President Trump announced that he is declaring a national emergency to bypass Congress and pursue building a wall on the U.S.-Mexico border. This comes as the president accepted $1.4 billion, a fourth of the $5.7 billion he had asked for from Congress. Mr. Trump hopes to add additional funding by declaring a national emergency as the U.S. Congress turned down his request for a longer wall. Congress only included funding for a 55 mile long fence along the Rio Grande River at the border with Mexico. To keep a campaign pledge to build that wall Mr. Trump acted with the support of Republicans including Senator Graham. Trump said he expected that "we'll be sued, and they will sue us in the ninth circuit, and then we will end up in the Supreme Court and hopefully we will get a fair shake." Under Trump's declared national emergency about $3.6 billion would be taken from the Pentagon's military construction fund and $2.5 billion from the Pentagon's drug interdiction programme. This will be challenged in the courts. Trump is under pressure from his support base to show that accepting the Congress offer of $1.4 billion and a 55 mile fence was equal to surrender. ...

Greg Ip points out in this WSJ analysis that the new NAFTA after negotiations and warnings from Mr. Trump to scrap NAFTA, is not very different from the old NAFTA. Mexico made concessions on auto exports and labor rights, wages. Canada made concessions for the dairy industry. Yet the combined influence of business interests, Canada's lobbying in U.S. Congress and state governments, and the restraint shown by Trump's own advisers prevailed in limiting Mr. Trump's tendencies to go for a "America first" agenda. It shows, says Ip, that there is resilience in the existing order.  It also shows what future trade negotiations with the European Union and Japan over steel and autos could look like. President Trump will continue to face resistance within from his advisers and from exporters, business, Congress, on following an exclusively "America First" agenda. President Trump will need to extol NAFTA in its current version the USMCA, U.S. Mexico Canada Agreement, to get it through the U.S. Congress in 2019.   Mexico's main concessions on autos were to agree to potential tariffs if exports exceed 2.6 million vehicles.  This keeps Mexico's status as a major auto export hub intact. Auto experts say VW and Mazda may simply pay the tariff of 2.5% for lower priced models assembled in Mexico that do not qualify for duty free entry instead of shifting production to the U.S. Current shipments from Mexico are not affected as U.S. demand is weak. Labor rights and higher wages in Mexico's auto industry are a win-win for Mexico and the U.S.. They are supported by the socialist administration of newly elected Mexican president Obrador. Canada's main concession was to expand U.S. access to Canada's protected dairy industry, with Canada already prepared to make the concession. Mr. Trump had also to consider the possibility that excluding Canada from the USMCA would have not passed Congress, and face even more resistance in a Democratic controlled Congress after 2019 elections.  The support Canada has received in Congress does not extend to China, which gets much less support in Congress, leading to higher uncertainty in the negotiations with China and possibly different outcome with the size of the trade imbalance of $1 billion a day factored in.   ...

The BBC cites Mr. Trump's comments on Sean Hannity Show that Attorney General Barr made up his mind "right on the spot" after receiving the Mueller Report before even going into the Report's findings. It says this confirms that Mr. Barr had already made up his mind as stated in an unsolicited June 2018 memo to the Justice Department about presidential immunity from obstruction charges, a reason Mr. Trump chose Barr.

Mr. Mueller did not make a traditional "prosecutorial judgement" because he left it up to Congress as it was not the role of the Justice Department under which Mr. Mueller operated. At issue is also the 34 pages "redacted" by Mr. Barr from the Mueller Report, and Congress will want to see the full Report and all the evidence on obstruction before making up its own mind, says the BBC.

The US Supreme Court will soon make a decision on the power of president Biden to take action on student loan forgiveness for millions of borrowers when Congress has failed to take action. 43 million people in the US holding $1.6 trillion in student debt would get some form of forgiveness under president Biden's $400 billion plan. Arguments will be made at the Supreme Court with a 6-3 Trump appointed majority of Conservative justices and a decision expected in June. Congress has failed to resolve this matter of debt affecting a large part of the US population leaving it to president Biden to offer some form of relief before a larger resolution is backed by Congress. A ruling will be made by June.

