US relations with Japan and South Korea are improved and both nations are taking a bigger role in their region with other partners India and Australia -so that the US frees up resources for tackling domestic and foreign problems that ensure US regains its position as a powerhouse for manufacturing, industry and world class infrastructure in the next decades to 2050. US and Chinese trade negotators vice premier Lifeng for China and Scott Bessent, Treasury Secretary, Jamieson Greer USTR, meet in Switzerland, for talks on tariffs of 145% and 125% on each others goods. An agreement for a 90 day pause is reached. During that pause period tariffs will be 30% by the US, and 10% by China on imported goods. The 30% tariff of the US includes the original 10% tairff on all nations and the 20% tariff for China not doing enough to stop flow of fentanyl  into the US. I mean, it seems that it might be directly applicable. You have a claimed source in IEEPA that had never before been used to justify tariffs. No one has argued that it does until this -- this particular case. Congress uses tariffs in other provisions but -- but not here. And yet -- and correct me on this if I'm not right about it -- the justification is being used for a power to impose tariffs on any product from any country for -- in any amount for any length of time. That seems like -- I'm not suggesting it's not there, but it does seem like that's major authority, and the basis for the claim seems to be a misfit. So why doesn't it apply again? GENERAL SAUER: Well, we agree that it's a major power, but it's in the context of a statute that is explicitly conferring major powers, that the point of the statute is to confer major powers to address major questions, which are emergencies. So it would be unusual... And another excerpt from the hearings on fentanyl- JUSTICE KAGAN: And, in fact, you know, we've had cases recently which deals with the President's emergency powers, and it turns out we're in emergencies everything all the time about, like, half the world. Let sleeping tariffs lie is the approach of S. Korea, Taiwan, Japan, China, India, European Union, Germany, UK-  expect all trade agreements with the US to remain in place after Supreme Court decision as no country wants to go through the intensely difficult process of renegotiating on tariffs. It is also the case that DJT can replace these same tariffs using other tools and different legislation passed by Congress to stop unfair trading practices by other nations. The president is also appealing to the public, some of the tariffs are about fentanyl flows into the US, the unfair trade practices and subsidies were a problem for the Biden administration and rebuilding manufacturing was the goal of both DJT and Biden, and will be for future administrations.  When the media NYT, Washington Post respond they are following the editorial line taken that opposes the DJT administration on all issues, when WSJ respond it takes the textbook approach of economists and finance people that free markets are best without considering the real life issues. This is why the president said at his press conference after the Supreme Court decision that 22 Nobel Prize economists had said the economy could not be turned around for growth and low inflation in 1 year, and were proved wrong after the experience of 2025 with low inflation at 2.8%, low unemployment 4.3%, and growth of 2.2% in real GDP (with strong growth in quarters 2&3 of 3.8% and 4.4%). Does a 10% reduction in tariffs on China with the October 30 2025 agreement- made in Busan South Korea at APEC meetings- make a difference for companies relocating from China? It only does for smaller companies who are stuck with Chinese sources. Larger American companies prefer to diversify their supply chain and continue to relocate part of their factories to Vietnam, India and other countries knowing that the tariffs game will end up with allies EU, Japan and India in the 10-15% tariff range as a concession to US for putting up with trade disadvantages and job losses 2000-2025. China's will still be at 47% in comparison and the fentanyl issue causing serious questions to be asked by the American people which have not been grasped in China or even in the US by companies and politicians.   Does it affect the urgency and general shift out of China? The fentanyl issue is unlikely to change and it is likely to do lasting damage to China's credibility to a degree that it not clearly understood in China, and even not fully grasped even in the US today because of the sheer size of the number dead- more young Americans dead from fentanyl than in the Korean, Vietnam and First World Wars combined. Other issues are technology that has been transferred without a proper assessment of the importance to national security, the need to shift the manufacturing base back home that US industries have inadvertently and carelessly shifted to China in the disastrous Bush and Obama years 2000-2016, and for the jobs, the wages, and cost of living concerns when supply chains are outside one's control. This article asks the question about tariffs on India and Brazil as being contradictory and showing a lack of consistency in tariffs. India is compared to China with India facing a 50% tariff because of Russian oil purchases, and Brazil a 100% tariff related to treatment of former president Bolsonaro even though US has a trade surplus with Brazil. One expects that at some point India and the US will come to an agreement that lowers the tariffs in a way that was done with the European Union to bring it closer to 10%. China's tariff to be sure is still around 47% dropping from 57% a concession for rare earths and for the upcoming elections and economic concerns not because of policy intent which has not changed on  strong action for fentanyl which is also part of the Appeal to the People in the DJT base.   ...

