If there is some excessive effort to turn the Court into a political body as opposed to being neutral, would Gorsuch prefer a level of judicial restraint as a preferred alternative, is a question posed in this report.

The FDR-Truman period laid behind the chapter of excesses of capitalism and Roosevelt's response, Truman set the Free World's response to the Soviets, Eisenhower period completed the Interstate Highway System but was stagnant in other respects. It is this Wisconsin campaign that put Kennedy on the map for the Democratic nomination in 1960 with a new feeling in the air about what America could really aspire to and aspire for. ...

This WSJ editorial describes the choices facing states in the U.S. for Medicaid- staying in and increasing the strain on state budgets or opting out altogether from Medicaid when hospitals in the states have enlarged their Medicaid dependent programs- as being a kind of extortion. Justice Kennedy said this was not giving the states much of an option, and Justice Scalia described it with a Jack Benny humor quote about being held up by a robber saying "your money or your life." Justice Roberts described the overwillingness of states to accept federal funds that got them to this point. The overall sense of the hearings at the U.S. Supreme Court on the third day, was that of skepticism on the part of Justices Scalia, Alito, Kennedy and Roberts, leaving Solicitor General Verrilli to make an appeal to humanitarian and patriotic sentiment about millions of the poor who would go without medical care if the Court ruled against the government.

In a blow to public employee unions the U.S. Supreme court rules that unions cannot collect dues from non members. Doing so would violate worker's free speech rights said the court in 5-4 decision. The U.S. Supreme Court  narrows the scope of the ban to people who have no bonafide relationship with a person or entity in the U.S., and allows partial implementation of the ban on 6 countries sought by the Trump administration. The court will hear the full case with oral arguments in October to decide. Earlier lower courts had reversed the travel ban, and president Trump filed an emergency appeal at the high court. The narrowing of the implementation is also applied to refugees. Chief Justice Roberts worked to negotiate a compromise on a middle approach, getting Justices Kennedy and the four liberal justices on board for the unsigned opinion. Conservative Justices Alito, Thomas and Gorsuch offered a partial dissent saying that the compromise was not workable in practice.

The arguments of both sides in front of U.S. Supreme Court Justices on the Health Care Law's expansion of Medicaid. Justice Scalia said the law gives the states no choice. Justice Kennedy pointed to the situation of the states which have no way to opt out without stripping millions of Americans of medical care. Textualism or strict interpretation of the Constitution word for word may be back but one can never be sure. No sooner is one decision made in a certain direction with a particular approach to the law whether it be textualism or something else it then comes up for rethinking a few years later, under a different approach to the law or from a new angle. This is the law practiced in most British style courts of law including the US.  Former Justice Breyer of the US Supreme Court replaced by his law clerk Ketanji Jackson, is interviewed by NYT's Adam Liptak. Today so much is written about Breyer as a non textualist, and Gorsuch, Kavanaugh recent additions to the Court as textualist or strict interpreters of the Constitution based on when it was written with what intent. Yet as thinking individuals who like the rest of the American people grow in their understanding all Justices cannot be categorized  in this way. Breyer says he worked with retired Justices Kennedy and Souter and found them to be willing and keen on hearing all angles. Then it has to be said that both Kavanaugh and Gorsuch were law clerks for Kennedy. Much of American law at the highest court actually is no better than any other human creation - it tries to approximate as best one can the people of the US. Sotomayor coming from Puerto Rican descent, Ketanji Jackson from minority black, Kavanaugh and Gorsuch from Georgetown preparatory schools where Kavanaugh's paternal grandfather attended Yale something even JFK could not claim, Chief Justice Roberts coming from a company professional type background, Barrett a professor at a Catholic university, Kagan with a Bostonian JFK style background, Alito old Italian and Clarence old minority black background. Breyer retired recently to make way for a younger judge, Judge Ketanji Jackson who was law clerk to Breyer. Breyer is writing a new book which he hopes the conservatives on the Supreme Court will read- Justices Kavanaugh, Barrett and Gorsuch. The book coming out March 26 has the title- Reading the Constitution- Why I Chose Pragmatism not Textualism. He hope these Justices will read the book and say their colleague was making sense, would say that it was not a bad point. ...

