The Supreme Court ruling on EPA mercury regulations gives smaller plants with coal fired plants more leeway in installing scrubbers. Large companies have already committed to installing scrubbers for coal fired plants. Regulations are only one reason for the shift to natural gas from coal. Lower prices of natural gas and increasing supplies are a major reason. The U.S. will reduce dependence on coal for energy from 39% to 36% in 2015, with natural gas increasing from 27% to 31%, and renewable solar wind energy making up about 13%, according to EIA.

Simon Denyer's interview with Vinod Rai, the Comptroller and Auditor General of India. Rai has persisted in uncovering corruption in India. He was appointed by prime minister Manmohan Singh from India's Finance ministry five years ago, and runs an organization with 63,000 employees with accountants in all Indian states. Reports by his agency have uncovered giving away of natural resources and telecom licenses worth billions of dollars. He describes the amounts involved as huge and attributes the increase in accountability of politicians and ministers to active citizens groups. The Indian media and Supreme Court have supported efforts to increase accountability. The CAG has constitutional protection. Rai sees the CAG's role as examining government spending to uncover irregularities and make it accountable to parliament. India is rare in this respect compared to China, Russia and other emerging market countries because of its vibrant media and democracy. A 2010 report uncovered corruption in giving away mobile phone network licenses and a 2012 report uncovered allocation of coal land without a competitive auction, with loss in government revenues estimated at $30 billion. The reports showed prime minister Singh aware of the irregularities but unable or unwilling to call for transparency and proper process. Rai's six year term expires in May 2013. ...

On Jan 19, 2023 the US hit its debt ceiling of $31.4 trillion. Republicans control the House of Representatives by only a few votes after a strong showing in midterms by Democrats who control the Senate. A small section of the Republican party insists that raising the debt ceiling- a task performed by the House of Representatives- should only be done with serious cuts to Biden programs to help workers and families during a cost of living crisis. Biden says he will not negotiate, simply won't.  This report in NYT by Jim Tankersley, says president Biden in the last resort could resort to the 14th Amendment which says: "The validity of the public debt of the United States, authorized by law, including debts incurred for payment of pensions shall not be questioned." What this means is that in the last resort if Republicans insist on serious cuts because of a faction within the party, and not because the whole party supports it, Mr. Biden could continue public borrowings to pay social security and make other payments. Moody's says this would lead to a rise in borrowing costs temporarily but would not lead to a recession, and have long term benefits as the debt ceiling could not be applied in the future. It would be challenged by Republicans and go to the Supreme Court which would have to decide on the issue: "the validity of the public debt of the United States shall not be questioned." The president's experience in US Congress for about 40 years was invaluable in getting through Congress the Chips and Science Act, the Inflation Reduction Act, and the assistance to families during the pandemic. Only LBJ in recent post war American history had this kind of experience in getting Medicare and Social Security legislation through Congress. Combining this with the experience and negotiating skill for legislation of Pat Schumer Senate Majority Leader is something not seen since the 1960's. This team comes with a clear dedication and plan to restore democracy to the people by building infrastructure, rebuilding American manufacturing and protecting workers and families through cost of living action and higher wages. As Jake Sullivan NSA, a law clerk for Supreme Court Justice, and one who with the advice of the president has put domestic policy at the heart of foreign policy, puts it for workers and families in the US, these are goals he said at Brookings, "we must, we will achieve." 10% tariff on Canada's exports to the US after Ontario Reagan ad misrepresenting trade facts is aired on television. The ad seeks to show US tariffs in the light of the Smoot Hawley tariffs of the 1930's, when the tariffs today date back to Reagan's use of tariffs when Asian partners (at that time Japan in the 1980's) followed unfair trade practices to the detriment of American workers and industry. The US Trade Representative who acted for Reagan was Lighthizer, the same USTR who worked for DJT in the first term to fight the unfair trading practices of China, and whose deputy USTR Jamieson is now the USTR in DJT second term negotiating with Asian partners. Tariffs ae being used as an additional tookl in the toolbox by DJT and Lighthizer/Jamieson to counter the unfair trading practices of other nations, which includes partners of the US such as Japan, South Korea, Taiwan, and EU. It also includes nations such as Switzerland who ignored US interests in trade whie having open access to the US market. Most of these nations know that these practices harmful to world trade exist, only Canada, China and some other countries have pretended they do not exist and they are the so called "champions of free trade." These nations attempt to make DJT appear to be doing this on whim when this is an issue in trade relations between the US and Asian partners, the EU, and Canada/Mexico for the last 50 years. DJT pointed this out- “The sole purpose of this FRAUD was Canada’s hope that the United States Supreme Court will come to their “rescue” on Tariffs that they have used for years to hurt the United States,” Mr. Trump said in a social media post Saturday afternoon. “Because of their serious misrepresentation of the facts, and hostile act, I am increasing the Tariff on Canada by 10% over and above what they are paying now. Former Attorney General of Ohio, Richard Cordray, is nominated to head the Consumer Financial Protection Bureau. Cordray was the first attorney general to file a lawsuit against a loan servicer for violation of state consumer laws. Prof. Lasson of the law school at the University of Maryland, teaches civil liberties. He provides perspective on the situation in Baltimore by giving a brief history of the city, and going over the history of Catholics, Jews and black people in the city as they struggled to assert their rights. Thurgood Marshall did not apply to the University's law school because he feared he would not be accepted. He went on to be appointed to the U.S. Supreme Court in 1967. The 1857 Dred Scott decision before the Civil War was written by Roger Tany, who was from Baltimore. Maryland was a slave state before 1865. The law library at the law school of the University of Maryland now has Marshall's name.