The new US president DJT says- "I have had many talks with China about the massive amounts of drugs, in particular fentanyl, being sent into the United States – but to no avail. Representatives of China told me they would enforce their maximum penalty, including the death sentence, for any drug dealers caught doing this, but unfortunately, they never followed through. As a result, drugs are pouring into our country, mostly through Mexico, at levels never seen before. The title says it all from BBC China Correspondent Laura Bicker. China is listening even as it is presenting itself as a nation that is putting up with an unfair tariffs war started by DJT. It has delayed tariffs till Feb 10 says this report and put tariffs on items which Europe needs from the US such as LNG and coal which China can get from Australia, saying that it wants to come to an agreement. My Fellow Americans, Canada, Mexico and China are putting themselves as aggrieved parties when there are two issues here one about fentanyl flows where none of the three nations have taken the needed action to stop all flows and control borders. The reader will find that much of the media titles blame the US for starting a tariffs war are misleading such as one in The Guardian-"In this era of Trump shakedowns everything has a price."  Or even in a Business friendly WSJ site- "The World has Changed since Trump's First Trade War. Other Countries are Ready to Fight Back." Or in Times of London sensational "World Watches as Trade War looms between China and the US," when US demand for effective action on borders and fentanyl flows from Canada, Mexico and China has little to do with trade. US Supreme Court hears arguments from D. John Sauer Solicitor General of the US on DJT Tariffs Wednesday, November 5, 2025. The Supreme Court will hear about a case brought by a small wine importing company with 19 employees. The US president used the 1977 International Emergency Economic Powers Act (IEEPA) that allows the president to impose tariffs. The IEEPA was introduced by president Jimmy Carter in 1977. It was used during the Iran hostage crisis. It has been used for the Venezuelan regime after elections were rigged with human rights violations, on Belarus as early as 2006, and on Mexico for drug cartels. This increases the responsibilities of the Justices of the Court as these sanctions have broad support of the American people. Tariffs were imposed on China for illicit fentanyl flows and a 25% tariff was imposed on Canada and Mexico under Executive Orders 14193, 14194, and 20% on China under Executive Order 14195 in 2025 for illicit drug traffic flows across their borders into the US. Illicit flows that has taken the lives in the case of fentanyl of more young people than were killed in the Vietnam, Korean and First World Wars combined.  For the reason that the economic aspect of tariffs now overlaps with trading partners abuse of basic rights of their largest trading partner the US in the case of Canada, Mexico and China not stopping such flows, the issue before the Supreme Court is basic to the US as a Nation to protect its citizens under these Executive Orders and IEEPA- not the kind of interpretation of the law the USC does for most or almost all of its cases. In 2025 a lot of the discourse is distorted and does not reflect the way citizens of the Nation should show concern for the welfare and safety of their fellow citizens in communities around them severely hurt by the scourge of fentanyl and other opioids making their way from other countries conducted by drug trafficking gangs outside the US.  Also relevant is that the tariffs are correcting trade deficits of $1 trillion of the world with China that threaten the economic security of the US, EU, India and other countries. Larger companies are moving their supply chains out of China to reduce concentration in China, impact on inflation is slight with 3.0 % inflation in September 2025. Smaller companies such as the wine company in this lawsuit are unable to do so. Most of the smaller businesses affected can be compensated with a fund from the tariffs revenue of $500 billion in 2025-2026. In this way the goals of the US as a Nation can be achieved of reducing the supply channels concentration in China, cutting supply chain concentration in China, for fair trade with trading partners EU/Japan, and for action on fentanyl and drug trafficking. Justice Roberts and his team have a lot to think about in this effort by the Nation to correct abuses that should never been allowed to happen. ...

US president's sweeping powers to use tariffs as a tool for policy when American people's jobs, communities, health, is threatened by fentanyl and concentration of manufacturing jobs in China, unfair trade by EU and Japan, is the issue presented to the US Supreme Court. The US president presented it in this way- tariffs as a foreign policy tool, not a way to impose economic policy in the form of a tax on American importers or buyers which is the power allocated to Congress by the US Constitution. Justices who mentioned these powers called them sweeping powers but would not say the word fentanyl or look back at the recalcitrant behaviour of Asian nations Japan and China when it comes to unfari trading practices, where the US could literally negotiate forever and get no result, or to the enormous concentration of manufacturing power and supply channels in China that not only ships out American jobs but leaves Americans at the mercy of foreign powers for cost of living. Nowhere was this more evident as during covid years and now in rare earths export restrictions from China. The Justices assumed it was just alright to ignore this or leave it unsaid.  The cost to American buyers is small because most of the tariffs are borne by foreign suppliers in China, Japan and Germany, who as in the case of automobiles unfairly benefitted for decades and are now bearing most of the cost of tariffs. The large business in the US have increased their margins so much in the 2020-2024 period that they are now bearing some of the cost of the tariffs, as reported in WSJ. So that inflation in the US is at 3.0 % in the US less than anticipated, when average tariffs are at about 10% overall, not what the headlines say of 15-20% because of the product exceptions made in the tariffs for each nation. Justice Roberts may be right when he says more care should be exercized in the placing of a tariff, but even Roberts and Justices Barrett, Gorsuch, Kavanaugh and others know that the US has used this as a last resort, as a policy tool to protect the American people. Sweeping powers need care and caution as Justice Roberts stated- “power to impose tariffs on any product from any country in any amount for any length of time. It does seem like that’s a major authority."   ...

