 President DJT has several options after SC Tariffs decision -Sections 122 Trade Act of 1972 has 150 day limit and 15% maximum tariff rate, and Sections 232 and 301 of the Trade Expansion Act of 1962 is specifically designed for China and countries with high trade deficits. DJT pointed out at the press conference following the Supreme Court decision pointed out that he had these options at the beginning in April for tariffs. He chose IEEPA instead because the other options required work that would take several months showing the unfair treatment of the US by other nations. It is likely that the president used IEEPA for speed yet kept open the options to replace it with the option that would work best. The new studies will have been started much earlier in 2025 so that the president can introduce all his tariffs under new arrangements. Another aspect of this is that the president has negotiated Free Trade Agreements with most of the nations that are large trade partners from India, China, Vietnam, South Korea, Japan to UK, EU, Germany, France with the idea of boosting the US economy with tariffs of 10-15%. ...

Foreign Minister Wadephul of Germany in India for talks on a free trade agreement that would double trade volume to $64 billion- September 2025. It is notable that German Foreign Minister is in New Delhi to improve relations and shift to larger trade relationship with India at the very time US under pressure from Europe and Germany, France is pushing India to shift away from buying Russian oil to other sources. Each side is aware of the complexities in the relationships. In the long run Germany under Merz will after the experience of China's support of Russian invasion in Ukraine, make the changes that never happened under Merkel- making India its major trade partner in Asia. By 2030 Germany trade's with India could exceed $100 billion.

Germany imports hardly 6% of it's oil from the Middle East compared to 13% for the European Union. This makes it possible for Germany to take its own position on Iran independent of oil supply considerations.  More important for Germany is Iran's support for Russia in the Ukraine war, a sore point for Germany and the EU considering the enormous damage done by Iranian drones in Ukraine including civilian targets. The pound falls in value to $1.30 as Mr. Boris Johnson rejects the requirement stated by Mr. Macron of France that Britain must follow EU rules. Mr. Johnson says Britain  will choose sovereignty over anything else, creating the possibility of a hard Brexit. He says the UK should not be expected to follow EU rules, anymore than the EU should be expected to follow UK rules. Business leaders hope these are opening statements only. 

Mr. Johnson want a Canada style agreement or failing this an Australia style agreement, and failing this he would stay with the existing Withdrawal Agreement with the EU he negotiated earlier. The UK wants to complete negotiations for a deal by December 31, 2020.

US actions to conduct investigations on 18 countries under Section 301 of the Trade Act of 1974 - March 12 2026 after the Supreme Court asks DJT to use another law for tariffs. A key focus of the investigation is to show how industrial overcapacity is deliberately built through subsidies to push product into US markets and destroy American competition. US Trade Representative Jamieson Greer said March 11- "Our view is that key trading partners have developed production capacity that is really untethered from the market incentives of domestic and global demand." The US and DJT have repeatedly shown how this has been done over two decades to destroy the US industrial base. Another focus is on the used of forced or underpaid labor working in substandard working conditions and excessive hours. Greer says he will have the investigations results ready by mid-July when the presidents new tariff of 15% (after the SC ruling) expires. Other probes or investigations will also be conducted. All trade agreements signed with Germany, EU, Japan, UK, India, China, and other countries will remain in place. Brexit negotiation guidelines from the EU rule out parallel talks on both Britian's future relationship with the EU and the separation agreement negotiations, preferring a phased approach. Only when the first phase of separation is complete or at an advanced stage would the second phase of future relationship with the EU be negotiated. The EU Council president, Donald Tusk, says the process would be long, complex and at times confrontational. Der Spiegel online writing on the negotiation describes the approach in a meeting with the lead German negotiator Mr. Oettinger, on the team of Michael Barnier who leads the negotiations for the EU- Oettinger focussed on what Britain owes the EU, estimated at over 60 billion euros. So far apart are the British and EU positions that Michael Barnier has no idea on the pathway for these negotiations, only awareness of the priorities such as the rights of EU and British citizens in each others region, says Der Spiegel. Looking at Theresa May speaking in parliament about her decision to move forward with Brexit in a letter to the EU invoking Article 50, one senses a mixture of confidence and nationalist appeal, far different from reality on the ground. The Leader of the Opposition cited government figures for a sharp decline in GDP as a result of Brexit, and the Scottish leader in parliament went so far as to say the government attitude in negotiations made "Scottish independence inevitable"- all headwinds Theresa May appears to be ignoring or treating with disdain.
