The Obama administration proposes new legislation that would require derivatives to be traded on exchangesor clearinghouses and backed by capital reserves, similiar to the capital cushions required for banks in case of a default. See the link to law Prof. Portnoy saying that these derivative regulation efforts have been diluted by lobbying from the finanical industry. The current proposal does not have the same rules for all derivatives, and leaves the CFTC with aleading role in regulation, some of the same weaknesses that plagued earlier efforts to regulate derivatives.

The firing of John Bolton as National Security Adviser opens up the possibility of a meeting of Trump with President Rouhani of Iran. There is a need for both sides to begin talks on a nuclear deal that would replace the one Iran signed with president Obama to address issues raised by Mr. Trump and Republicans. Iran and countries that buy oil from Iran such as India, China and Japan have an interest in relief from sanctions imposed by the Trump administration on imports of Iranian oil. The European Union is keen to preserve aspects of the nuclear deal. Relief from sanctions is critical for Iran to develop its economy. The last two decades have seen Iran struggle to develop its economy with the sanctions imposed by  different U.S. administrations.   President Trump expressed flexibility on sanctions saying "we will see what happens. I think Iran has potential. They are incredible people." President Rouhani urged Mr. Trump "to put warmongers aside." Mr. Trump told reporters that he had resisted Mr. Bolton's opinions on issues and realized he had moderate views when compared to someone like Bolton.  Trump told Iran "We are not looking for regime change. We hope we can make a deal and if we can't make a deal thats fine too. But I think they have to make a deal." Helping the U.S. and Iran come to talks is president Macron of France who hopes to setup a meeting at the UN General Assembly which meets next week following his efforts at the G-7 meeting in France last month. In the past when tensions were high in the Straits of Hormuz President Trump refrained from aggravating this by saying actions that are "disproportionate" should not be taken and respected Iranian intentions. The tone of the conversation between the two sides has moderated to the point where both sides realize the need for coming to some compromise. This is in sharp contrast to the period a few months ago with rising tensions in the Straits of Hormuz and the seizure of an Iranian ship. Bolton's opinions were not the only issue for president Trump. He was also seen as the source of leaks including one that said Mike Pence, the Vice President, had opposed Mr. Trump's plan to bring the Taliban to Camp David. Also contributing to the new climate for talks is Mike Pompeo the Secretary of State, who has promoted the idea of talks with Iran. He told the media about such a meeting at the UN General Assembly in New York- "Sure. The president has made it very clear that he is prepared to meet with no pre-conditions." The willingness to try new ideas even contrary ones to policy pursued only a short while ago as long as the desired goal is reached is a feature of this presidency and key advisers. From the beginning of the Trump administration there is a firm sense of the need to end the wars in Afghanistan and Iraq. and reduce foreign entanglements that have dragged on wasting resources and destroying priorities. With a willingness to try all sorts of approaches even ones that appear to be contradictory always keeping the end goal in sight. ...

A comprehensive study on immigration's impact on the U.S. by the National Academies of Sciences, Engineering and Medicine in 2016, looks at the broad fiscal and economic impacts of immigration. On the drawbacks the new immigrants can lead to lower wages for earlier waves of immigrants and high school dropouts. It can also burden government finances, education budgets at local and state levels. On the plus side it leads to more innovation, entrepreneurship and technological change in the economy. Other facts that are new in the report and run against the popular narrative are that 53% of immigrants had at least some college, including 16% with graduate education, as of 2012- which explains the technological impact of being open to immigrants. It is this that helps lift overall growth says the report- "the prospects for long run economic growth in the United States would be considerably dimmed without the contributions of high-skilled immigrants." About 42.3 million immigrants live in the U.S. in 2014, 13% of the population, increasing from 24.5 million or 9% in 1995. Unauthorized immigrants doubled in this period to 11 million.  A surprising result considering the popular idea of anti-immigrant sentiment in the U.S. is that a WSJ/NBC poll shows 54% of respondents saying immigration helps more than it hurts. In 2006 only 45% to 42%, considered immigration as beneficial to the country. Immigration is an issue today even though in recent years the large scale deportations under the Obama administration and difficulty finding jobs have reduced the flow of immigrants - since 2009 about 300,000-400,000 new unauthorized immigrants arriving and similar number leaving.   ...

