WSJ reports that Tech companies spent heavily in 2022 to block legislation in the US. Congress. This means the US Justice Department had to step in with the Executive Branch determined to dismantle the edifice of anti competitive behavior that Google, Apple and other companies have built. Roger McNamee, an early investor in Google and Facebook, writes this opinion piece in the Guardian newspaper saying that there are very serious problems in the way the "addiction" created by Facebook and Google products is affecting children. Legislation sponsored by US Senators Mike Lee, Ted Cruz, Amy Klobuchar and Richard Blumenthal that would breakup Google's ad business. Google dominates the online ad business in every aspect and segment of the business in the way Standard Oil dominated the oil business more than a century ago. Under Theodore Roosevelt that monopoly was broken up. Today Google operates in an environment where foundational anti-monopoly legislation has not been written for about 100 years says this report in WSJ. The Sherman Act of 1896, and the Clayton Act of 1914 form the foundations of anti-monopoly legislation. The Clayton Act was last updated in the 1970's. For 50 years no update has been done leaving the ground open for unfair advantage and conditions that are harmful to the American people say members of Congress sponsoring new legislation.  The Cruz-Lee-Klobuchar-Blumenthal bill would prohibit companies processing more than $20 billion in online ads from participating in more than one part of the online ad ecosystem. Google antitrust decision in Mehta's Court for over 5 years since lawsuit by DJT in first term. During these 5 years much of the behaviours of monopolies and oligopolies in tech is further entrenched and new technology has created new ripples. The result is an ineffectual ruling that does little to address the original concerns of the Justice Department. Lost in all this commotion is the fact that there are real and present dangers in the situation presented by Google as a gatekeeper for knowledge and information which are a real and present danger to democratic forms of government as Google or social media tech companies can act as arbiters of information, a role that is not given to them under the US Constitution or any of the principles laid down by our founding fathers. Google has come out firmly on the side of parents struggling to deal with schooling at home for children, with social distancing during the pandemic, as it supports working from home all the way till summer of 2021. For 200,000 full time and contract Google employees is sure to offer some relief.  Sundar Pichai the Alphabet CEO made the decision after a debate in Google Leads a small group of executives at the company.  Mr. Pichai told staff " I hope this will offer the flexibility you need to balance work with taking care of yourselves and your loved ones over the next 12 months."  He was especially concerned about parents trying to tackle schooling of children. The surge of the pandemic in California where Google is located is likely to have convinced Google executives that this was the right step, with no vaccine in sight, and the possibility of a second wave after this one. Goggle's Eric Schmidt speaks at the annual meeting of the Newspaper Association of America on the issues raised by Google News use of newspaper content. He says it is unlikely that Google would buy the content behind a pay wall for a subscription and make it available to users for free. Under the current arrangement only AP is paid for content. Newspapers can choose not to be part of the Google Search but choose to get traffic from Google Search to their websites, and from Google News to their websites, which they monetize through advertising. Schmidt provided as one solution publishers creating more personalized news products that could be effectively delivered on the Web, on mobile phones and on the iPad.

The way Mr. Partovi's idea of mixing keyword search with ads met with resistance at Microsoft, after Microsoft spent $265 million to acquire his company LinkExchage. Some of Partovi's bosses warmed to his idea of auctioning keywords but their eyes were glued to the prospects of display banner ads and did not think much of the search and ads combined together, like searching for a term and seeing the vendors of all kinds of related services who pay a fee every time someone clicks on their name. Bosses changed and the Keywords group was shifted to other parts of the Microsoft business ending up in software. A small trial was made but price of auctioning keywords was not set appropriately. Partovi's insistence was seen as resistance to the ordered way of doing things at Microsoft, and Ballmer in 2003 talked about "discordant and dissident directions" in the company, tendencies which he derided. Partovi's passion was seen as insubordination and finally in May 2000 with $1 million in revenue from Keywords comparing poorly with Microsoft's other online ad revenue, Keywords was shutdown. Partovi left Microsoft in July 2000. He shopped his idea around. Yahoo said it did not fit in with its plans, later buying Overture for $1.8 billion in summer 2003. Google talked to Partovi but declined, instead quietly building its own service. And Google launched its own service AdWords combining search and ads in October 2000. It was under pressure to come up with arevenue generating method.By 2002 Google was stealing advertisers from Goto.com that had pioneered the business of ads and search but lacked the advantage of having its own search engine. Microsoft also faced the same problem. In May 2002 AOL dropped Goto.com and teamed up with Google for paid search. By late 2002 Microsoft executive Yusuf Mehdi was visiting Goto.com and launched an effort to buy Overture the new name for Goto.com. But when in Spring 2003 Mehdi pitched buying Overture for $1 billion to Gates and Ballmer, both tore into the proposal saying that they could do it for less than the $1-2 billion price tag by doing it inhouse. By this time Google was already the dominant company in search ads and Overture was losing out. But even with hundreds of programmers Microsoft did not get its search engine ready till late 2004 and the search ad system in May 2006, about 3 years from the meeting with Mehdi. The resistance of founders to development of new products, is seen at HP for the personal computer which was later embraced, and at Honda where a new kind of engine had to be developed secretly without Soichiro Honda's knowledge. In both cases the product was developed successfully after initial resistance, but in the case of Microsoft the new ideas and people may have been smothered and development done to Microsoft's founders own inclinations for order, and treated the same way as its other products till it was too late. A factor not present to the same degree in HP and Honda's situation was the speed with which the internet developed and search engines like Google developed. So that in 8 years since its launch Google is firmly entrenched, and has 73% of search ad spending, with Yahoo at 13.3% and Microsoft a distant third. Google generated $5 billion in profits from this in 2008. By 2009 search ad spending is estimated to reach $12.3 billion....