Biden goes to Brownsville, Texas, on the same day that Trump goes to the Texas border with Governor Abbott. Biden talks to Border Patrol and Trump visits a barbed wire section of the border with Abbott. The two visits show different approaches to the fight to control border crossings of migrants that reached 250,000 in December, an all time high that requires action and has the support of the president. Biden offered a compromise legislation with Republicans in the Senate which passed 70 to 30 with 22 Republican senators supporting Biden to toughen the asylum policies, add Border Patrol resources, and make it harder for fentanyl to enter the country. Biden has worked out and agreement with China and Xi Jinping as part of an overall economic agreement and cooperation to eliminate the source of fentanyl production in China. Republicans led by Trump hoped to use immigration as an issue in the election in Nov. 2024 and refused to even let the House vote on it, as there is likely a majority in the House that would pass it over Mr. Trump's objections. Republicans now look to president Biden to issue executive orders to get the job done to which Congress offers it deference today. Biden has the State of the Union speech coming up next week.   ...

A remarkable change has happened in a matter of 100 days in Canada's stance on immigration and fentanyl flows. Trudeau now calling for eradication of fentanyl, his deputy prime minister saying Canada has more fentanyl deaths per capita than the US because of smaller population, and the need to wipe it out off the face of North America. The Canada Conservatives generally support DJT. The Trudeau Liberals have shifted policy to support DJT policies on immigration and fentanyl flows. In general Canada is making a pronounced shift towards support of the US position on immigration.  It is not just DJT policy as closing the border was part of the agreement agreed by Biden in 2024 with Republicans in Congress led by Lankford-Graham-McConnell which was not passed because it was too close to the election. One can only say the Covid pandemic, vaccination shortfalls, failures of supply chain distracted Biden from acting early and similar to DJT on the first phase of immigration action on illegal migrants committing offenses. The release of illegal migrants across the US is something that Democrats will years from now see as a major error in its policies. The main lines of the Message to Congress by the US president in 2025 related to flood of illegal immigration, and illegal fentanyl flows with deaths of Americans in the most vulnerable neighborhoods across 51 states over 12 years, 490,000 deaths, more than Vietnam. "The media and our friends in the Democrat Party kept saying we needed new legislation to secure the border—but it turned out that all we really needed was a new president.” As it turns out the legislation Biden with Republicans led by Senator Lankford negotiated in Feb 2024 did not have the strong action taken in the first 100 days to deter illegal immigration and remove illegal immigrants endangering safety in American neighborhoods. That legislation did not have provisions to bring illegal fentanyl flows into the US to an end with strong action including tariffs on CMC countries Canada, Mexico and China responsible for the fentanyl flows into the US. Transgender was another issue addressed in the speech with DJT clearly stating that their only two genders and against mutilation of bodies, with trust in God about the gender God placed us in as best for us. Other issues were about tariffs action going into effect on reciprocal tariffs on April 2 with all nations including India, Europe, China, Japan, South Korea. DJT cited India for high tariffs, South Korea with 4 times American tariffs, and European nations. The goal was to ensure a level playing field for the US to compete- "what they charge us, we charge them." As explained in an earlier article in the WSJ reciprocal tariffs in the world context mean commodities products would not have price increases for the US consumer, smartphones autos would increase but this would be temporary as these nations play fairly and create a level playing field, and these products manufacturing is shifted to the US. This would mean growth for US auto industry and smartphones coming from inside the US and from India offsetting concentration of production in China. China imports from the US only $143 billion and much of this is soyabeans (US farmers), petroleum oil products (buyers in Europe and Asia), aircraft (Boeing). Farmers were compensated from the tariff revenues in the first term, oil products would be shipped to Asia and LNG to Europe to make up for loss of supplies from Russia. India will take up the Boeing production as it's economy expands to levels China, Japan had earlier. The action is a last resort as 490,000 lives were lost in 12 years from the fentanyl shipped raw materials from China and drug trafficking gangs in Mexico processing it in labs to ship across the long US border or Canadian border into the US. China and Mexico have not stopped the flow of fentanyl into the US. How much is 490,000 American lives worth? That is 5 times the lives lost in the Vietnam War and the Korean War combined of 100,000 lives lost in both wars. China exported $436 billion to the US in 2023 increasing by about 6% from prior year. Integrated Circuits alone were more than all US exports combined to China at $154 billion. Electric batteries another $80 billion. Computers and office machine parts were $54 billion. Where will China ship all these products. It is brave but it is easier to stop fentanyl flows out of China, and cut all the trade barriers, reverse state policy to dominate