The strategies of the U.S. Justice Department in the probe into VW emissions cheating includes novel use of the civil financial fraud law Firrea. A multi front investigation is taking place, with each agency including the EPA and Justice Department, German prosecutors, all expanding their action to demonstrate effectiveness in enforcing the law. VW has set aside $7.3 billion for legal settlements and now admits to a "chain of mistakes," and a "culture of tolerance" for breaking rules leading to the cheating.

VW's Dieselgate settlement required it to spend $2 billion on electric charging stations in the US to compensate society for air pollution caused by its faulty diesel engines. The Washington Post looks at these EV charging stations and finds many of these do not work. An author of a reliability study on charging stations Prof. David Rempel of UC Berkeley says there should have been more oversight as he considers it to be public money. About 80% of these charging attempts are successful at 4000 fast chargers run by Electrify America according to JD Power, and customer satisfaction is low.

VW is cutting a fourth of its German jobs over 5 years, about 35,000 employees. Half of the 120,000 people in Wolfsburg work for VW. Germany faces deindustrialization as a result of its dependence on heavy industry, on automobiles, chemicals, metallurgical engineering. Its failure to digitize and to move ahead in AI and software presents a problem. While countries such as China surged ahead with bold investments in EV vehicles VW was slow to respond. Japan pushed forward in hybrids. India in digitizing fast. Cost of labor have caught up to inflation and rising, electricity costs are up, and profits from Chinese production are vanishing with China's BYD and Geely, and other Chinese auto companies taking away VW and GM market share. VW's US Tennessee EV plant faces an uncertain future with loss of EV subsidies by DJT executive orders. In the US the effects of deindustrialization underway were covered up for decades by Compliant Media and Economists with the idea that it brought consumers lower prices, a facade for not saying that labor was more compliant in Asia after a period of job banks in Detroit and other hindrances put up by labor in the US in the 1970's souring management. That generation and period is gone and America badly needs to get its act together. Here in Wolfsburg the schools supported by VW like the Wolfsburg New School will lose VW funding as well as the public services in the city from lower tax revenues. This is what happened in the US catching up to the last of the industrial players of the twentieth century now facing a competitive China and a future competitive India.   ...

Efforts to save the VW brand in North America as it faces disappointing sales. It lost $1 billion in North America for each of the last 3 years. VW faces perception issues among customers in the USA who read JD Powers surveys. The surveys show VW in the bottom 20% for reliability, quality and service. Its younger customer base does online shopping and compares models and this led to sales declining from 338,00 to 235,000 in 2006. Now Jacoby, an accountant by training, who headed VW global sales and marketing and boosted market share from 18.1% to 20.3% in European car sales, has been given charge of the American operation to get VW to breakeven n North America by 2009. Previous ad campaigns showing VW safety in car crashes and Helg a German dominatrix failed to stir up much interest in Jetta and Passat models.

A sign of how VW has faded in the American market. In 1970 the VW van sold at $20,000. Sales were 570,000 in 1970. Today the 2025 EV Van (ID.Buzz) priced at $60,000 has'nt made much opf a dent in the market with 2025 sales at under 10,000. It can charge up from 10 to 80 percent in 30 minutes in a DC fast charger. Its two tone yellow and white colors were a key part of its attractiveness to buyers, which were not produced on the production line.

The repeated denials by VW officials from global headquarters in Wolfsburg, Germany, and from VW in the U.S., since 2012- when the problem of higher emissions on roads compared to emission test readings first came to public attention- show that VW management took the problem lightly. The deep consequences of such a move to hide real emissions, not just from the EPA but from unwary buyers, appears to have been entirely missed by management. Even when the issue was raised by the EPA, VW stated to EPA that the differences in results on roads vs actual emissions tests were technical flaws. In December 2014 VW even made a voluntary recall of half million diesel vehicles. Yet the high emissions on roads continued till VW officials told EPA about the software that was the real cause in August 2015. Even then VW officials offered to personally apologize, and asked for certification of 2016 models in the U.S., missing entirely the deep consequences of their actions. VW now says that the software to conceal the real emissions was installed on 11 million vehicles worldwide. VW management has set aside $7.7 billion as provision for penalties. The VW stock declined by 35% by September 22, 2015....

