Plan B is to reimpose the tariffs using the Section 122 of the 1974 Trade Act and Section 301 which puts the tariffs on firm legal footing. In fact the ruling by the ITC Court on the use of emergency powers under IEEPA law said there was already Section 122 on the basis of which serious trade imbalances could be addressed. Trade Adviser Navarro told Bloomberg that this was a possible strategy to reimpose the tariffs. The federal appeals court has allowed the tariffs to remain in place after the ITC ruling. The administration is appealing it to the US Supreme Court saying that the ITC ruling has unfairly jeopardized the president's negotiations with other countries.

Clean Energy and Manufacturing investments under Biden Inflation Reduction Act in North Carolina, South Carolina, Georgia, Kansas, and other Republican states are leading to the Senate Republicans taking a position favoring keeping such investments in the DJT 3B Tax Cuts Bill. Republican states getting bulk of clean energy investments from Biden's IRA Act are working to keep the jobs and factories being built in their states. About $130 billion of $271 billion to 2032 has already been given out, the Senate 3B Tax Cuts Bill wants to keep these tax credits for renewables till 2027. North Carolina is an example which has $21 billion in such clean energy and manufacturing investments since 2022 when the Inflation Reduction Act of president Biden was passed. The IRA Act gave states $271 billion for such investments over a decade. Senator Thom Tillis is leading the Republican Senators group that wants to keep these projects that bring jobs to North Carolina, South Carolina and Georgia as the biggest recipients.This means the Senate bill sent back to the House will try to come up with a moderate position on Clean Energy and Manufacturing investments that bring jobs to Republican states. ...

The surprise is the DJT Senate bill cuts to about 75% of the solar and wind subsidies in the Biden 2022 IRA Act for $843 billion in investments that were going to Republican districts. New rules in the Senate version of 3B Tax Cuts Bill require US renewable solar to disentangle supply chain from China by 2027 or face an excise import tax. All renewable subsidies will also be phased out earlier by 2027 instead of 2032 set by the Biden administration in the Inflation Reduction Act. The Inflation Reduction Act passed in 2022 with subsidies, tax credits for renewables solar and wind led to $843 billion in planned solar and wind investments. Suddenly much of this is placed in doubt. Instead of 2032 phase out the date is moved up to end of 2027 for 30% subsidies and to end of 2028. Judge Carl Barbier's ruling on Jan. 14, 2015 against BP which increases its exposure to a maximum penalty of $13.7 billion under the Clean Air Act. Judge Barbier's decision was that BP was liable for 3.19 million barrels of crude that spilled into the Gulf of Mexico in the 2010 Deepwater Horizon rig disaster. Judge Barbier's ruling said that BP acted recklessly in the events leading to the rig explosion an oil spill, giving the company exposure to the maximum penalty of $4300 per barrel. BP asked for a smaller penalty of $3000 per barrel.

Lost in all this commotion is the fact that there are real and present dangers in the situation presented by Google as a gatekeeper for knowledge and information which are a real and present danger to democratic forms of government as Google or social media tech companies can act as arbiters of information, a role that is not given to them under the US Constitution or any of the principles laid down by our founding fathers. Demand for autos after pandemic and lockdowns coupled with supply chain problems caused auto prices and used car prices to rise sharply. This is now reversing with price declines. Greg Ip's 2026 warning about Stablecoins citing 1837-1863 privately issued bank notes fragmented fraud prone and outside the official banking system regulation will be remembered years from now when this crypto (anything but stable in the true sense of the word)  leads to a fianncial crisis. Stablecoins crypto currency that is similar to private banknotes issued between 1837 and 1863 with banks issuing their own currency- fraud widespread even with state laws like todays Genius Act. There were many bank failures and financial crises in that period. The state laws in the 1840's required the banknotes to be collateralized but fraud inevitably creeps in as it might with stablecoins.  Leading to financial crises as private capital shrinks and affects public capital that are US Federal Reserve bank notes we use as dollar bills. Today 84% of illicit activity is conducted using these crypto currencies and only 1% used for transactions. Proponents ( who stand to benefit in some way) call it a new efficient way of transactions. But the facts dont lie. Not only are stable coins used for only 1% of transactions, and illicit activity conducted through crypto coins, but also most of this currency is held overseas not in the US where it is less regulated. Federal Reserve has always questioned the value of crypto currency. Here is what Bank of International Settlements (international institution similar to Federal Reserve) has to say-“Stablecoins attempt to import credibility from public money while operating outside the established settlement system.” -Pablo Hernández de Cos, general manager of the Bank for International Settlements Holding Treasury bills as collateral does not remove the basic problem in is design. Issuers are for profit. The Federal Reserve is not for profit. And the Federal Reserve is part of a whole regulatory structure, Stable . laws have loopholes, and coins lack that kind of regulatory structure , making stablecoins prone to failure, an accident waiting to happen. Tether has $190 billion and Circle has 76 billion for about $300 billion in private capital tied up in this undertaking and posing risks to the Us and world financial system. ...

