US Supreme Court hears arguments from D. John Sauer Solicitor General of the US on DJT Tariffs Wednesday, November 5, 2025. The Supreme Court will hear about a case brought by a small wine importing company with 19 employees. The US president used the 1977 International Emergency Economic Powers Act (IEEPA) that allows the president to impose tariffs. The IEEPA was introduced by president Jimmy Carter in 1977. It was used during the Iran hostage crisis. It has been used for the Venezuelan regime after elections were rigged with human rights violations, on Belarus as early as 2006, and on Mexico for drug cartels. This increases the responsibilities of the Justices of the Court as these sanctions have broad support of the American people. Tariffs were imposed on China for illicit fentanyl flows and a 25% tariff was imposed on Canada and Mexico under Executive Orders 14193, 14194, and 20% on China under Executive Order 14195 in 2025 for illicit drug traffic flows across their borders into the US. Illicit flows that has taken the lives in the case of fentanyl of more young people than were killed in the Vietnam, Korean and First World Wars combined.  For the reason that the economic aspect of tariffs now overlaps with trading partners abuse of basic rights of their largest trading partner the US in the case of Canada, Mexico and China not stopping such flows, the issue before the Supreme Court is basic to the US as a Nation to protect its citizens under these Executive Orders and IEEPA- not the kind of interpretation of the law the USC does for most or almost all of its cases. In 2025 a lot of the discourse is distorted and does not reflect the way citizens of the Nation should show concern for the welfare and safety of their fellow citizens in communities around them severely hurt by the scourge of fentanyl and other opioids making their way from other countries conducted by drug trafficking gangs outside the US.  Also relevant is that the tariffs are correcting trade deficits of $1 trillion of the world with China that threaten the economic security of the US, EU, India and other countries. Larger companies are moving their supply chains out of China to reduce concentration in China, impact on inflation is slight with 3.0 % inflation in September 2025. Smaller companies such as the wine company in this lawsuit are unable to do so. Most of the smaller businesses affected can be compensated with a fund from the tariffs revenue of $500 billion in 2025-2026. In this way the goals of the US as a Nation can be achieved of reducing the supply channels concentration in China, cutting supply chain concentration in China, for fair trade with trading partners EU/Japan, and for action on fentanyl and drug trafficking. Justice Roberts and his team have a lot to think about in this effort by the Nation to correct abuses that should never been allowed to happen. ...

Reagan words taken out of historical context by Ontario ad- Lighthizer as Reagan's USTR negotiating with Japan experienced Japan's efforts to unfairly capture world markets. It was only after years of negotiation that Lighthizer was able to get Japan to play by fair rules of world trade. In 2025 Jamieson as US Trade Representative for the US is Lighthizer's deputy in prior negotiations with Asian trade partners who have unfairly gamed the system to their advantage. Canada, Mexico and China are misrepresenting the facts to show they play by the rules when they clearly and blatantly flout world fair trading practices that lead to losses for American workers. The reality is that the Smoot Hawley tariffs by the senators of states that were not industrial states in the US inthe 1930's were adopted by the reckless atitude of Herbert Hoover as president and by senators who had no grasp of world trade. Senator Harry Truman from Missouri as president made correcting these mistakes a top priority in the late 1940's. Today's abuse of the system by Asian countries and Canada, Mexico have nothing to do with the tariffs of the 1930's- America wants all nations to play by the rules which over time will create a stronger world trading system. ...

Starmer's visit to China and the result being halving of tariffs- it comes 8 years after Theresa May's visit 2018.  Starmer is following his intution  to set an independent course for Brtian's foreign policy. It makes sense as the US is using common sense in coming back to basics, to getting its own hemisphere policies right. How could there be a situation like that in Venezuela and Mexico as with the drug cartels operating as states within states- what would Teddy Roosevelt say about this? So we now have the Monroe Doctrine, the return of the Panama Canal, the restructuring of the oil industry in Venezuela, and other action. This also means Canada and UK, India, European Union can pursue policies that are common sense. It means for Britain a new openness with China after 8 years inward looking with Austerity, Brexit and Covid. For a smaller economy it makes sense for Britain to have agreements on trade as it signed with India, and now with China. Carney, Starmer and soon Merz will have worked out relations with China on trade and exchanges. For Europe and the US over concentration of making goods in China can be corrected while still engaging with China. For the EU the visits Germany's Merz made to the kite festival an India and Leyen/Costa of the EU following up with trade agreements are all part of common sense to not just reduce over concentration in China, but also to build a new partnership with India to form a 2 billion people market. All of which happened suddenly as European nations realized how to work out new arrangements following the war with Russia over Ukraine and China's support for Russia, taking up the cues from DJT common sense action in its backyard. "I'm a pragmatist, a British pragmatist, applying common sense," the prime minister tells BBC on the plane and says he wants to "make Britain face outwards again."  ...