The Supreme Court upheld the provision under an Arizona state law that requires police to check the immigration status of people stopped for traffic and other offenses. By a vote of 6-2 the Supreme Court voided the provision that made it a state crime to fail to carry federal registration papers. By a vote of 5-3 it voided the provision that provided for jail time for immigrants not carrying federal registration papers. Justice Anthony Kennedy wrote the majority opinion that includes Justices Roberts, Ginsburg, Breyer and Sotomayor, and said: "The government of the United States has broad, undoubted power over the subject of immigration and the status of aliens... Immigration policy can affect trade, investment, tourism and diplmatic relations for the entire nation." At the same time Justice Kennedy said " the problems posed to the State by illegal immigration must not be underestimated," saying that "unauthorized aliens, were responsible for a disproportionate share of serious crime." Unauthorized aliens are only 8.9% of the population of Maricopa County which includes Pheonix, but caused 21.8% of the felonies. The part of the Arizona law SB 1070 that stated the illegal immigrant seeking work was commiting a crime, was struck down on the grounds that this "would interfere with the careful balance struck by Congress" for the labor market in which only employers are committing a crime. Justice Kennedy reminded the country that it was still a nation of immigrants....

Robert Reilly, an assistant to President Reagan, former director of Voice of America, says don't underestimate the importance of what the younger Bush as president called "the vision thing." Efficiency experts like Hoover, and Republican candidates who had business and other professional experience but could not grasp the moral imperative in politics such as Alf Landon (1936), Wendell Wilkie (1940), Thomas Dewey (1944 and 1948) failed to convince voters. Democrats presented ideas like the Fair Deal, New Deal (FDR), New Frontier (Kennedy), Great Society (Johnson) and captured this "vision thing" to win. This is why he is skeptical about Romney as business and management consultant coming in and bringing change with a number of management consultants. Bush and Obama wars left this region and rural regions across the US neglected till Biden pulled out of Afghanistan and made rural America a top priority with the hundreds of millions of dollars needed to invest in it. It is as tough to tackle as the poverty in a similar forested and hilly part of eastern India called Orissa and Chattisgarh, which is only now receiving the attention of prime minister Modi in his third term. WSJ says J.D. Vance called mere rhetoric as no answer to such intractable problems in his Yale days, calling mere reference to cultural issues and immigration as forms of cultural heroin that would do little to change the centuries old poverty of the region.  Of the 39 year old senator J.D. Vance migration to MAGA, WSJ says it reminds them of Obama with only 2 years experience in the Senate- Vance has only a little over a year- who with lack of experience contested for the presidency of the US only to find Republicans poking Obama for seeking the presidency with such insignificant experience. This led to one of the least effective presidencies for lack of bipartisan support similar to that of Bush, both distracted by wars neither had the wisdom to not enter in the first place or to end quickly.   ...

RFK Jr. nomination heads to the full Senate for confirmation as Health Secretary to bring new ideas and solutions to tackle obesity and disease in the US. He called the US health condition dismal as it is, not just for what is spent. RFK Jr called the US a sinking ship when it comes to the health of its people as he answered questions from Senators at Senate hearings. Ron Johnson, Senator from Wisconsin, said RFK Jr. was an answer to his prayers for someone who could help tackle this crisis. A Vermont musician could not practice her livelihood after her arm was amputated because of gangrene. The gangrene developed as a result of a physician's assistant at a clinic using a a wrong technique for adminstering Phergan for nausea. The PA used IV Push instead of an IV drip or intravenous which is the right method. He missed the vein and and hit an artery causing the gangrene to develop. A Vermont state court awarded Ms Levine $6 million from Wyeth Pharmaceutical. Now the Supreme Court upheld the Vermont Court, with Justices Kennedy, Souter, Ginsberg, and Breyer joining Justice Stevens. Justice Thomas concurred. Scalia, Roberts and Alito were in dissent. Wyeth had a FDA approved label that warned against "inadvertent intra-arterial injection," but it did not say do not use IV Push. Justice Stevens writing the majority opinion said Wyeth's reading of the regulation was "cramped" and based on a "fundamental misundrstanding." He said "the manufacturer bears responsibility for the label at all times," and affirmed the Vermont Court's opinion that Federal law provides afloor not a ceiling for state regulation." ...