EU Competition Commissioner, Margarethe Vestager, on a trip to the U.S. to meet FTC and Justice Department officials, says the situation in Europe is different from that in the U.S. In Europe Google has a dominant position with over 90% market share, much more than in the U.S. where Yahoo and Microsoft are competitors in general Internet search. She said about Google following the filing of formal antitrust charges by the EU against the company- "is a successful company because they have good products. But the compliments, they stop when you get the suspicion that there may be an abuse of this very strong and dominant position." In earlier statements Vestager has said that the dominant position in all its ramifications poses "societal challenges." Complaints to the EU Commission originated with Microsoft and smaller companies affected by Google. News Corp, publisher of the WSJ, has joined a group of companies in filing new formal complaints in April 2015 with the EU Commission about Google practices. Google now has 10 weeks to respond to the charges. In the U.S. the FTC also had concerns, with FTC staffers favoring filing formal charges. In the end the FTC decided to rely on Google making voluntary changes to three practices taken up by the FTC- including complaints about "scraping" of content from rival websites, and its restrictions on the ability of advertisers to use competing platforms. Vestager sees the need to get the process moving, as it has dragged on for about 5 years, saying "it is important for us to be more speedy in getting the question out, to be able for Google, for competitors, but most of all for consumers to see our concern." The EU Commission charges about Google favoring its own comaprison shopping service are a way for Vestager to establish a broader precedent, as it looks into other ways Google's uses its dominant position to favor its own products and services....

Specialized websites such as Realtor.com,Trulia, Zillow in the US and Rightmove in the UK have customized features appropriate for the field. In this case real estate search. This vertical search is proving superior to the horizontal search of the world's 182 million websites that Google searches, when it comes to specialized tasks. Restaurant reservations has OpenTable, job-hunting has Simply Hired. These sites do more than simply search, they also complete transactional tasks which Google doesn't. In the retail Amazon is adding new features specialized to the retail field, and also has consolidated online retail. Right now Google has 69.4% of the search market to Bing's 24.4%. For Google 96% of revenues come from search, even with diversification efforts through Android (mobile devices), YouTube (video advertising), and Chrome (browser software). Google acquired ITA Software in 2010 to compete in the travel field. Rayport says the search business is changing with users geting more sophisticated and demanding, and he sees a shift to vertical search. This shift appears to be the next step as the capabilities of horizontal search are being exhausted....

David Brooks of the NYT is critical of the way Google CEO Sundar Pichai handled the Damore email affair. Pichai cut the discussion short and fired a 28 year old engineer who wrote a controversial memo about women and working in the software industry. Brooks says the memo actually makes things harder for women in a male dominated tech world.  Not mentioned here or in the coverage in the media is that Google could have used this as an opportunity to refocus the discussion on how to correct the exaggerated tilt in favor of men in the male dominated tech world- about 80% male. Even with the differences between men and women is such a huge tilt a good idea? How could it be handled by giving women better opportunities and changing the culture itself to ways that can make it good for both sexes. An extremely competitive environment with its corresponding behaviours is not the best environment for all. Most of the male dominated tech world does not walk the talk by actually helping women in tech in multiple ways, including changing their own culture- this itself could have become the focus of the discussion. Google could turn its gaze inward and say this is happening because it was too late or not doing enough, and use this as a wake up call- letting people be heard, yet quietly redoubling its efforts as some contrary voices explain how the current situation happened, is another way to respond effectively that eluded Google.  ...

Experts point to several factors favoring a lawsuit by the EU against Google. Google's dominance in Europe is higher than in the U.S., with Google used for 90% of web searches in Europe. The case is easier to build in Europe because the EU commission acts as prosecutor, and EU judges in Luxembourg rarely overturn the commission's major decisions. The EU competition commissioner, Margrethe Vestager, who took office in Nov.1, 2014, sees the need to give smaller internet companies room to compete with Google as a definite priority. She favors setting a legal precedent through a formal court process, and says that "citizens and companies should see that we are willing to go to court if that is the right thing to do."

A 3 year old lawsuit by Viacom against Google's You Tube, was decided in favor of Google. Google was granted a summary judgement in this case. Viacom claimed that You Tube tried to exploit Viacom's copyrighted works and make a profit on them. Google's argument was that it was protected by the Digital Millenium Copyright Act. Viacom had sought more than $1 billion in damages. Judge Stanton said that general copyright infringement was not the same as knowledge of specific and identifiable infringements of individual items. In this case once Google received specific notice that a particular item infringed a copyrighted work, it quickly took that item out. And none of the aleged video clips are on the site.

Joshua Wright, a George Mason University law professor was appointed to the FTC where he had other commissioners dilute the powers of the FTC so that it would benefit Google, Facebook and Amazon from weaker oversight by the FTC. During this period the three companies acquired immense power with monopoly behavior and lack of the necessary oversight from Congress or the FTC. Related to this is the story in this WSJ report of the relations of a GMU law professor with his female students that led to GMU and the tech companies distancing themselves from Joshua Wright as each new story emerged.  ...