The WSJ calls it a chaotic runup while conceding that the stated purpose was clearly to stop fentanyl and migrants coming across the US land Borders with Canada and Mexico. In reality its purpose is clear and it is the recalcitrant positions of Canada and Mexico and the failure of previous administrations since Clinton-Bush-Obama to act forcefully in the face of such an attitude that was the problem. Of what amounts to indifference from Canada and Mexico to fentanyl flows  and the destroying of America, that made it imperative for America to use all the powers at its disposal to get action to stop fentanyl and migrants.  These powers at America's disposal include economic power tariffs being one, and other powers as necessary, as no nation can long endure such indifferent attitudes to harm done against another for long. 11 Pacific Rim nations form the Trans-Pacific Partnership in 2018. The Obama administration supported the trade pact alienating supporters in its union base particularly in the midwestern states. Mr. Trump opposed the TPP in his election campaign and made it a significant issue for swing voters in midwestern states after job losses in the auto industry. With the opposition of president Trump the U.S. decided to withdraw from TPP.  The 11 nations agreeing to join a revised agreement are Japan, Canada, Mexico, Australia, Brunei, Chile, Malaysia, New Zealand, Peru, Singapore and Vietnam. So far six countries have formally approved the deal, Australia, Canada, Mexico, Singapore, New Zealand and Japan, setting the stage for two rounds of tariff reductions starting December 30, 2018. Agricultural products duties will be duty free within 3 to 7 years including for Japan and Mexico. Australia, New Zealand, Canada are major agricultural exporters. Japan supported the deal as a way to counter China's influence in the region. In the U.S. the gains would be in intellectual property rights but losses for workers in the auto and manufacturing industries, a point Mr. Trump recognized in his election campaign as he campaigned in the midwestern states. Mr. Obama pursued TPP over objections of workers organizations and unions including auto workers union, with his advisors suggesting this as a way to counter China's influence in the region. Greg Ip points out in this WSJ analysis that the new NAFTA after negotiations and warnings from Mr. Trump to scrap NAFTA, is not very different from the old NAFTA. Mexico made concessions on auto exports and labor rights, wages. Canada made concessions for the dairy industry. Yet the combined influence of business interests, Canada's lobbying in U.S. Congress and state governments, and the restraint shown by Trump's own advisers prevailed in limiting Mr. Trump's tendencies to go for a "America first" agenda. It shows, says Ip, that there is resilience in the existing order.  It also shows what future trade negotiations with the European Union and Japan over steel and autos could look like. President Trump will continue to face resistance within from his advisers and from exporters, business, Congress, on following an exclusively "America First" agenda. President Trump will need to extol NAFTA in its current version the USMCA, U.S. Mexico Canada Agreement, to get it through the U.S. Congress in 2019.   Mexico's main concessions on autos were to agree to potential tariffs if exports exceed 2.6 million vehicles.  This keeps Mexico's status as a major auto export hub intact. Auto experts say VW and Mazda may simply pay the tariff of 2.5% for lower priced models assembled in Mexico that do not qualify for duty free entry instead of shifting production to the U.S. Current shipments from Mexico are not affected as U.S. demand is weak. Labor rights and higher wages in Mexico's auto industry are a win-win for Mexico and the U.S.. They are supported by the socialist administration of newly elected Mexican president Obrador. Canada's main concession was to expand U.S. access to Canada's protected dairy industry, with Canada already prepared to make the concession. Mr. Trump had also to consider the possibility that excluding Canada from the USMCA would have not passed Congress, and face even more resistance in a Democratic controlled Congress after 2019 elections.  The support Canada has received in Congress does not extend to China, which gets much less support in Congress, leading to higher uncertainty in the negotiations with China and possibly different outcome with the size of the trade imbalance of $1 billion a day factored in.   ...

Instead of killing the NAFTA trade agreement Trump and his advisors prefer renegotiating the treaty. Priorities for the Trump administration are reducing the U.S. deficit with Mexico of $61 billion. Trade with Mexico and Canada is worth $1.1 trillion and the complex supply chains works such that product components cross borders more than once to become finished products. Mexico promotes its auto and other industries as duty free access to the U.S. for foreign investment. Special tariffs would reduce the trade deficit with Mexico and firms that moved production to Mexico would pay additional taxes. A provision that allows Mexican and Canadian companies to challenge U.S. regulations would also be removed. Rep. Brad Sherman (Democrat) says he supports the renegotiation so that duties of 4% are imposed to reduce the deficit to $25 billion.