A lot that is wrong at Apple and Tim Cook's responsibility for putting profits over national interest in not preserving but destroying American manufacturing. All the talk about design is a smokescreen for dismally letting down American communities that relied on American industrial ingenuity. Tim Cook started the process of sending America's industrial manufacturing base to China in 1998 with an elaborate plan that has been put into effect over 2 decades. Some of this I saw with my own eyes in the period just before Jobs returned in 1997, on a trip as Japanese manufacturing methods consultant at Apple's Colorado Springs Plant. Apple's failure since 2016 to correct this overconcentration of manufacturing in one place is one of the major failures for America in the first decades of the 21st century. Apple's success in profit margins was bought at a price that is too high for the communities and towns that depended on manufacturing across America during the 20th century- it has a spiralling effect as other companies followed Apple leading to the shipping out of America's entire industrial base. Creating risks of international conflict as this entire process was allowed to happen by administrations of Bush and Obama that have failed America in unimaginable ways with foreign wars, and neglect of American workers. DJT, Biden who retained DJT policy, and DJT second term are only now correcting these serious mistakes and American business shortsightedness. ...

Assistant U.S. Attorney at the Fresno office, Richard Elias, spots a JP Morgan Chase bank memo in 2012 after looking at many documents. This starts the process leading to the large settlements of $37 billion with U.S. banks in 2014. The memo used words such as "fallout," "kick" and other words clearly showing the banks were aware of the serious risks associated with the securities and the fallout expected. By 2012 the Obama administration felt the pressure from Democrats in Congress to show results in prosecution of banks for schemes related to packaging of highly risky mortgages into securities that led to the 2008 financial crisis. The Justice Department senior staff, Mr. West and Mr. Cole decided to focus on this incriminating evidence for JP Morgan Chase, Bank of America and Citigroup. Most of 2013 was used for preparation of the cases against the bank which were prosecuted using the Financial Institutions Recovery, Reform and Enforcement Act of 1989. Firrea has provisions not contained in other legislation, to get huge settlements as penalties, with extended time period for enforcement, when damage was done to financial institutions. The resulting effort led by Attorney General Holder led to the largest part of the total $128 billion paid in settlements by U.S. banks for cases related to the 2008 financial crisis....

 Harris's role for the Border was limited to telling Central American migrants to stay home. Much of the migration was a result of wars started in the Reagan years in Central American states of Nicaragua and San Salvador. This destabilized the region and led to gangs taking over parts of the country in San Salvador and entrenching Castro style regime in Nicaragua, leading to outward migration of young people. As this report points out Harris was supposed to take on decades of such misguided policies in Central America in a few months. A drought hit agricultural coffee regions of Guatemala increasing migration. Her role instead was to ensure several wins. Win No.1 to generate stability setting up the peaceful transfer of power in Guatemala, singling out corrupt regimes. Win No. 2 to generate jobs. US AID and IFDC loans were increased, foreign investment attracted to generate 250,000 jobs. Win No. 3 the increased stability led to gradually declining migration from Central America. What replaced it was Venezuela. And that is a repeat story of Reagan style wars in Central America. Under the Trump Administration the US did not take up the Monroe Doctrine and act directly to support a stable fairly elected government in Venezuela, an obvious solution. Instead going half way- destabilizing the government but then left it on its own. The result about a third of the population leaving the country in these years to Colombia and other parts of Latin America in a immense humanitarian tragedy.  In 2023 Venezuelans not Guatemalans entered at the US Border in large numbers, most of them middle class families that left Venezuela after hyperinflation and mismanagement of the economy. Realizing the danger by January 2024 Biden negotiated with Senate Minority Leader McConnell and his Republican representative Senator Lankford to pass legislation in the Senate closing the Border. All that was needed was the House to act and 30 years of Border problem would be solved.This was blocked in the House by new Speaker Mike Johnson on advice from former president Trump who chose to use the issue in the 2024 election. Biden then used his executive powers to close the Border leading to lower numbers of migrants under Biden by July 2024 than under Trump. Migration Border Czar was never a term used by Democrats in the Obama and Biden years. Biden who also served in a role given migration as one of the issues to handle under Obama, had this as only one of his assignments. Biden played more important roles in foreign policy with his experience as chairman of the Senate Foreign Relations Committee for decades. Border policy was made by president Obama and his advisers. The same is true of Harris, Border policy being done by president Biden and his advisers. Similar to Biden's role as VP Harris was given assignment to cover foreign policy and was the US representative at 3 Munich Security Conferences in 2021-2024 following the Russian invasion of Ukraine. Chancellor Scholz of Germany said of Harris last week that he had full confidence in Harris as both competent and experienced. ...

