This has happened in the case of Iran where the US has gained so little and lost so much in lives and resources sunk in the ensuing was in Syria, Iraq, Kuwait, Afghanistan, Yemen. The European Union suffered from the huge migrant flow from Syria with splits in its ranks. The distractions of these 30 years through Reagan and Rumsfeld who supported Hussein in Iraq against Iran in a balancing act is now foolishness, of elder Bush as he diverted attention to a long desert war in Kuwait, of Bush and then Obama in Afghanistan, who wasted enormous resources and impoverished the American people. Leaving legacy wars for Trump and Biden to handle. After Vietnam another failed chapter of Iran in the US for the American people by incompetent leaders who were taken in by French and British colonial and oil interests in wrong directions.   ...

Sheila Bair, former head of the U.S. FDIC, points out flaws in the rules for capital adequacy ratios and risk weighted assets which allow banks to increase their capital adequacy ratios. The ratios show the financial strength of the banks and their ability to absorb losses, which makes their accurate calculation very important for the safety of the U.S. banking system, especially with large "too big to fail" banks. Bair says the 2013 U.S. Fed stress tests showed Bank of America as having a capital adequacy ratio of 11.4%, when it should actually be 7.8% without the risk weighted adjustment. The mortgage banking crisis showed how the risk wieighting can be flawed and give a distorted representation of the acutal risks facing the banks in its assets. For Morgan Stanley the 2013 stress tess by the U.S. Fed showed the capital adequacy ratio at 14%, taking out the risk weighting adjustment this drops to 7%. Bair says its not the idea of risk weighting that is the problem, but the way it is applied- for example considering sovereign government bonds in the eurozone as zero risk, or that only 20% of the accounting value of debt one banks buys from another bank is to be taken into account in setting the ratio. Go back to the drawing board she says, it makes no sense that Citibank debt be shown as having one fifth risk of IBM's. ...

How the nations private investors, private equity funds and funds that are backed by public pension funds, could acting as vulture investors, become part of the solution to taking bad assets off the banks that have them. The first step is forming apublic private partnership and White House advisor Summers has already met with private equity managers about this. Again these investors are in for making atidy profit so the government would have to pick up alarge part of the tab. In the case of IndyMac private investors paid $13.9 billion but only took responsibility for 20% of the losses the government picked up the rest of the losses. Theo Lubke was head of the Financial Infrastructure Department in the Banking Supervision Group, and was a key member working for reforms in the derivatives market. He oversaw efforts at the Fed to have Wall Street centrally clear trades in credit default swaps, which helps control the risk of a firm's failure. Lubke will join Goldman Sachs as a managing director in the securities division, and will help Goldman implement the facets of regulatory reform legislation. Prior to his 15 years at the New York Fed, Lubke worked on the staff of the National Economic Council under President Clinton, and worked as an investment-banking analyst at Lehman Brothers.

This editorial in the Economist looks at China's relationship with Russia. It says the Ukraine conflict and western sanctions have resulted in Russia moving closer to China. Yet the two countries have competing interests in central Asia, and different relations with India and Vietnam, in the Asian region. Russia is also wary of China copying designs of Sukhoi aircraft in sales to China of advanced military technology. The major oil and gas deal signed in 2014 provides Russia with a new outlet for oil and gas with the cooling of the relationship with Europe. Yet Russia has strong ties built with Germany over the entire post war period, and differences have emerged in U.S.- German relations. Germany's relationship with Russia- cooled by sanctions and German wariness over Russian intervention in Ukraine and Russian wariness over NATO close to its borders- spans 7 decades and is likely to remain strong in the long term. This comes from the shared sense of awareness of the terrible conflicts of an earlier period, just as it has for French-German relations, and from the strong efforts made by Germany to preserve the relationship and peace in Europe. Chinese president Xi's visit to Moscow on May 9, for celebrations of victory over Nazi Germany, will be followed by a visit May 10 by Chancellor Merkel of Germany. A factor in German-Russian relations is the close trade links, cultural exchanges, and history going back to the GDR where Chancellor Merkel is from, built up over many years, that are likely to set the long term future of relations. China's dominant partner relationship in the China- Russia relations does not bode well for the future of relations, compared to the equal partner relations with its European neighbor, Germany. In this different light Ukraine is a temporary pause, in German-Russian relations and peace in Europe, a situation which is in China's long term interest as it focusses on its economy and the next phase of development for a modernized economy. Especially as China continues to build on its own vital trade relations with Germany and the European Union, the latest example being Germany, other EU nations, and India, joining the China sponsored Asian Infrastructure Investment Bank. ...

Otis Elevator is moving a plant based in Nogales, Mexico, back to the U.S. This plant was moved to Mexico in 1998 for cost reasons. Now Otis CEO, Didier Michaud-Daniel, says producing at a new South Carolina plant will cost less than Mexico. Logistics and freight costs are 17.3% less in the U.S. than Mexico, and an additional 20% in savings come from "efficiencies" gained by having all its white collar workers associated with elevator design and production. Most companies that manufacture in China and Mexico keep their design and engineering jobs in the the U.S. It is not clear to what extent American companies have considered all the costs of separating design and engineering from manufacturing, including the opportunities for close cooperation possible in one location that are lost when everything is so spread out. At Otis toolmakers in Dallas and engineers and designers located in Indiana and Arizona traveled to the Nogales, Mexico plant. This can be especially important when as in Otis's case the new plant in Florence, South Carolina, plans the launch of a new generation of elevator designs. In this case there is an added benefit by making it easier for customers to visit the plant and look at the product. The new plant will have more automation and use fewer workers on the factory floor. The new factory will employ 360 workers including white collar workers, the same as the Nogales, Mexico, plant with a lower number of factory floor workers. ...