The Trump administration's early proposal for NAFTA moves away from campaign pledges to completely renegotiate the treaty, instead taking the approach of working to improve the U.S. trade position in relation to Mexico and Canada. It includes seven objectives for tougher rules for labor and the environment favored by Democrats in Congress, and it also has support from Republicans with its effort to update NAFTA for changes in technology and in other areas since the accord was signed during the Clinton administration. The WSJ is still calling the president's stop fentanyl flows tariffs on CMC Canada Mexico and China economic tariffs in this editorial board opinion. It is incomprehensible that little or no mention is made in most of the media of the magnitude of injury to the US, the 490,000 deaths in America over 12 years as the result of Canada, Mexico and China not taking the needed action to stop fentanyl flows into the US. There is also the added factor of lack of a level playing field in trade which has resulted in the same communities in many cases having suffered from in the case of China loss of 25 million jobs over the last 10 years and loss of $250 billion in infrastructure and public services for schools, libraries, childcare, and health care clinics that were lost from losses in taxes for local communities in the US. This has decimated life in these communities and in small towns across America.  In the case of Mexico the illegal migrant flows that were not stopped at the border have put an added burden on already underfunded and strained public services in local communities in the US. This is the reason for much of the frustration and anger that has built up over time in these communities with the response from the DJT administration to find solutions. CMC countries could have taken action on their own, yet the US had waited too long for this action. Reciprocal in reciprocal tariffs is about fairness, a level playing field, something that China had agreed to in the spirit of the WTO entry in 1994 and American desire to aid China industrialize build a modern economy. Instead US business was coopted by China during the industrialization process 1995-2010, 2010-2020, including in the first term of the DJT administration even when tariffs were imposed. This happened with transfer of technologies happening late into the first term of the DJT administration 2016-2020, which has led to a much of the pent up frustration and action in the first 100 days of DJT in 2025.  ...

In his comments at the Congressional Institute DJT says his tariffs plan resulted in China cancelling building the largest automobile plant in the world just across the US border in Mexico to export these cars to the US. That plant was planned for a capacity of 1 million cars a year which would have hit the US auto industry hard. One in particular is massive. So they are going to build cars and send them to the US, for no tax or little tax, and destroy whats left of Detroit." "Mexico has taken 32% of business over 30 years. The other is Canada. They send us millions of cars. We don't need them for that. I said to hime when is this going to open. A couple of months. It will openin 1.5 years. I said I am not happy about that. And I said in my next speech I'm going to charge them. No cars coming ino the United States from Mexico without a massive tariff. I said it 3 or 4 times and what happened is about 2 months later I saw the same gentleman in the audience and I said I want to see you backstage. I said let me ask you what happened to that plant. Where is it now? He said China has canceled it. Why? Because they think you are going to be elected and charge tariffs on the cars coming in and it doesn't work."  "So Detroit will breathe and we are going to do the opposite. Companies can build plants if they want but they are going to have to build it in the United States."   ...