Leon Panetta, former Defense Secretary in Obama's first term, and president Clinton's chief of staff, says president Obama made a series of poor decisions for Iraq and Syria. Not following up on the "red line" of use of chemical weapons by the Assad regime has damaged U.S. credibility, says Panetta. The failure to lead in budget fights, on health care, is seen in foreign policy for Iraq. There Panetta points out Obama failed to lead to ensure that Maliki had to agree to a residual troop presence in Iraq, for without this the hard won gains under the previous Republican administration could easily be allowed to slip away. Sectarian tensions, and rise of ISIS could have been controlled by having U.S. troop presence, according to Panetta. White House centralized power under Tom Donilon, chief of staff, and John Brennan, counter terrorism advisor, to th detriment of input from the Defense Secretary and the Secretary of State, says Panetta. Panetta says Obama lacks fire and too often does not take the lead as a president should. A similiar complaint is made by Washington Post journalist Bob Woodward, who covered Nixon and Watergate, after observing Obama's dealings with the Republicans and Congress up close in the first term....

The efforts of Senator Kyl to get committments of $4.1 billion in missile defense and nuclear warhead modernization from the Obama administration. This WSJ editorial sees the New START treaty with Russia as a footnote to the Cold War years, which does not confront the real world of today with nuclear proliferation to Iran, N. Korea and other states. It says this dangerous world requires not the largely irrelevant efforts of New Start, but more serious antiproliferation strategies and efforts. Loretta Lynch, U.S. attorney for the Eastern District of New York, is likely to become the next Attorney General of the U.S. This is the first time since President Monroe in 1817 that a top prosecutor was directly appointed as Attorney General. She was first nominated in 1999 as U.S. attorney in the Clinton administration, and returned to this office in 2010. She does not have any ties to president Obama. This should help speed up the nomination. Her long experience as a prosecutor, her experience with civil rights and terrorism related cases, and her openness, are cited as key qualifications.

Harold Thibault of Le Monde France says, the rise of China in the past 50 years means the US is wondering whether engaging China turned out be something different than what Clinton anticipated when letting China join WTO without strict rules for a level playing field, and the Bush- Obama years when nothing was done to protect American manufacturing in small towns across America from the ravages of so called "free trade" that was not free, and the effort of American business to integrate its operations with China as single supplier without any guidance from government, behaviour that started with "American triumphalism" of the 1970's and 1990's, that left America with a destroyed industrial base. Tax cuts initiated by the Bush administration and to a smaller degree by the Obama administration account for $6.3 trillon of the $10 trillion deficit in 2011. This is about half the $12.7 trillion gap between the $2.3 trillion surplus predicted by the CBO a decade ago for the year 2011 and the current deficit of $10.4 trillon. Two wars and higher defense spending add another $2 trillion. The Stimulus added $700 billon. The Prescription Drug Benefit for seniors $272 billion. This is based on new analysis of CBO data by the Pew Fiscal Analysis Initiative. The record shows unrestrained spending by both parties has led to the current mess. Pete Domenici who chaired the Senate Budget Committee at the time of the first tax cuts in 2001 says "in the end the floodgates were opened." This also shows how quickly the situation can change if sound fiscal practices are abandoned. Two wars were financed entirely with borrowed money for the first time in U.S. history.

As many as 2 million votes in the 2014 Afghanistan elections are called into question. This is 2 million out of a total of 8 million. In the last election it is estimated 1.3 million fradulent votes were made for Hamid Karzai. This time it is said security officials, government officials and others worked together to get as many as 2 million votes for Asraf Ghani, who Karzai supports. This is happening even as the Taliban are increasing attacks in the country and the Americans are withdrawing. It shows that instead of a withdrawal that the Obama administration promised their appears to be a situation that is no different from that of the Bush administration, where American lives were lost and sacrifices made without even the most basic results- no assurance that if the government collapses from strains within and outside, Taliban and terrorism could not happen again as is hapening in Iraq.

