Robert Mueller, the special counsel, says the Mueller Report and his investigation into the 2016 presidential election does not exonerate president Trump. If we had exonerated the president we would have said so, said Mueller in a public statement. "If we had confidence the president did not commit a crime we would have said that," Mueller said. He said the constitution of the U.S. does not allow a sitting president to be charged by the special counsel. Because the special counsel office is under the Justice Department and the department policy set the manner of the report, charging the president was not an option he had. The Republican party controls the Senate and the Democrats control the House of Representatives. Any effort by Democrats in the House to impeach the president would fail in the Senate. Democrats and Speaker Pelosi are wary of impeachment proceedings. Mr. Mueller's statement suggests there is also growing discomfort in Congress about taking no action at all that would be construed as exonerating the president for what happened during the presidential election, because it might set improper precedent for the future. This increases the pressure for impeachment proceedings in the House of Representatives from some Democrats for more information to let Congress decide. ...

Democrats lost 6 Congressional districts won by Biden in 2020. This is more than any other state in the US. Wolfson, a former deputy mayor of New York City says it may have cost the Democrats the House of Representatives in 2022. It all started with redrawing of districts by Democrats in the House that was thrown out by the courts, leading to it being done by someone appointed by the court, and redrawing that was unfavorable to the Democrats. Democrats also failed to grasp the effects of laws passed that change the way judge set bail for offenses which Republicans pointed to as creating a larger crime situation. A 30% rise in crime in New York City was made an issue by Republicans in the midterms, which Democrats failed to address. The Republican majority in the House is thin and there is a sense that New York state played apart in Democrats losing the House.

It was not till 1.39 am in the early hours of the morning of January 7, 2023, that the just elected Speaker of the US House of Representatives Kevin McCarthy swore in all the new members of the 118th House. This ended a week of voting that went into 15 rounds before five Republican member holdouts of 20 rebels voted "present" to make it possible to elect Kevin McCarthy as the new Speaker. A bitter fight led to concessions being made to Freedom Caucus members who wanted to limit spending and cut spending on infrastructure and defense. McCarthy opted for the route of repeated ballots to avoid making concessions on who controls key committees and to limit concessions to ab out 20 rebel members of the Republican Congress. The vast majority of remaining members do not share these views including Democrats who make up about half of the House and many Republican members of Congress.

The fight for electing a new Speaker that led to 5 days of voting could lead to month of turmoil in the US House of Representatives. Kevin McCarthy made concessions that could lead to more fractiousness among Republicans says this report in the WSJ. A single House Republican can challenge the Speaker under one of the concessions. Other concessions would make it harder to pass legislation. The WSJ Editorial Board says some Republicans who agree more with Democrats than positions taken by the 20 Republican holdouts in voting for Speaker, such as spending on infrastructure and support for Ukraine may actually join Democrats in future voting.  This brings in a new period in which party affiliations will be only one of the factors deciding how members vote, other factors being where they stand in the US support for Eastern Europe against Russian threats, and on issues such as spending on fixing broken American infrastructure .