Much of the growth in 2022-2024 was a result of Biden administration government spending on infrastructure supported by private sector spending. With efforts to cut waste and set new priorities in government spending, growth in 2025-2026 has to come from private sector spending with the DJT administration. President Trump pushes forward with a deal with Mexico so that it can be signed before the new Mexican administration of Lopez Obrador takes over. This means leaving Canada out and having a separate deal with Canada later on. Mr. Trump sees negative connotations in the term NAFTA and would like to call it the "United States - Mexico Trade Agreement." Terms for Canada to join the agreement would be tougher and the pressure on Canada to strike a separate deal was increased with Mr. Trump saying there could be tariffs on imported Canadian made cars. Mexico has accepted revisions to NAFTA that make it harder for Mexico to challenge U.S. trade penalties. Mr. Trump's negotiating position is based on his conviction that the eagerness of other nations to sell in the U.S. market gives the U.S. a lot of clout. Mr. Trump also faces pressure from within the Republican Party to show results not just by imposing tariffs and playing hardball on trade but to come up with new trade deals. Steps taken by Mr. Trump were to impose tariffs of 25% on imports of aluminium and steel, and 25% tariffs on a list of imports from China including solar panels. President Trump hopes to get support from Democrats by including provisions that support trade unions in Mexico and higher wages in Mexico. Insurance companies will wait to see the impact and how long the tariffs are in place. Tariffs are put in place to stop fentanyl flows through Canada, Mexico and China to the US, which have cost 490,000 deaths in the US over the last 12 years. Canada now fully supports the US for action to be taken and cites similar loss of lives in Canada from fentanyl comparable to the US for its smaller population. Democrats vastly disapproving, the messaging on cuts to Medicaid even though it's funding had grown close to $1 trillion ($909 billion in 2024), the uncertainty on tariffs even though the $1 trillion China trade surplus needed serious corrective action, federal government job cuts, leads to much larger proportions of Democrats opposing than Republicans supporting leading to about 60% unfavorable overall on tariffs and Big Beautiful Bill. Such unpopular action is sometimes the role of government like the action to rebuild the trading system and bring restraint to runaway spending on benefits, and can be overcome with a strong economy and capital investment for growth in future years. Another problem for the DJT administration is in the messaging to get the message across when some of the president's actions can be inconsistent or appear inconsistent. Add to this the distractions such as international diplomacy on Ukraine that take the president's time. Yet changes were needed in the international trading system and tough action is sometimes necessary when most countries and groupings, China EU, Canada, Mexico, can game the system their benefit to the detriment of the American people and jobs/communities at home. On the Big Beautiful Bill at the rate of growth in funding for Medicaid to $909 billion in 2024 from $2 billion at its inception under LBJ in the 1960's some restraint on spending would ultimately keep such help flowing where it is needed over the long haul. ...

An assessment of progress in free trade and generating jobs in N. America under the NAFTA agreement between the U.S., Canada and Mexico. The agreement was signed under President Clinton in 1994. NAFTA removed existing tariffs on over half of the exports from Mexico to the U.S. and phased out remaining tariffs between the U.S., Canada and Mexico. The U.S. had two way trade of $918 billion with Canada and Mexico in 2010, according to the Office of the U.S. Trade Representative. Canada is the U.S.'s top trading partner, with $462 billion in trade through Sept. 2012, and U.S. trade with Mexico- expected to overtake China- is at $369 billion in the same 9 month period of 2012.

Mexico replaces China as the U.S. top trading partner in the first half of 2019. U.S. imports from China fell by 12% and exports fell by 19% in first half 2019, according to Commerce Department. The total value of trade with China of $271 billion was less than the trade with either Canada or Mexico.

Mr. Trump said yesterday to China- "If they don't want to trade with us anymore, that would be fine with me. Until such time as there is a deal we will be taxing them." He went on to say he would place 25% tariff on additional $300 billion of Chinese goods on Sept. 1, 2019.

Meanwhile in first half 2019 the U.S. imports increased to 34% from Vietnam. Some of this could be Chinese goods transhipment through Vietnam. Japan, South Korea, India, Europe, all increased exports to the U.S.

Transgender was another issue addressed in the speech with DJT clearly stating that their only two genders and against mutilation of bodies, with trust in God about the gender God placed us in as best for us. Other issues were about tariffs action going into effect on reciprocal tariffs on April 2 with all nations including India, Europe, China, Japan, South Korea. DJT cited India for high tariffs, South Korea with 4 times American tariffs, and European nations. The goal was to ensure a level playing field for the US to compete- "what they charge us, we charge them." As explained in an earlier article in the WSJ reciprocal tariffs in the world context mean commodities products would not have price increases for the US consumer, smartphones autos would increase but this would be temporary as these nations play fairly and create a level playing field, and these products manufacturing is shifted to the US. This would mean growth for US auto industry and smartphones coming from inside the US and from India offsetting concentration of production in China. Automakers will have to ensure that 40 to 45% of a car's content is made by workers in the U.S. earning at least $16 per hour. If this is not met automakers pay a 2.5% tariff for cars brought in from Mexico. Mexico makes 2.3 million cars and Canada 1.8 million. Automakers invested tens of billions of dollars in Mexico turning it into a lower cost export hub. This has led to job loss in the U.S. Mr. Trump's efforts in the new trade deal with Mexico are designed to increase investment in the U.S. auto industry.

Countries who have blatantly unfair tariffs for decades can then decide as in EU, China, India, Japan, S. More evidence in Commerce Department trade figures that president Trump's strategy of imposing tariffs on $200 billion of Chinese goods and renegotiating trade pacts with Canada, Mexico and South Korea was not sufficient to reverse the huge U.S. trade deficit. The international trade deficit in goods and service increased 19% in December from prior month to $59.8 billion. Excluding services that U.S. sells to foreigners such as tourism, intellectual property and banking, the deficit grew to $891 billion the largest on record.