The 2016 Republican platform is written to express the ideas in the Republican Party for family values, child rearing using the Bible and traditional values, calling pornography a "public health crisis."  The Family Research Council and tradition or family focussed groups played an important role in writing it, with Mr. Trump playing less of a role. Instead of "physical barrier" with Mexico, it says "a wall"  should be built in a taking up Trump's idea, but in general it is a clear expressing of traditional family values that Republicans have supported for years and expressed frustration with the movement of social lives in an opposite direction. The same sex marraige decision by the Supreme Court and transgender debate were not present in 2012 election, so in that sense the Republicans see the country as moving in a different direction. More of the pendulum having swung too far in another direction is how Republicans perceive it, and their response is to go back to how things used to be and the world they knew, based on what they see as positive outcomes for the whole of society. Hence language that encourages teaching of the Bible in public schools, condemning pornography as a menace particularly for children, and insisting on "man made laws being consistent with God given natural rights." A good understanding of the Bible is considered "indispensable for the development of an educated citizenry."   Amendments opposing gay and transgender are being added. ...

From now on the vaccination program in India will be run nationally by the federal government. This will ensure fair access to vaccines to all parts of the Indian population. Earlier vaccine costs were bid up as states and private hospitals bid up prices. Under the new national program 75% of vaccines will be given out by the federal government and 25%  by private hospitals and other private health institutions. The government in New Delhi under prime minister Modi will offer adults free vaccinations. Modi said "We will increase the speed of procuring vaccines and also increase the pace of the vaccination program." Even in private hospitals the cost of vaccine will be kept at Rupees 150 or $2.06. Experts say this is the right policy and the government has learned from errors in letting states and other private institutions run vaccine policy, which made it too fragmented and subject to too many variables, resulting in inequity, and slowing vaccination drives. The Supreme Court stepped in asking for clarity, leading to the clear policy from the federal government announced today.  Advantage of the new policy is that the responsibility lies in one place, and the federal government also has the clout to make things happen, to negotiate with companies and other parties involved effectively. India has vaccinated 222 million people but because of the population being so large at 1.2 billion this comes out to be a small fraction of the population. This puts the task of getting vaccine supplies and getting the vaccination drives to work in the only place that has the determination and the resources to deliver results by vaccinating 1.2 billion people by December 2021. It has never been done before in history says Mr. Modi, and it is a challenge that India is now taking up for itself and for the global community. It also lays the ground for India to help its neighbors in Asia and in Africa, Latin America in 2022.   ...

A hard fought election in Brazil between Mr. Bolsanaro and an ex-president Lula da Silva. Voting is compulsory in Brazil for all those who are literate and between age of 18 and 70 years. There are 156 million registered voters. President and members of Chamber of Deputies are elected for a four year term. Elections also take place for 27 governors for 26 states and one federal district. If no candidate in elections for president or governors gets 50% of the vote the vote heads to a runoff on October 30 between the top two candidates. Bolsanaro is supported by evangelical Christians in a Catholic country, rural landowners, and business people. He was a deputy or member of parliament for the state of Rio de Janeiro for 27 years, who won on a law and order and anti-corruption platform in 2018. Lula da Silva is a former trade union leader who was president from 2003 to 2010. He was popular during a commodity boom in Brazil's soyabean and iron ore export boom to China that financed social support programs. A corruption scandal affected his successor from the Worker's Party leading to the change in government after the collapse of the commodities boom. After he was given a jail sentence under the Bolsanaro government he was released by the Supreme court decision in 2019 that declared there was a lack of due process in his conviction. Mr. Bolsanaro also as a program to benefit poor families that is called Auxilio Brazil to replacve Lula's Bolsa Familia. Payments to 18 million recipients were increased in August and a monthly stipend was added for taxi and truck drivers by Bolsanaro. The competing interests and the pandemic with the high toll of around 685,000 deaths have created a highly contested election. ...