Efforts to impeach two previous presidents including Democrat Clinton failed in the Senate where the vote requires a two thirds majority. The first impeachment vote against Mr. Trump failed in the Senate. In the House of Representatives only a simple majority is required. Majority Leader McConnell says he will not reconvene the Senate before president Biden takes office. Vice President Pence has refused to invoke the 25th Amendment. House Democrats have moved ahead to vote for impeachment of president Trump for the storming of the Capitol offices in Washington D.C. President Trump won 74 million votes in the last election more than in the 2016 election and lost with Mr. Biden winning 81 million votes after polarization of the country. This would also result in continuing the division of the country, and continue polarization.  About 5 House Republicans are expected to support impeachment. In the Senate some Republicans say there are impeachable offenses yet only Mr. McConnell and the senator from Utah, Mr. Mitt Romney, favor impeachment.  Mr. Trump's style of governing was controversial from the beginning of his campaign in 2016, strident and taking on critics. He governed through relative moderation compared to his aggressive posture towards critics. For instance on Mexico his remarks offended critics, yet he negotiated a new trade agreement with Mexico replacing NAFTA to ensure worker protections in Mexico, and worker jobs and wages in the U.S. Negotiations with China on trade were conducted by a seasoned veteran, Mr Lighthizer,  who was deputy Trade Representative under Reagan, and negotiated the trade agreement with Japan that worked to reduce Japanese trade surplus in the eighties. Ryan served as vice presidential nominee and became Speaker in October 2015 eight years before Mike Johnson in a similar situation where his job depended on different factions. Mike Johnson's view is that he wants to be seen as listening to all members to kind of decentralizing things. Yet as more experienced members of Congress say the only way to get things done is for the Speaker to take action on his own accord and let the situation rest there having done his best. As Governor of South Carolina for two terms 2011-2017 Nikki Haley played a major role in getting Boeing to expand its operations in the state and attracting auto companies and other manufacturing industries. South Carolina had suffered from the decline of its textile industry from an earlier industrialization era. She personally helped recruit smaller companies such as Kent Cycle to set up plants in the state.  Nikki Haley's father Ajit Singh Randhawa  is from Amritsar, India, and went to the University of British Columbia on a scholarship for advanced studies in 1964. Nikki Haley graduated from Clemson University in 1994 with a Bachelors degree in Accounting and Finance. After working for FCR she joined her family's clothing business started by her mother. From 2005 to 2011 she served in the South Carolina House of Representatives. The report from Politico on Haley's career shows her to be resilient and sticking with her beliefs and principles even as she found herself to be the only immigrant  prominent in southern state politics of South Carolina. This report in WSJ looks at the unanimous vote in the House of Representatives delisting hundreds of Chinese companies trading on U.S. stock exchanges. The Holding Foreign Companies Accountable Act passed by unanimous voice vote in the House of Representatives after a similar vote in the Senate in May, and will be signed into law by president Trump. The law says foreign companies should be delisted if they fail to comply with U.S. Public Accounting Oversight Board regulatory agency's financial audits for 3 years in a row. The basis of the law is that all companies should be equally treated and required to meet U.S. regulatory standards to be listed. It also ensures safety for investors who may be defrauded of their money investing in companies that have not met such audit requirements. Wirecard in Germany and some Chinese companies have failed in the past because of lax overseas standards. This gives three years for the Chinese companies to prepare. This report also points out that the MSCI Index has 43% Chinese companies even more than before. American investors can still buy these stocks on the Hong Kong exchanges so that if fairness and investor protection should prevail American investors have to think and act along the same lines. China is also decoupling from the U.S. to some extent and pushing to have its companies listed on the Hong Kong Shanghai and  Shenzen stock exchanges. For these reasons the access to global capital is not likely to be affected by this law particularly with the behaviour of major American institutional investors. China is providing incentives to these investors even though it did not do so in the past creating another hurdle to the goal of creating a level playing field in regulatory requirements stock for all companies listed on American exchanges and safety for investors.  ...

On Jan 19, 2023 the US hit its debt ceiling of $31.4 trillion. Republicans control the House of Representatives by only a few votes after a strong showing in midterms by Democrats who control the Senate. A small section of the Republican party insists that raising the debt ceiling- a task performed by the House of Representatives- should only be done with serious cuts to Biden programs to help workers and families during a cost of living crisis. Biden says he will not negotiate, simply won't.  This report in NYT by Jim Tankersley, says president Biden in the last resort could resort to the 14th Amendment which says: "The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions shall not be questioned." What this means is that in the last resort if Republicans insist on serious cuts because of a faction within the party, and not because the whole party supports it, Mr. Biden could continue public borrowings to pay social security and make other payments. Moody's says this would lead to a rise in borrowing costs temporarily but would not lead to a recession, and have long term benefits as the debt ceiling could not be applied in the future. It would be challenged by Republicans and go to the Supreme Court which would have to decide on the issue: "the validity of the public debt of the United States shall not be questioned." WIth China reluctant to make concessions on agricultural imports at a recent Shanghai meeting of Mr. Lighthizer with Chinese trade representatives, the trade dispute with China has escalated. Mr. Lighthizer had little to show Mr. Trump at a meeting in the WHite House. After a 2 hour meeting Mr. Trump told his advisers that his patience was wearing thin. His response on what the U.S. should do- "tariffs." A tweet was prepared saying U.S. would place import duties of 10% on imports of additional $300 billion in Chinese goods. China responded by lowering its currency value to 7 to the dollar to offset the import duties. China also said it was suspending all agricultural imports of U.S. farm products. The U.S. designating China as a currency manipulator.  The situation today is that there is a level of mistrust between president Xi and his advisers and Mr. Trump and his team. The situation has taken a new turn with China saying the U.S. is supporting protests in Hong Kong. President Trump has stated China is waiting it out to deal with a new administration in Washington. Both sides do not see any solutions till after the U.S. elections in 2020. For China there is also the upcoming 70th anniversary of the People's Republic. ...

Vigorous and eloquent testimony before Congress by Treasury Secretary Scott Bessent, answering questions from Republicans and Democrats. Bessent had just landed from London at 3 am in the morning and after 3 hours of sleep took the time to answer over 5 hours of questioning by members of the House of Representatives. In question after question he explained how the certainty offered by the tax cuts bill would help small business and job creation in the US. The permanence of the 100% expensing of buildings and equipment would help farmers and small business , regulations would be cut, and manufacturing would take off. Manufacturing employs 9% of the workers in the US and their wages will rise faster than for service workers. The combined effects of the improvements for small business, farmers and for manufacturing workers will help the American middle class, America's working class, and increase the growth of the economy. Bessent points out that in the original bill of which the new tax bill is an extension the top 10% paid 7% more in taxes in 2017. He also points out that workers were hurt the most by the slower rise in wages and the rise in cost of living of 21% in 2021-2022, which he says was in essential goods with the actual impact of about 30%. With higher jobs creation by small business and more investment in the economy more able bodied men can join the workforce and gain healthcare benefits under new rules. He pointed to low inflation at 2.1% and to higher job creation, and to higher growth in the economy of 2.6%, that with other savings could lower the deficit. ...