Robert Lighthizer, was deputy trade representative for the Reagan administration. He says, trade is one area in which the establishment has simply got it wrong. In this area there is little difference between George Bush, Bill Clinton, Obama and Republican politicians. It is one area, he says, where the feeling that elites are thwarting the will of the voters resonates most. He says the talk about America's decline, and the idea that the 21st century belongs to China, leaves voters unconvinced that our trade policy is working for America. For voters who are unconvinced, it makes sense to have a nationalist trade policy that takes on foreign abuses and fights for American interests. He cites 2 statistics that worry these voters. One is the huge trade imbalances that require the USA to sell hundreds of billions of dollars in assets each year. The value of foreign investments in the USA exceeds the value of American investments abroad by $2.74 trillion, and China by itself has $2.5 trillion in foreign currency reserves, mostly in dollars. The other fact is that while the trade deficit for the last decade was about $4.3 trillion for the last decade, America also lost 5.6 millon jobs. And its becoming increasingly clear that as with managed currencies such as the Chinese yuan, and other trade practices, the rest of the world is stacking the free-trade deck against us. ...

Republicans have supported less regulation. After the 2009 financial crisis with faulty mortgages and excessive leveraging one would expect that there would be a shift among Republicans favoring necessary regulation of banks. This did not happen after the Obama administration failed to articulate a new culture after 2009 and lost control of Congress in 2010 by as much as 64 seats in the House 6 in the Senate, and in all demographic and income groups. The result was that the 2009 crisis changed some laws but not the culture of laissez faire that less regulation was better for the economy. It is left to president Biden to tackle this problem of culture and the Silicon Valley Bank clearly shows that the parts of the Republican and Democratic parties that support less regulation even where the regulation is essential for a good economy for workers and families, are self serving. No where is this culture of laissez fairre in its other manifestation in not planning for the US manufacturing base to be strengthened by government action more evident than in the way it has prevailed to turn a blind eye to not just sending manufacturing overseas, but over concentrating it in one country China with additional supply base from Japan into China. This is the challenge that the country faces- only if the culture or mindset changes will laws have the needed impact.  This report in the NYT shows that when president Trump appointed Randall Quarles to vice chair of banking supervision in 2017, Congressmen both Republicans and Democrats believed that less supervision was better for the economy. Democrats such as Congressmen Barney Frank were themselves part of the new culture when Frank joined Signature Bank's board in 2015, one of the banks that along with SVB bank caused the banking crisis of 2023. Its association with risky crypto assets is considered by the WSJ as being one reason the government decided to close it. Frank did not see this aspect of its risk insisting that the bank was in sound condition.  This culture is also manifested in its approach to the cost of living crisis and support for workers and families. The Biden administration sees the problem of culture and of clearly making the changes that create a new culture, and a new understanding of what is right for America, for its economy and for its role in the world, and best for its people.   ...

Professors Cole and Ohanian of the University of Pennsylvania and UCLA, provide a new interpretation of FDR's economic policies during the period 1932-1934 and the period 1937-1941, based on their research. This suggests conclusions different from that of Obama advisor, Christina Romer, and Fed chairman, Bernanke about that period. Changes in economic policies under the Roosevelt administration that helped bring wages in line with productivity, reduced strikes, and gradual elimination of the undistributed profits tax, improved incentives for business investment during 1938-1939. Cole and Ohanian, say that by 1941, before the U.S. entered the war, close to half of the increase in nonmilitary hours worked in the U.S. between 1939 and the peak of the war, had already been achieved. And this was primarily the result of the changes in FDR's policies in 1938. They say a similiar opportunity is presented by the proposals of the Bowles-Simpson commission on deficit reduction, by lowering the corporate income tax through simplification of the tax code and reducing or eliminating most tax expenditures. Improving the incentives for business to hire and invest through this and other steps is likely to do more for the economy than the steps tried so far since 2009....