VW chairman Hans Dieter Poetsch tells reporters in Wolfsburg, Germany, that a small group of engineers starting working on emissions cheating software as early as 2005 when they could not find technical solutions to U.S. nitrogen oxide emissions within their timeframe and budget. When a technical solution was later available, it was not used. Poetsch said; " We are not talking about a one-off mistake, but a whole chain of mistakes that was not interrupted at any point along the time line."

Germany is facing a shrinking market for its electric car exports to China as local makers dominate the market in China for the first time in 2023. BYD is China's largest e-car maker and is growing much faster than American or European makers. Every second e-car worldwide in 2023 is made in China. Germany's e-car exports are 60% of what they were in 2022. BYD sells 20 times more e-cars in China than VW.

Germany stands out as an outlier in the percentage of cars imported into the US and not made in the USA- for VW this is 80% and for Mercedes 63%. Only Hyundai falls into this category with 65 percent and it announced a $21 billion plan for investment in the US including a $6.5 billion steel plant in Louisiana. All other foreign companies import about half or less of their sales into the US. VW and Mercedes could follow Hyundai in making the shift to making in the US. Honda makes 65% of its cars and Ford 80% in the USA. Peter Navarro, senior Trade adviser to DJT says-"foreign trade cheaters" countries  such as Germany and Japan, South Korea have turned America's manufacturing sector into a "lower wage assembly operation for foreign parts." VW brings back the Scout brand to the US adding it to VW and Audi brands. VW will invest $1 billion initially to manufacture the Scout EV vehicles in the US with additional investments after preparing the ground for the manufacturing plant. VW acquired the Scout brand name with its acquisition of Navistar in 2020. Navistar was created in 1985 from the International Harvester Company which went out of business.

Sales of automobiles in China in July 2012 declined 12.6% from the prior month according to the China Association of Automobile Manufacturers. There are two parts of China's automobile sector, the foreign brands of GM, Toyota, VW, Ford and others, and the Chinese brands. There are 48 Chinese domestic carmakers for 30% of China's automobile market, with sales of 87,500 per brand on average, according to J.D. Powers. Many of these carmakers will not survive even with subsidies from local governments. China's car buyers prefer foreign brands because of the better quality and reliability. Foreign carmakers face an oversupply of cars as GM, Honda, Ford, VW have continued to add capacity. Total automobile manufacturing capacity is about 28.5 million cars and commercial vehicles. This is 9 million more than the expected sales in 2012, according to J.D. Powers. The most recent company adding large capacity is Ford Motor Company, which was relatively late in the Chinese market, and decided to boost capacity from 450,000 in 2011 to 1.2 million in 2015, to make it the largest manufacturing location outside of its home base of Michigan. This creates the prospect of foreign carmakers having to offer larger incentives and discounts to manage inventory and operating with higher levels of unused capacity, reducing profits in future years. German authorites are looking into the possibility that higher up management knew about the emissions cheating and whether management had permitted it to take place. A search warrant was issued by a judge in Munich in March 2017 that makes it possible for investigators to take documents and other evidence on mobile phones of senior management, including Mr. Muller and Mr. Stadler, two very senior executives who head VW and Audi. Almost 2 years after the story first came to light the investigation continues and the probe deepens into who knew what at the highest levels of management.

Experts expect an out of court settlement of $12-$13 billion. The inconclusive discussions between the EPA and VW led to the filing of the lawsuit. Habeck said this at a G7 economy ministers meeting in September- "the naivety towards China is over." Habeck has denied the VW group guarantees for investments in China in May. German companies business in China was supported by government guarantees for exports and investments in China. Germany has about 90 billion euros of investments in China. The relationship began in 1972 when China was a poor developing country, and surged particularly in the Merkel years when China was no longer a developing country. Today Germany and the US face technological competition from China and the reappraisal of global supply chains overly dependent on one country.

Still Chinese car makers will only have 12% of the EV market and it is VW that is a winner in the competitive market in Europe.