Section 230 is a law passed in 1996 that makes the Social Media Companies and Media companies such as Meta and Google and others to have no liability for content posted on their sites. This has allowed these companies to grow and develop monopolies on the internet. Here CSPAN covers the hearings in the US Senate today December 9  with the following US Senators speaking at a Senate hearing on Online Safety for Children. Senator Whitehouse of Rhode Island describes the biggest problem as being the Section 230 which needs to be removed. The following mothers who are Senators and mothers or grand mothers of children were very vocal on this point- Katie Britt-Alabama, Martha Blackburn-Tennessee, Ashley Woody-Florida (former Attorney General of Florida).  Senators who are fathers or grandfathers of children speaking are-Josh Hawley-Missouri,      Whitehouse-Rhode Island, Bluementhal-Connecticut, Corbyn-Texas, Chuck Grassley-Iowa. Senator Whitehouse says-  "I understand Senator Graham was with respect to getting rid Of Section 230 Um, I strongly believe that Section 230 has long outlived its use, and it is now a real vessel for evil. That needs to come to an end. Um, the laws that Section 230 protects these big platforms from are very often laws that go back to the common law of England. that we inherited when this country was initially founded. I mean, these are long lasting, well tested. Important Legal constraints that have They've met the test of time, not by the year, by the decade, but by the century. And yet because of this crazy Section 230, these Ancient and highly respected doctrines just don't reach these people. And it really makes no sense that if you're a Internet platform you get treated one way. You do the exact same thing. And you're a publisher, you get treated a completely different way. And so I think that the time has come. I think it's pretty widely known that there were a core 4 of us. Ready to proceed with a bipartisan bill 2 and 2. And a A lot of work, important work, good work, valuable work has gone into making sure that other members of the committee and other members of the Senate have a chance to look at that and decide whether they want to join or not. And I'm at the stage right now where I think we just need to go." The Online Safety Act passed overwhelmingly in the US Senate recently still languishes in the House of Representatives. Ostensibly because of free speech but really because of monopolies and campaign contributions, and beyond this because of the idea that rapid internet growth gives the US economic and business leadership in the world. That is not how it has turned out instead by weakening the education of the children of the Nation this has created the idea in China and other nations that the US's period of world leadership has passed. In the overall scheme of things social media has weakened education in America as children of the Nation spend countless hours away from classroom education on their smartphones. Australia and other countries including China regulate the use of the smartphones and internet social media for children under the age of 14. This regulation strengthens education in these countries at the same time that the absence of limits weakens education competitiveness in America, and creates the idea that America's days of leadership in education have passed.The loss of this leadership means the loss of American leadership in the world in a decisive way. ...

The Trump administration's early proposal for NAFTA moves away from campaign pledges to completely renegotiate the treaty, instead taking the approach of working to improve the U.S. trade position in relation to Mexico and Canada. It includes seven objectives for tougher rules for labor and the environment favored by Democrats in Congress, and it also has support from Republicans with its effort to update NAFTA for changes in technology and in other areas since the accord was signed during the Clinton administration. The struggles and triumphs over adversity and difficulties of Senator Olympia Snowe of Maine. Daughter of immigrant parents- a father who is a Greek immigrant and a mother who is a child of immigrants- Olympia is raised by an aunt who works at a textile mill in Maine in the 1950's, after losing both parents by the age of 10. She goes to the University of Maine where she studies political science. She marries a member of the House of Representatives from Maine, but her husband is killed in a car accident by the time she is 26. She decides to run for the Maine House of Representatives, and follows this by being elected to the U.S. House of Representatives in 1978. In 1994 she is elected to the U.S. Senate. The final tally is Republicans 220 and Democrats 215 as all results are in for the 435 member House of Representatives in the US. This is the second smallest majority in US history- in 1917-19 Congress Democrats had  217-215 majority of 2 seats. Because DJT has appointed 3 US Congress members the GOP majority for months will be 217-215. Gaetz's and Waltz's districts are likely Republican but Elise Stefanik's in New York is uncertain. 

At 220-215 Republicans can lose votes of only 2 members of Congress. Washington Post says there moderates, vulnerable Republicans and retiring Congressmen who can express their concerns about legislation. About 12-20 Congressmen have scored less than 60% in Heritage Action's scorecard says Washingon Post. This means hasty,  or controversial legislation will face constructive opposition, be modified or rewritten to satisfy concerns of moderates.