Trade is just one aspect of the Biden Economic plan. It covers US manufacturing and jobs, Climate Change Action and Renewable Energy, Cost of Living and Wages for workers, Interest rates and inflation, and Capital Allocation with government partnering with the private sector in key industries such as electric cars, solar panels. It has the overwhelming support of most Americans- seven out of 10 Americans favor it polls show. What is described here in the Washington Post as a change from decades of trade policy since Reagan/Bush, Clinton/Obama, is also a response to the loss of key midwestern states by Democrats to Trump in thepresidential election of 2016, and the upheavals for democracy that Biden calls the struggle for the soul of the nation on the White House website. Biden is simply saying that the old policies were a mistake, a huge mistake, and Biden is correcting the Trump response which was loud but lacked the substance that is in the Biden plan through capital allocation in size and government actions to back this up. In this move he now has the support of both Democrats and Republicans. As Greg Ip has pointed out in the WSj no one during the Clinton administration when it engaged China with the World Trade Organization on trade imagined China would replace America as the dominant nation in manufacturing, the size and th scale also affected the climate, the environment in China, and created huge inequalities in the US and China that both nations are trying to correct, Biden in the US and Xi in China. It could even be said these policies were a failure because the size and scale simply overwhelmed everything else with growth rates in China of 12-14%, and the fallout in the near collapse of the economy in the years ahead from hypergrowth.  ...

Pearlstein argues that the US and the Obama administration achieved most of its goals, even though the Europeans took the credit. On regulatory reform, Geithner's regulatory reform proposal he says, could well have been written at the French Finance Ministry, as at the US Treasury. And it gives Obama ammunition to prepare, as private equity, hedge funds, and banks try to water down his proposals for regulatory reform. By having member countries commit to adding $850 billion to the resources at the IMF, and regional development banks to provide help to countries in serious difficulties- and giving instructions that the money can be used not only for debt rollover, bank recapitalization and balance of payments support, but also for stimulus spending, infrastructure investment, trade finance and social support- the Obama adminstration has accomplished a great deal. It has succeeded in putting in place the necessary financial resources to support not only the financial systems of countries in Eastern Europe, Asia and Latin America that need help, but put emphasis on the need for resources to go for helping reduce job losses, create jobs, and provide some forms of income or support to people in these countries. This is a major step as it means the countries of Eastern Europe and other developing countries can deal with their crises in confidence. Mexico is taking loans from the IMF. Dominique Strauss Kahn had begun the policy of shifting IMF's focus to these social goals as significant parts of the recovery process in countries, but he faced the old mindset among the IMF staff, as when its reported staff wanted to increase interest rates in Pakistan by 10% instead of the 3% that was finally agreed to. That would have caused serious difficulty to the people of Pakistan, created chaotic situation and disturbed the social fabric of that country. See the link to this for S. Korea and for Pakistan. And as Gordon Brown put it the old conditionality that lay behind the IMF loans, is phased out. This makes it the new policy at the IMF backed by the G20 mandate. The Washington consensus which prescribed open borders, floating exchange rates and fiscal prudence is now ended. 11 Pacific Rim nations form the Trans-Pacific Partnership in 2018. The Obama administration supported the trade pact alienating supporters in its union base particularly in the midwestern states. Mr. Trump opposed the TPP in his election campaign and made it a significant issue for swing voters in midwestern states after job losses in the auto industry. With the opposition of president Trump the U.S. decided to withdraw from TPP.  The 11 nations agreeing to join a revised agreement are Japan, Canada, Mexico, Australia, Brunei, Chile, Malaysia, New Zealand, Peru, Singapore and Vietnam. So far six countries have formally approved the deal, Australia, Canada, Mexico, Singapore, New Zealand and Japan, setting the stage for two rounds of tariff reductions starting December 30, 2018. Agricultural products duties will be duty free within 3 to 7 years including for Japan and Mexico. Australia, New Zealand, Canada are major agricultural exporters. Japan supported the deal as a way to counter China's influence in the region. In the U.S. the gains would be in intellectual property rights but losses for workers in the auto and manufacturing industries, a point Mr. Trump recognized in his election campaign as he campaigned in the midwestern states. Mr. Obama pursued TPP over objections of workers organizations and unions including auto workers union, with his advisors suggesting this as a way to counter China's influence in the region. By 2018 the Democratic party support base fractured on this as one of the major issues.   ...