The Trump administration has pulled together $18 billion of the funding for the border wall, the fencing that will replace inadequate exiting barriers along 885 mile stretch on the U.S.- Mexico border. This includes the current budget proposal for $2 billion in funding request. The remainder was collected by shifting funds from the military. During the initial request to Congress it was given only $1.325 billion. President Trump made up the difference by declaring a state of emergency in February 2019, allowing funds for military construction projects to be shifted to the border wall funding- $6.7 billion in 2019 and $7.2 billion in 2020. The Trump administration's early proposal for NAFTA moves away from campaign pledges to completely renegotiate the treaty, instead taking the approach of working to improve the U.S. trade position in relation to Mexico and Canada. It includes seven objectives for tougher rules for labor and the environment favored by Democrats in Congress, and it also has support from Republicans with its effort to update NAFTA for changes in technology and in other areas since the accord was signed during the Clinton administration. The Trump administration is preparing direct aid to Americans and American industries hurt by the coronavirus epidemic. Each check will be based on family size and income, according to a Treasury Department memo seen by WSJ. The direct payments in two rounds will be on April 6 and May 18. This is part of a $1 trillion stimulus program. $50 billion lending facility is being setup for the airlines. Another $150 billion goes to distressed sectors in the economy. $300 billion will go to a small business interruption loan program, which will go to temporarily cover payroll costs for employees. The idea is to put a safety net and support workers who will need help while they are not working. The measures include two weeks of paid emergency leave for a large number of people. Money also goes to additional Medicaid funding, more money for food stamps, and for unemployment insurance program. Congress has passed the bill and president Trump is expected to sign it into law. Other bills will follow in Congress. A third economic package will cover additional needs of agencies of government, with $11.5 billion for Department of Health and Human Services, and Departments of Defense, Veterans Affairs, Homeland Security. Trump blocked it for personal advantage at the elections to use this as an issue which has blocked a permanent solution. Confirming this is a month old interview in NYT by Republican Senator Lankford saying the legislation he drafted would have passed Congress in December 2023 and signed into law by Biden. It came up in Congress in February by this time Trump was made nominee of the party and he blocked it so that he could use the issue in an election. This says a lot about character and more than mere fact checks shifts focus on the characters of the two people running. People ask yourselves what you would have done in this situation, and what would Kamala have done, would she have blocked a bill that would permanently fix the Border and change US asylum policy?  Biden went on to do this by executive action bringing migrant flow numbers down to where they were under Trump and Obama, and more than that put together a bipartisan bill with Republican Senator Lankford that Kamala can now sign into law.    ...

This exceptional report in the New York Times shows the results of a NYT investigation into Trump's taxes. Trump used a $916 million loss on his tax return for 1995. This was at a time when casino losses had mounted in Atlantic City and Trump was having financial difficulties. Trump used a tax avoidance maneuvre that was considered stretching the law by tax experts. Under tax law when debt is cancelled it has to be reported as taxable income. When Trump had some of this debt cancelled for his casinos, he would normally have had to show it as taxable income. He used a tax maneuvre to not show this taxable income- to be able to show a loss of the magnitude of $916 million for 1995 tax returns. The cancelled debt would make it possible to wipe out $50 million in taxable income for 18 years, says the NYT report. Trump used the losses of $916 million to offset other income from branding, television. Trump's debate comments to Hillary Clinton was why she had not closed the loopholes he had used. Hillary Clinton was one of the senators who had this loophole closed when legislation was passed in 2004. According to Mr. Buckley, the former chief of staff for Congress's Joint Committee on Taxation, this violated a key principle of American tax law, that you cannot deduct someone else's losses. Only the bondholders for the casinos who cancelled some of Trump's debt should be allowed to use these losses according to that principle. So Buckley says of Trump's tax return maneuvring- that "he was double dipping big time." What does it mean for the average citizen- it simply increases his tax burden. ...

The US Supreme Court unanimously agrees that letting a state decide who is on the ballot and who is not based on an insurrectionist interpretation of the US Constitution would lead to chaos. The SC was considering a lawsuit filed by the state of Colorado asking that Trump be disqualified for insurrectionist behaviour related to events at the Capitol on January 6, 2021. Other states had filed similar lawsuits. With 51 states any state could do this leading to chaotic and unanticipated situations.