key industrial sectors in State Planning. The problem in the stock market response is that this is a trade war which it is NOT. It is about National Security if this is allowed to continue as Clinton, Bush, Obama have allowed to happen US is in real danger of becoming a second rate power in the world, at which point the world will become a dangerous place with India, China, Russia, Germany and other states having no constraints to create future wars without US to set some basic principles of world peace. UN itself would not exist without Cordell Hull and FDR. The world we know will be GONE. The Trump Accounts for children born 2025-2028 and the Dell $6.5 billion expansion to include earlier born children may be one of the single biggest actions to rebuild the bank accounts of the next generation. It looks at the shrivelled bank accounts of today's older generation with lack of enough savings for a medical crisis and says it has got to be different from now on. The median bank account of Americans over 65 and over is $13400 which means there is little for medical health emergencies and little for needs of older Americans. Median means half have less and half have more than $13400. This is astounding for the wealthiest nation at a time when the total wealth is the highest ever in history. This report by WSJ unfortunately does not mention this at all and dwells on how this is an opportunity for banks and investment companies to get in the door to get your business. DJT as US president with a mandate from lower income Americans has designed this so that it shows the value of careful investments of small seed money. With $1000 to begin with from the government, added amounts from parents and grandparents and invested in a mutual fund that tracks the S&P 500 it will grow with the economy for 18 years, doubling two to three times on the way. Does the ICC, the International Criminal court have jurisdiction over US policy in the Western Hemisphere? The ICC was founded in 1998 with the Rome Statute which was signed by US president Clinton but never ratified. President Bush unsigned for the US and Congress passed the ASPCA American Servicemen's Protection Act to protect Americans in the armed forces from prosecution by ICC. The US sees the ICC as infringing on its sovereignty. As most UN institutions with members from 125 (ICC) or 193 countries (UN) the tendency or bias is to be critical of the US in a "anti-imperialist" sense and for European states that practiced colonialism to also have the same tendencies. For instance the Monroe Doctrine was to keep European colonial powers out of the western hemisphere, out of Latin America, so that institutions modeled on the US and the UK including democratic representation, courts and rule of law could thrive. In today's context it is for the US to keep drug trafficking gangs and crime out of the western hemisphere. The ICC easily ignores the lack of rule of law, drug trafficking, and millions of of refugees, in favor of single incidents where violation has not caused massive harm to tens of millions of people and enormous deaths such as the Mexican drug trafficking that has cost more lives from fentanyl than the Korean, Vietnam and World War 1 combined.  In fact without the US and the UK on which US institutions are modeled, much of the framework of civil liberties, rule of law, independent court, democratic representation would be lost.  The ICC is part of institutions that are answerable to no one and made up of the many independent states emerging from the colonialism of Europeans in the 20th century that have little experience in such institutions that are with science and industry the achievements of the modern world, and in many cases these new and numerous states are proof of egregious violations. It took many centuries for the UK to develop these institutions from the 16th century and the US from the 18th century, and it is American and UK institutions that are the foundations for protecting the rights of citizens and of the people in the modern world. ...

It is too early to say it is a playbook. Trudeau's action may be more effective in the long run. The issue of fentanyl from Mexico is different in 2025 from the first term of DJT in 2016, 8 years later with 490,000 deaths from fentanyl in the US, a part of America's younger generation- unprecedented in American history and since the settling of the American continent since 1600. Fentanyl smuggling into the US from Mexico is the biggest issue facing the US along with closing the US Border. This report in the WSJ says Sheinbaum tried to deflect 25% tariffs by making the offer of sending 10,000 troops to the US Border. This was similar to her predecessor saying he would send 28,000 troops to the Guatemala Mexico border to stop migrants. DJT raised the issue. The week before the Feburary 3, 2025 call between Sheinbaum and DJT the White House said Mexican drug-trafficking organizations “have an intolerable alliance with the government of Mexico.” These are aspects of the problem that the White House needs addressed in effective ways to stop the flow of fentanyl into the US. Action from the first term of DJT has not solved the problem so that DJT will have to find real effective solutions. The Canadian government followed its own approach. It set $140 million for a new unit to gather intelligence on organized crime. And appointed a head for an organization on stopping fentanyl from entering the US. Canadian PM Trudeau followed the US and DJT in labelling the Mexican cartels as terrorist organizations. Issues the US faces with Mexico that remain unresolved are the $150 billion deficit and bringing home US manufacturing in the auto industry back to the US.   ...