The NYT editorial says sharks circle in Congress to kill the Obama plan for a new consumer protection agency with the necessary powers to protect consumers. Campaign contributions to members of Congress by the banking industry is having anegative effect. But says the NYT the federal regulators who put the interests of banks first are also having the negative effect. It cites the example of a Fed governor, Elizabeth Duke, who says the Fed has all the powers to protect consumers, in a Congressional hearing. Says NYT the Fed was given sweeping powers to prevent predatory lending in 1994, but did not issue new rules till July 2008, till the damage had alredy been done. And not just to consumers, but to the American and global economy. It goes on to say that consumer protection is the unwanted stepchild in the regulatory community as protecting consumer s is spread across 20 statutes and seven different agencies. Considering the damage to the economy that has already been done its amazing that the same tired old arguments can be repeated without severely straining credibility. The close relations between Geithner, Rahm Emmanuel Obama's chief of staff, and others in the administration with the banking industry do not bode well for coming up with the strong legislation to protect consumers. The meeting planned between Xi and Biden is important for stable US China relations after the Trump administration angry rhetoric, the Covid pandemic, and when imbalances in the poorly managed trade relationship with the entire supply chain shifted to China with millions of its American jobs has shaken working class communities in the US. China's and Xi's views on Hong Kong and Taiwan have also affected the relations. After the Ukraine war this will be the first meeting between the two leaders, and follows a visit by German chancellor Scholz to Beijing. Under Bush America appeared to be distracted by middle east wars, under Obama and Trump America appeared weak or angry but not resolute. Under Biden America appears resolute and sure of itself. This makes a difference for US China relations. Following the Ukraine war both the US and Germany, and China, appear to have grasped the dangers of nuclear threats such as were made in recent weeks. India has also shown its serious concerns about wars for territorial gains, and the world community of nations has expressed this through the words and actions of UN Secretary General Antonio Guterres speaking for Europe, and the rest of the world.  Under Biden America seeks decent Competition with China and not conflict, and this is in the interest of both countries and of all the countries in the world. Neither China or America represent the largest share of the world's peoples, and in a world of advanced technologies other regions such as India, Europe, South East Asia and Japan, have just as great a determination and influence to seek a mutually beneficial peaceful coexistence in the interests of all the peoples of the world including the continents of Africa and Latin America. ...

Former U.S. Defense Secretary Robert Gates points out in this intervew with Holman Jenkins of the WSJ, that Iraq's prime minister, Nouri al-Maliki, who worsened Shiite-Sunni relations, was the principal cause of the unraveling that happened in Iraq during the first term of U.S. president Obama. He says President Obama failed to do what was done by president Bush to persist and obtain Status of Forces Agreement with Iraq, to maintain a U.S. foce presence in Iraq. Presence of U.S. forces would have prevented the spread of Islamic State in Iraq and Syria. U.S. force presence would have provided a more even handed treatment of Sunnis in the region, creating the conditions for peace by having Sunnis, Kurds and Shiites continue talks about the future of Iraq. Gates grew up in Kansas in the 1950's, attended the College of William and Mary for undergraduate studies, studied Russian and Soviet history in grad school at Indiana University and Georgetown University, before joining the CIA. Gates was selected by Brzezinski to work in the White House, worked under Brent Snowcroft, and as head of the CIA (1991-1993) during the elder Bush administration. He was Secretary of Defense from 2006-2011, under presidents George Bush and Barack Obama, succeeding Donald Rumsfeld. He was succeeded by Leon Panetta, Chuck Hagel, and Ashton Carter. ...

The failure of the Obama administration to negotiate a trade treaty with South Korea during the G-20 talks in Seoul. The lack of efforts to lay the groundwork for such a treaty in the last 2 years. Valuable political energy lost in defending the Fed's move and calling for the 4% of GDP limit to surpluses. Result is a loss of American leadership for the first time at a summit conference of world leaders.

This editorial in the New York Times says the 'comfort women' agreement is a positive step, and that it was done with pressure from the Obama administration so that Japan and South Korea can do more to tackle North Korean nuclear weapons development. However as Soble and Choe Sang-Hun in the NYT point out in their report from South Korea, the primary goal of the agreement which should have been to generate goodwill has not been reached.