US Business has considerable apprehension about the former president in 2024 compared to its willingness to consider Trump in 2016. At the time executives from investment bank Goldman Sachs and heads of oil companies joined the Trump administration. This time US business and corporate interests are apprehensive about becoming the target of a tweet they might find the next morning under a Trump administration. They are not supportive of student loan forgiveness, but when it comes to the CHIPS and Science Act they see president Biden as effective and helping industry. Business leaders have a negative view on the Trump effort through appointment of 3 Supreme Court Justices of overturning decades old rights of women on abortion, and on this issue alone many will support Harris-Walz, overriding other concerns they might have. The visions of Harris and Trump are so vastly different with one calling climate change a hoax and hyping up social issues and infrastructure needs without any record of delivery when in office, and the other a strong position on climate change, wages and income, delivering on infrastructure and CHIPS that US Business. The result is that it leaves US Business with no better option in 2024 than to support the vision  that takes America forward. There are different sections of the business community which have different priorities.  Silicon Valley, and oil, pharmaceuticals because it profits most from light regulation which brings with it social costs is a special issue not addressed here. Other business, banking, automobiles, and a range of other industries have other priorities yet also see the need for the economy and the US to move forward with a different vision than one that simply ignores climate change, and fails to address child care, child poverty, wide disparities in wealth, and other issues facing of wages, cost of living facing most Americans.  ...

DJT executive orders include one ending birthright citizenship. “It was really meant for children of slaves." DJT is referring to the 14th Amendment that was passed in 1868 by Congress and ratified by 1868 by the states. It came after the Civil War and Emancipation of slaves and was intended without any doubt for one and only one purpose to make slaves citizens of the United States Look at Section 4 of the 14th Amendment which says the United States will not allow any claim for the loss of any slave. "But neither the United States nor any State shall assume or pay any debt or obligation incurred in aid of insurrection or rebellion against the United States, or any claim for the loss or emancipation of any slave; but all such debts, obligations and claims shall be held illegal and void. The only SC decision in US vs Wong Kim that gave citizenship in 1898 to Wong Kim was not intended to go beyond that particular case, it was only meant to make an exception to the Chinese Exclusion Act  of 1882 after which till 1960 (JFK's election) Chinese immigration to the US was stopped, and the same for all Asians. Only immigrant labor allowed in was from Mexico for agriculture till 1960. And in 1954 Operation Wetback wwas conducted by Eisenhower to return about 1 million illegal immigrants to Mexico. DJT says- “It was not meant for everyone to come into our country by airplane, or charging across the borders from all over the world and think they’re going to become citizens.” The millions that came illegally across land border  and the flow of drugs is a new situation that Congress and the Supreme Court are only facing since 2014 a period in which wars in Afghanistan and Iraq took time and resources away from problems at home. ...

Simon Jenkins of The Guardian says it is time to clear some of the myths around migrants, tariffs, and NATO and in this way action by the current Republican administration can be a positive step. Jenkins says DJT is moving quickly in the first 100 Days because most presidents get only 2 years to make changes before losing the House or the Senate making legislation difficult to pass. If it appears that things are happening on many fronts too quickly that is just the nature of things under a democratic process where checks and balances mean all three parts of government- executive powers of the president are balanced by powers of Congress and of the Supreme Court. Jenkins points out that action on migrants with the unease about millions of migrants coming in illegally, putting tariff barriers to bring manufacturing back and rebuilding America's forgotten middle class, cutting the bureaucracy and misuse of funds, sending education back to the states, and rethinking NATO bringing Russia back into the community of nations, will have long term positive effects long after the chaotic nature that they appear in the news cycle and the media presentation has passed. He cites China being invited back into the community of nations under Nixon. And today disarmament possible only by working with Russia, when China is moving in the direction of increasing nuclear missiles with trouble spots in Taiwan. He does not mention the sending back of about 1 million people back to Mexico under President Eisenhower in Operation Wetback in 1954, Harry Truman a senator from Missouri who led the effort to cut waste and fraud in government spending in the Second World War, the ED Hirsch graph showing reading comprehension scores of American K-12 headed one way - straight down since the 1960's showing education is failing in the US and needs parents and states to come up with new solutions.   ...