A critical part of the Affordable Care Act is the setup of marketplaces or exchanges to let people without insurance buy individual health plans. Some states setup their own exchanges, and some states let the federal government step in and run them. To help the lower middle class and poor the Act provides health subsidies to buy insurance in the exchanges, and 85% of customers in the exchanges qualify for this benefit. The U.S. Supreme Court voted 6-3 in 2015, compared to a tight vote in 2012 on the Affordable Care Act, to maintain the health subsidies. Justice Roberts wrote the majority opinion, saying "Congress passed the Affordable Care Act to improve health insurance markets, not destroy them." Justice Scalia dissented calling it "interpretive jiggery-pokery." Justices Clarence Thomas and Samuel Alito Jr. dissented. Voting in favor were Justices Anthony Kennedy, Ruth Bader Ginsburg, Stephen Breyer, Sonia Sotomayor, Elena Kagan, Justice Kennedy dissented in the 2000 case. The challengers petition to the courts was based on a reading of phrases in the Affordable Act which had not occurred to the writers of the law. The reading suggests only people enrolled in state setup exchanges are eligible for subsidies. If the Supreme Court ruled in favor of the plaintiffs the 6.4 million Americans who are enrolled in the federal exchanges would lose the subsidies provided under the law and lose health insurance. And the economic foundations of the Affordable Act would be undermined with insurance companies required to provide insurance to all regardless of pre-existing conditions and subsidies removed, leaving the companies with sicker pool of customers resulting in destabilizing the exchanges and higher premiums. The court ruled in favor of an interpretation that is compatible with the whole law and the intentions of the statute to help the middle class and the poor buy health insurance. The chaos in the insurance markets that would result in going with the plaintiffs because of a careless writing of a phrase, was uppermost in the majority's mind. Chief Justice Roberts emphasized this, saying- "The statutory scheme compels us to reject petitioners' interpretation, because it would destabilize the individual insurance market in any state with a federal exchange and likely create the very 'death spirals' that Congress designed the act to avoid." This case originated with 4 plaintiffs from Virginia who challenged the IRS regulation that said subsidies were allowed regardless of whether the exchanges were run by the state or the federal government, arguing that this was at odds with the particular phrase in the law that was ambiguous about federal exchanges eligibility for health subsidies. Judge Roger Gregory of the Fourth Circuit Court of Appeals in Richmond, Virgina, ruled that the phrase was indeed ambiguous, but the IRS was owed deference in its opinion. Chief Justice Roberts made it clear that this was not a case for the IRS, saying "it is instead our task to determine the correct reading." ...

Robert Kaiser, former managing editor of The Washington Post, reviewed this book on Joe McCathy in The Washington Post on August 7, 2020. It shows the link with today of Senator Joe McCarthy and Roy Cohn, the then 27 year old lawyer chief counsel of the senate subcommittee on investigation when Joe McCarthy became chairman in Jan. 1953. The book is-  Demagogue The Life and Long Shadow of Senator Joe McCarthy by Larry Tye. Roy Cohn passed on some of the methods used at that time to Mr. Trump. Kaiser points out that the senator Joe McCarthy assembled "a coalition of the aggrieved." Tye shows that it started with the junior senator from Wisconsin making a speech in West Virginia for Lincon Day dinner to the Republican ladies of Wheeling, W. Va. The senator used it to talk about threat of communists working in the State Department. He claimed there were 205 Communists. Today we know that this was just made up by McCarthy, at a time when Winston Churchill made the speech about the Iron Curtain in Eastern Europe and the Soviet Union and a sense of shock in America at the People's Republic of China being formed in 1949 under CCP chairman Mao tse tung. McCarthy saw this as an opportunity to gain prominence and a Senate career. What is seen from this carefully researched book is that for a while it succeeded in putting many of the Nation's best leaders on the defense. This includes Harry Truman, Eisenhower himself who disdained McCarthy's and Cohn's methods, Gen George Marshall who was a mentor to Dwight EIsenhower, Joe Stilwell, and other military leaders who ran the 1940's war effort under Marshall in Europe against the Nazis and in China against the Japanese imperialists. On the domestic side it included the head of TVA and the new Atomic Agency setup by president Truman. Gallup said at that time of McCarthy's 38% support in the US following his censure in US Senate by 67-22  -even if it was known that McCarthy killed five innocent children they would still go along with him. Tye writes that in that atmosphere similar to the sense of shock at China's rise and America's loss of manufacturing and falling behind in infrastructure by 2016, in that atmosphere if one told a small lie or big lie it made not much difference in public's penalty or censure, then why not tell a whopper of a lie. This became the ethic for a while in 2016-2024 similar to the period till the collapse of McCarthyism in America by 1957 with McCarthy's death in 1957 and in 1960 the election of John F. Kennedy. What is forgotten is that Richard Nixon a young senator from California was part of the group in Congress, so that in some shape or form it existed and remained part of the Reagan efforts to push back against the Soviets that led to wars in Afghanistan and then Iraq sapping the Nation's energies and resources and with faulty economic theory allowed China to dominate key industries and outspend America in infrastructure investment, creating the kind of shock that led to the second McCarthyist decade under Mr. Trump. ...

