Einer Elhauge, professsor of law and founding director of the Petrie-Flom Center in Health Law Policy at Harvard University, says there are limits to Congressional powers under the Commerce clause such as enacting a law requiring Americans to eat broccoli. If the health care law required all Americans to subject themselves to health care this would be the case. But the law only requires all to buy insurance so that insurance can cover the costs of healthcare for all. He points to the "necessary and proper clause" as also authorizing the health care mandate. That clause gives Congress the power to pass laws that are "rationally related" to execution of constitutional powers, such as criminalizing the interference with mail, on the basis of the constitutional power to setup post offices. In this case the health care law mandate is related to the constitutional power to regulate premiums and prohibit rejecting the sick, says Elhauge.

Shiller points to a Gallup poll that shows that two thirds of Americans don't see a recovery in two or more years. He cites the economist Samuel Bowles who points to the errors of thinking that a high performing economy can be based on self-interest alone. In these lectures titled "Machiavelli's Mistake" at Yale, Bowles warns that the overuse and abuse of incentives that appeal to individual's self interest only could lead to a collective disorientation. He points to a book "Identity Economics" that carries the same theme. In that book economists George Akerloff of the University of California, Berkeley, and Rachel Kranton of the University of Maryland, show that an economy works well when peple identify with it . Their self-esteem has to be woven into the activities of the society and economy. This describes today's mood where other polls done by Wall Street Journal and NBC in January 2010 show a majority of people do not see a bright future for their children's generation. And it has become hard for ordinary Americans to identify with activities in an economy where individuals are pursuing their self interest regardless of how it benefits the society and the economy as a whole....

Questions about the U.S. raid at Abottabad on May 1, 2011, that killed Osama Bin Laden. Was a Pakistani military helicopter involved in the raid as the Pakistanis say. President Obama said that the U.S. did not trust anyone, especially knowing where he was located. Abbottabad is 40 miles from Islamabad, and the location of a Pakistani military academy. Obama's statement that no intelligence was shared with the Pakistanis makes sense till the next question that comes up immediately. That question is how American helicopters took off close to the Osama compound- in an area with a large military presence- without the Pakistani military knowing.

Friedman points to Congressional Research Service numbers showing that of the D.of D. workforce contractors accounted for 48% in Iraq and 57% in Afghanistan. Allison Stanger of Middlebury College who wrote the book "One Nation under Contract: The Outsourcing of American Power and the Future of Foreign Policy," says tasks of diplomacy, development, defense and even intelligence are all outsourced. And State and USAID are also heavily outsourcing. In 2008 roughly 80% of State Department budget went out in the form of contracts and grants.

Experts in both the USA and China say that the trade deficit will remain a problem in US-China relations, as China now wants to see not an appreciation of its currency but some devaluation of its currency to promote its exports. Additionally both Congress and Mr. Obama are looking at trade relations carefully. Obama has been critical of how unfettered free trade has not been beneficial to both countries.

Corner Office, is a new Sunday Business feature in the NYT. This interview with Greg Brenneman of the turnaround at Continental Airlines, was done by Adam Bryant. Corner Office will cover leadership and Management. This is a wide ranging interview with Brenneman sharing not only his philosophy on work and business, but also his philosophy of life. He describes his approach to a company based on asking what are the two or three most important things you do, levers that you pull, that will make a difference in this company. It should all fit in one page. If its not simple and easy to tell a colleague, then its not right or its too complicated with buzzwords. Another approach is ask what are the 2 or 3 things you don't do which are bleeding the the business. Can you put these things down on a mental page, just one page, just 2 or 3 things that stick out, you absolutely don't want to do. That helps you put down the plan of attack. Brenneman sees too many executives focussed on economic gains and not having a rounded life, a balance that helps them lead happy, productive lives. In his view the balanced person is better at work because he finds fulfillment from all aspects of life. What leaders consider important is a shadow that they cast on the whole organization, in Brenneman's view, making it very important that the leaders actions convey the right message that they care about people....

Because not much money is being spent the velocity of money as measured by the ratio of GDP to M2 money supply is at a low not seen since 1991, in the 4th quarter 2008. If GDP shrinks in the 1st quarter 2009 at 6% annualized rate as expected, then M2 velocity will be the lowest since 1987, even with the accelerating growth of money supply growth. The M2 money supply, a measure of money in the system including time deposits has grown by $767 billion or 10% in the past year accoding to the Fed. Money that is not being spent is building up in amountain of cash reserves. Banks have about $679 billion in reserves of cash, and this matches the $653 billion by which money supply has increased during that time as aresult of the Fed's repeated infusions. This suggests that inflation is not the risk that it would appear to be, even with the governments huge spending plans and the Fed's efforts to add so much liquidity. Says one economist, the money multiplier is just not working and is broken. Will consumers start borrowing and spending again. Not as long as they are so overstretched and with job losses mounting. And will banks continue to cautious and slow to led? Most likely as long as the bank's balnce sheets are broken, and the bad assets remain on them. This may explain last weeks efforts by the Fed to buy Treasury bonds upto $300 billion and more efforts to get credit flowing again by buying up mortgage securities and raising the ceiling to $1.25 trillion for purchases. cash...

How the IMF conditionality has changed in the 2009 global economic crisis. The IMF head, Dominique Strauss-Kahn of France, is aware how sensitive nations around the world have become to the word IMF. So much so that it has even suggested removing the word IMF from loans to get takers. The IMF conditons worsened the S. Korean financial crisis in 1998. See link to this. This time Kahn has advocated that the developed countries of Europe and the USA increase stimulus spending to 2% of GDP.And there are fewer calls for cutting spending in developing countries offered help by the IMF. Pakistan was asked to increase interest rates by 3% but actually increased them by 2% to fight inflation. But to get some idea how the IMF is viewed with suspicion and hostility in many countries one has to listen to comments made. The move for Pakistan was so unpopular in 2008 that Mohsin Khan a top IMF official says he met with agroup of generals to get their backing. Some IMF officials insistend on a 10% rate increase. Something like that would have led to riots in Pakistani cities. IMF loaned Pakistan $7.6 billion. When S. Korea said no to the IMF credit line, Lee Hyoung-ryoul, a Korean Finance Ministry official said that S. Koreans tremble and financial markets turn sensitive whenever they hear the word "IMF." This time Brazil, S. Korea and Mexico, were offered condition free credit lines. But it has found no takers from these three conuntries, so badly is the IMF viewed in developing countries. Even though it appears that Kahn, in the small club of western nation's officials and staff that form the governing body of the IMF, is trying to give the IMF a new image, its just so bad and the views of the old timers at the IMF on spending or interest rates so contrary to the needs of people in the developed and developing countries, that a new generation of people in finance and economics will be needed before real change is established. ...

Wayne Mullins, the Senator from Oklahoma, is doing his best to restore the reputation of the nation's Department of Homeland Security, after the messy period under Kristi Noem who violated the department's norms and allowed all sorts of inappropriate behaviours for what is the nation's largest law and order organization. It is vital that the people have full confidence in the Department to have full confidence in the rule of law, and for internal security in the US at a time of illegal migrants by the millions crossing the nation's borders with impunity during the last administration.