The Nation is faced with another Supreme Court decision as in 1868 for the 14th Amendment, in 2025 on birthright citizenship.  The 14th Amendment was written in the 19th century it had no concept of the 20th century and absolutely no idea of the 21st century we live in, unable to even conceive of conditions today, or even think of  setting rules for immigration today. It rejected the Dredd Scott decision of 1857 denying black people rights as citizens, restating the law of the land, had nothing at all to do with stating the opinion of the Judiciary on whether a mother flying in from Asia could secure US citizenship for a new born child by merely visiting the US. As in 1857, in 2025 the law is based on assumed historical facts as Lincoln said on Dredd Scott decision, that are not really true. Lincoln said in 1857- "That burlesque upon judicial decisions, and slander and profanation upon the honored names, and sacred history of republican America must be overruled, and expunged from the books of authority." The 14th Amendment was written to give black people the rights of citizens of the US, in a complete repudiation of the Dred Scott decision of the US Supreme Court of 1857 that deprived black people of rights as citizens because Judge Tanney said the British Empire had set up the institution of slavery in the American colonies and the British were responsible for the institution, little we can do about it. When by 1807 slavery was being banned in Britain and in 1838 totally banned in the British Empire. It created the idea that Americans were not the master of their destinies after the departure of the British to choose which institutions they would keep and which they would reject including slavery. Abraham Lincoln citing President Andrew Jackson said each the executive, the judiciary, Congress, and the common man were entitled to their own view of the US Constitution as they understood it. Lincoln also said Judge Tanney's decision in Dred Scott case was based on assumed historical facts that were not really true- Judge Tanney making no mention of the fact that in 1857 the British Empire had already abolished the institution for 50 years. The DJT Executive Order banning birthright citizenship shown here on the White House site has the title- Protecting the Meaning and Value of American Citizenship. It is written in  simple language in 1 page -Purpose, Policy, Enforcement and Definitions, Provisions.  The purpose clearly states that the Dred Scott decision of the US Supreme Court in 1857 is what the framers of the 14th Amendment had in mind when they drafted the 14th Amendment of the US Constitution. A reading of the 14th Amendment makes this abundantly clear. The wording comes out at the outset reversing the Dredd Scott Decision of 1857. It's repudiation was why the Northern and Southern States fought the Civil War. The National Archives say that with Dred Scott decision to allow the spread of slavery to American territories in the West,  America moved one step closer to civil war. With such  momentous events in the history of the US 1857-1868 the framers of the 14th Amendment were not sitting down to write rules about what was right for America a century and a half later.    ...

Interracial marraiges are increasing since the Supreme Court made antimiscegenation laws unconstituional in 1967. According to a new report by the Pew Research Center- based on historical data and Census Bureau information of the annual American Community Survey- 15% of all new marraiges in 2010 were between people of different race, ethnicity or color. This is double what it was in 1980. Of the total people married in 2010, 9% of whites, 17% of blacks, 26% of Hispanics and 28% of Asians were married outside of the ethnic and racial group. Interracial marraiges were more common in western states and in the northeastern U.S. compared to the southern and midwestern states. In the western states 22% of all marraiges were between people of different ethnic or racial groups or color. College educated people under 30 were the most open to interracial marraige.

A three judge special bench of India's Supreme Court led by chief justice Rajendra Mal Lodha, said the process of allocation of coal licenses by the coal ministry lacked accountability and openness. Lodha said: "There was no fair and transparent procedure, all resulting in unfair distribution of the national wealth. Common good and public interest have, thus, suffered heavily." A report by India's federal auditor in 2012 stated the improper allocation of 200 coal leases to private companies cost the government about $30 billion. Former prime minister Manmohan Singh of the Congresss party headed the Coal ministry for part of the period when the improper coal leases were given, leading to intense criticism from the media. This was an issue in the elections leading to the defeat of the Congress party by the BJP party led by Mr. Modi.

The trade deficit with China has led to loss of 3.8 million jobs, 75% of them or 2.9 million in manufacturing. Go back to 1990 and Beijing was a city of bicycles not cars. If Beijing shifted to a open economy and simply imported products from the US and Europe as it had done since 1700 it would have remained a backward agricultural economy. It took 20 years of focused effort after 2000 for China with US technological assistance to excel in manufacturing, as the US had done after 1920. Can or cannot the US excel in Manufacturing with its own focused effort and restore jobs and decent wages to the American people, that is the question. That a $1 trillion deficit that has already destroyed the US manufacturing and its capacity to defend itself by rapidly building up the US Navy, is that not an emergency, then what is, is also the question, and the role, the duty, of the president of the US in such a situation. The federal appeals court has allowed the DJT Tariffs to remain in place till it goes to the US Supreme Court. Today May 30 the WSJ in a front page article shown here says the one California shipyard could assemble a supply ship in 5 days in 1942. China's independence in the fight against Imperial Japan and the Kwantung Army's adventures, and the independence of Europe in the 1940's depended on this vital US capacity. Is this forgotten? FDR acted step by step by 1938 to restore the US lost capacity at that time, what is the role of the president today? ...