Indonesia is a country with a long history of Hindu and Buddhist culture before conversion to Islam through traders from Malaysia and Sufi saints in the sixteenth and seventeenth century. Hanuman and other deities from India are also part of the existing culture and traditions. Communist influence has been alien to this culture and tradition as in India. It was part of the Dutch empire in the east and a source of European trade in spices from the seventeenth century. It is also a extensive island chain of Java, Sumatra and other islands with a population of 280 million very closely linked to India culturally and with links to America since independence. Indonesia was given a great deal of importance during the Cold War with Robert Kennedy and other leaders visiting Indonesia during the period after Sukarno in the sixties. By 2000 the US engagement with China had evolved to the point that neglected India, Indonesia and the entire south east Asian region in a preference for links with China.  The British division of India led to the US links with India and Indonesia being shaped by that division and the Cold War with Russia. The confusion of the struggle against colonial rule of the British and Dutch led to leaders such as Nehru and Sukarno who compounded the difficulties of the Cold War and perpetuated with it the old British idea of a divided South Asia on a religious basis that had supported British rule and set the conditions that made it possible for a small group of English civil servants to run the country. This led to the Indian and Indonesian relationship with the US being stifled as the US struggled to rid itself of the British obsession with a divided India. Culturally India and Indonesia are part of an extended region in Asia with development aspirations and a youthful population that aspires to better infrastructure, better education, healthcare and ease of living, and the better opportunities in life. This is what migration did for Europeans who left for America for a new life on the east coast and on the prairies of America. It has little to do with the obsessions of the British and the Dutch that divided the region between the Indus and the Ganges and divided the Indonesian islands. That phase is now coming to an end as China reverts to its Communist period leadership under a new generation led by Mr. Jinping, a son of one of the veterans of the Communist Revolution of 1949. The US has to evolve its relations with India, Indonesia, Vietnam and other countries into new ties of trade, culture and technological exchange. This is needed as it winds down its close trade relations with China in its supply chain to rebuild a new supply chain after the trade wars and the pandemic revealed the deep flaws of that supply chain. What is needed is not the efforts of one changing adminstration after another, but an effort started by president Biden that will last through different administrations as the US engages with Asia in the way that it engaged with Europe after FDR and Truman for most of the twentieth century. And one that rids itself of the obsessions of divided regions from the colonial period of the Dutch and the British. The1.6 billion people in India and Indonesia share a  common aspiration of being a major part of the Free World with America. ...

A landmark ruling and a huge win for consumers and for the country, as the Supreme Court says states can enforce fair-lending laws and other consumer protection measures against the largest banks in the USA. The Suprem COurt said that the rules issued by the federal banking regulators like the Comptroller of the Currency under the NationalBank Act - a law passed in 1864- could not block sfforts by the states to enforce their laws. For the country its a win because the lack of enforcement of state laws only allowed abuses in the subprime area to continue and helped create the subprime mortgage crisis. The case began with letters by the New York Attorney General Eliot Spitzer in 2005 to several national banks including CItigroup, JP Morgan Chase and Wells Fargo inquiring about lending practices to minorites. The letters referred to "troubling" disparities that suggested black and Hispanic borrowers were being charged disproportionately higher interest rates on mortgages compared to whites. THe letters asked for information "in lieu of subpoena." Protection of minorities and the weak in American society is part of the moral fabric of America and that it had eroded in recent years is evident in the manner the banking sector responded. A banking trade group and the Office of the Comptroller of the Currency brought a lawsuit to block the New York Attorney General's request saying that the National Bank Act nd rules issued by the Bush administration in 2004 gave that type of authority to comptroller and prohibited such efforts by the states. And then afederal district court ruled against the states, aand the U.S. Court of Appeals for the Second Circuit Court affirmed that decision. These are instances where the system failed to protect the weak even with the laws that states had on their books. Justice Scalia voted in favor with a 5-4 vote to allow states to enforce consumer protection laws, even though his written opinion was based on an interpretation of what "visitorial powers" of a federal regulator were, and not about the importance of fair lending in the proper functioning of the American economy.
