispersed by soldiers with live ammunition and fixed bayonets. This makes him shudder at the very thought of it, and brings back memories of his early years in Hungary, as a young man in 1956. Are we listening? ...

The electricity grid in Africa is being strained by electricity demands of mining companies. Power outages are costing African economies as much as 2% of their GDP according to World Bank estimates. Energy shortages in South Africa are creating blackouts in South Africa and neighboring countries Botswana and Zambia and affecting the mining industry in these countries. South Africa's energy company Eskom is petitioning regulators for a hike of 50% in electricity prices to reduce demand. Shortages of electricity have increased prices of platiinum and other metals in the commodities industry. Mining in South Africa produces 7% of GDP but consumes 17% of the electricity leaving less for domestic consumption and for industry. Eskopm was late in ordering new plants not taking action till 2004. For Africa the total electricity generating capacity of 63 gigawats supplies 770 million people about what Spain generates for 40 million people. And the expression energy poor means that this shortage in urban areas means the rural poor wil have no electricity for decades to come. And in places like energy rich Port Harcourt Nigeria electricity is inconsistent or in dire shortage. An accountant at a construction firm in Dakar, Senegal has to choose between paying his child's school fees or paying for electricity, chooses to pay for electricity as prices have gone up by 88% in 3 years. And rural areas of Africa have little hope of electricity. This is another sign of how adverse effects of huge energy consumption in places like China and the wasteful consumption in the USA affect global energy prices and in turn affect the poorest in Africa. In places where the voices will never be heard. How boom times in some Asian and westen economies can lead to choices like fuel guzzling vehicles and energy wasteful plants in China that reverberate across Africa....

Gokhale describes the intense discussions that are taking place in the inner circles of all three parties, Merkel's CDU out of power questioning Merkel's policies of building so much concentration of business in China, the SPD questioning why it went along, and the Greens knowing that India is their natural partner and the one partner that thinks and acts most like the Greens Baerbock and Habeck. Baerbock is critical of the sale of a stake in Hamburg port to China. No other German leader is like Baerbock, who feels really at home in India in a way that few German leaders have during her recent visit. There is so much change in the Biden administration and in the three major parties thinking about China and how the future of the western nations rests squarely on India's shoulders and its young aspiring population of 1.2 billion, that even India under Modi's leadership for technological change and infrastructure has not kept pace with these changes. Enough actas were collected in the Venezuela elections that show a landslide win with a 38% margin for Gonzalez over Maduro. The Maduro government has not accepted the result. It shows 7.3 million votes for Gonzalez, a former diplomat, to 3.3 million for Maduro the successor of Chavez, says the Wall Street Journal. For president Biden it was the surge in Venezuelan migrants flow and the refusal of Maduro government to take back migrants making deportation difficult, that precipitated the immigration crisis as an issue in the 2024 elections. The problem was tackled by closing the border with Biden taking executive action, after the law closing the border cleared the Senate in February but was held up in the House by Mr. Trump. Trump hoped to benefit from the Border issue to get elected in November 2024 held it up. That law was negotiated by Republicans McConnell and Lankford and Biden. Kamala Harris says the first thing she will do if elected is to pass that law. Republicans like the Tories in the UK are now seen as pandering on the issue to keep power, not keen on resolving it once and for all. As we show from the example of Mette Frederiksen in Denmark and her far sighted thinking it is possible to be good for workers and families, and tough on immigration that hurts workers by creating like foreign wars a huge and unnecessary distraction. Why for instance must workers and families live from paycheck to paycheck because of misgovernance in Asia or Africa or Arab world ,or deliberately created wars to empty countries of population as in Arab lands. Taking the issue up in the countries themselves with whatever action is needed was the right answer from the beginning, and lost on Merkel and other leaders in the US and Europe.