The world today is in a much better position to complete the transition to zero dependence on the volatile Middle East for oil. Today in 2026 the world's largest nations 1. US   2. China  3. India  4. Germany are all free of Middle East oil (India through waivers for Russian sources). European Union and UK is at about 12% which can be quickly substituted from the US+ Venezuela and other sources. US is self sufficient in oil and gas and exports oil to the UK, India, Germany and the European Union. Canada is self sufficient. Germany gets only 6% of its oil from the Middle East, the UK 12%, Spain 13% and Italy 14%. The Iran war is likely to shift more of the needs of UK, Spain and Italy to other more stable sources including oil from the US and Venezuela managed by the US, and other sources. This means that US policymakers can act in the best interests of all the nations of the world for preventing the spread of nuclear weapons and long range ballistic missiles. Germany is moving rapidly to renewable energy and this could bring its dependence on the Middle East to zero. India will meet its needs from Russia for the time being till it also shifts to oil from US+ Venezuela. India get 55% of its oil from the Middle East or about 2.7 million b/d. Russia was an important source of oil for India till the US trade agreement called for it to shift- a 30 day waiver and extension means India can get this oil from Russia without sanctions for the duration of the war. Reducing European demand and Indian demand frees up oil for Japan and South Korea on the world market the other 2 countries dependent on Middle East oil- Japan importing 95% of its oil consumption with imports of 2.5 million b/d and South Korea importing about 2 million b/d or 70% of its consumption. This means Japan and South Korea need a new strategy as they are overexposed to one source just as Germany was and learned a difficult lesson to diversify its sources. Japan has learned to reduce consumption for the same level of GDP and some of this can be through conservation, also tried in Germany in the last 4 years. During the 4 years. of Ukraine war Germany had to find ways to diversify sources Japan and South Korea will need rapidly to do the same in the Iran War. This means that only Japan and South Korea because of their lack of policy direction and vigilance have allowed this overdependence on the Gulf region,  (even as Germany diversified its sources, DJT and Israel were firm on nuclear weapons policy) they failed to see signs that they should diversify. NTT Japan's largest telecommunications company plans to pay a 41% premium on shares of the part of Docomo that it does not own. NTT owns 66% of shares of Docomo. The $40 billion deal is designed to speed up decision making and compete in world markets. New prime minister Yoshihide Suga is pushing for lowering of high mobile phone service prices. Japanese government owns one third of NTT. The WSJ discloses that the U.S. Federal Trade Commission's Bureau of Competition 160 page report in 2012 described Google's anti-compettitive practices and recommended a anit-trust lawsuit for three anti-competitive practices. The WSJ obtained documents based on the Freedom of Information Act. Mullins and Winkler provide a detailed account of the practices cited in the report as anti-competitive. The FTC Commissioners did not act on the report and instead voted unanimously in 2013 to end the investigation after Google agreed to some voluntary changes. The report stated a different conclusion: Google's "conduct has resulted-and will result- in real harm to consumers and to innovation in the online search and advertising markets." The Stop Online Piracy Act is being pushed by the Motion Picture industry to prevent U.S. websites offering pirated movie or television content. Estimates show 13% of Americans have watched pirated movie and television shows which costs the industry millions of dollars. The legislation to correct this under the SOPA is so broad that it would limit the ability of internet companies to operate freely. It gives the Justice Department powers to shut down sites to prevent pirated content from appearing even if the internet companies are not knowingly allowing pirated content through their sites. This is why Google, Wikipedia and other internet companies see this as a violation of freedom for the internet, and leading to possible censorship of the internet. Because the SOPA legislation would allow Domain Name System (DNS) blocking this also affects cybersecurity in a negative way. By redirecting traffic away from pirate websites using a DNS blocking system the move would allow hackers a way to create problems for internet security. For this reason the U.S. government has also raised concerns about this proposed legislation. Considering the problems and issues raised this may be an example of overreach by the Motion Picture industry that affects the vital free flow of information on the web. ...

He points out that costs are high in healthcare because regulations keep them high. Supply of new doctors is controlled because Congress and the AMA made it that way with a cap on residency programs and AMA opposing the expansion of medical schools. In a system of open competition new hospitals and health care businesses would challenge old ones which is not happening in a regulated market with regulations working to limit competition for the firms already in the business and with the influence to limit competition. Insurance costs for major expenses in an open and deregulated competitive market without the regulations would be so much lower than todays costs that its likely we would not even need a mandate such as the one the Obama healthcare law imposes.

This story by Emmarie Huetteman describes the effort of three Republican women in the U.S. Senate who had the courage to listen to the different voices in their home state and use their informed judgement in deciding how to vote on a Republican healthcare bill or Affordable Care Act repeal effort. Especially when they heard that it would hurt people in their state, the elderly, low income and other vulnerable people without offering alternatives. Even when this meant resisting pressure from fellow Republicans. The senators are Capito of West Virginia, Collins of Maine, and Murkowski of Alaska. This is particularly significant at a time when too much polarization has led to paralysis in coming up with informed discussion and good solutions to problems. It is also significant that senators from the midwestern states such as Iowa- Mr Grassley, and Kansas- Mr. Moran, also joined the effort to listen first to people back home in their districts before making up their mind.

As Chancellor Scholz sets anew direction for Germany reminiscent of the days of Adenauer and Brandt following the Berlin Airlift in 1948, two previous chancellors offer a stark contrast. Policies of Gerhard Schroder of the SDP and Angela Merkel of the CDU created some aspects of the situation where China and Russia are able to act in the manner they are acting today. Schroder made CDU policies under Merkel look acceptable even as they actually strengthened the position of both Russia and China in relation to the US. Both Schroder by joining the boards of Russian oil companies and Merkel with her policy towards China integrating German economy with China's, have created a situation where the American and European, Indian and other Asian, Latin American, African views of the free world are being challenged.

American Bar Association officials now think that mandatory standardized tests such as the Law School Admission Test can deter law schools from using innovative ways to evaluate candidates for admission. Only one out of 21 members of ABA's accrediting council voted against removing mandatory tests such as LSAT or GRE to enter law school in the US. To attract people of diverse backgrounds is now considered important and many ways can be adopted to evaluate candidates without standardizing the process. Could Abraham Lincoln have done well on a standardized law school test? Could leadership qualities needed for the US to meet a new set of challenges be missed by standardizing processes and tests that produce the same type of candidate, and eliminate anything that does not conform to the set uniformity?