Automakers stand to lose a lot of money on their leased SUV's. Spinella, President of CNW Marketing Research estimates they could lose $4.7 billion in 2008, with losses extending into 2009 and 2010 which could cost them additional $10 billion. Why? Because many of these SUV's leased for as long as 39 months are on the road and automakers only recently started writing fewer leases, and as thes SUV's come back to the car lots they are marked way down. Automakers did not anticipate such a large markdown. According to Mannheim, the USA's largest vehicle wholesaler, between March an May the resale values of large SUV's have fallen 13%, with some pickups down 20%, as a result of $4 a gallon gasoline. Knowing the drop in resale values more lease holders are reluctant to buy or to extend their leases. Over the next 18 months GM will lose $600 million in lease related costs, and Ford will lose $1 billion, according to Chase analyst Himanshu Patel. According to Brian Johnson, Lehman Brothers analyst, GM's lending arm will lose $1.1 billion and Ford's $1.5 billion, GM's losses lower because GMAC is owned 51% by Cerberus Capital. Not just the American automakers, BMW took a charge of $400 million for losses in the first quarter on sales of off-lease SUV's and cars. ...

Speaking at a banking conference, advisors including the head of Russia's largest retail bank Sberbank, German Gref, minister of the economy, Aleksei Ulyukayev, and head of the central bank , Elvira Nabiullina, express deep concern about the economic prospects in 2015. Foreign investment is down from about $90 billion in the 1st quarter of 2013 to a negligible amount in the 3rd quarter of 2014. Capital outflows following the Ukraine crisis are estimated at about $110 billion by former finance minister Alexsei Kudrin. The ruble dropped to its lowest level against the dollar since the 1990's. And the sharp decline in oil prices with Brent crude at about $90 is another risk factor as 50% of the budget comes from oil and gas revenues and 60% of exports are still oil and gas, with no serious or effective effort to diversify under the Putin adminstration. Putin told the banking conference that a deficit free budget and reserves of $460 billion are "fundamental factors supporting stability." Advisors and leading bankers remain unconvinced. The problem is that even at the beginning of 2014 before the Ukraine crisis foreign investment had slowed to a trickle, similiar to what India experienced in 2013. The central bank head says her effort to open up the bond markets in Russia to foreign investors is now in vain because there are few foreign investors. Instead of reversing the situation as is happening in India with the new Modi administration, policy under Putin and the Ukraine conflict may have scared investors away with the increasing western sanctions and stagflation (estimated 8% inflation and about 0.5% growth in 2014). The head of Sberbank Mr. Gref told the banking conference- "The Soviet Union broke apart because of the mind boggling incompetence of the Soviet leadership. They did not respect the laws of economic development." The problem with sovereign reserves is that it can protect a sovereign currency such the Russian ruble or the Brazilian cruzeiro to some extent, but today's vibrant economies need foreign investment and foreign technology for growth. Even a country such as China with a trillion dollars in reserves needs the reserves in its special case because of its billion plus aging population, and is no exception to these laws of economic development about the need for foreign technology and foreign investment. ...

Textualism or strict interpretation of the Constitution word for word may be back but one can never be sure. No sooner is one decision made in a certain direction with a particular approach to the law whether it be textualism or something else it then comes up for rethinking a few years later, under a different approach to the law or from a new angle. This is the law practiced in most British style courts of law including the US.  Former Justice Breyer of the US Supreme Court replaced by his law clerk Ketanji Jackson, is interviewed by NYT's Adam Liptak. Today so much is written about Breyer as a non textualist, and Gorsuch, Kavanaugh recent additions to the Court as textualist or strict interpreters of the Constitution based on when it was written with what intent. Yet as thinking individuals who like the rest of the American people grow in their understanding all Justices cannot be categorized  in this way. Breyer says he worked with retired Justices Kennedy and Souter and found them to be willing and keen on hearing all angles. Then it has to be said that both Kavanaugh and Gorsuch were law clerks for Kennedy. Much of American law at the highest court actually is no better than any other human creation - it tries to approximate as best one can the people of the US. Sotomayor coming from Puerto Rican descent, Ketanji Jackson from minority black, Kavanaugh and Gorsuch from Georgetown preparatory schools where Kavanaugh's paternal grandfather attended Yale something even JFK could not claim, Chief Justice Roberts coming from a company professional type background, Barrett a professor at a Catholic university, Kagan with a Bostonian JFK style background, Alito old Italian and Clarence old minority black background. Breyer retired recently to make way for a younger judge, Judge Ketanji Jackson who was law clerk to Breyer. Breyer is writing a new book which he hopes the conservatives on the Supreme Court will read- Justices Kavanaugh, Barrett and Gorsuch. The book coming out March 26 has the title- Reading the Constitution- Why I Chose Pragmatism not Textualism. He hope these Justices will read the book and say their colleague was making sense, would say that it was not a bad point. ...

The issue says the New York Times is whether the financial meltdown was caused by one of these frequent crises of capitalism as bankers would have us believe or was there malfeasance involved. This is its comment on the SEC filing civil charges against Goldman Sachs in the Abacus case in which Goldman helped Paulson put together a batch of bad mortgage securities into a security that it sold to its institutional clients, without disclosing what Paulson had done and without disclosing that Paulson had structured these securities precisely so that he could bet against them. As other financial houses are also involved in dealings of this type, the New York Times editorial says this will mean people at these firms will also not be sleeping well in the coming days and months. This is a story that Gretchen Morgenson and Louis Story of the New York Times wrote about for the first time several months back.

Advice on walking away from a home loan when you are way under water, and it makes no sense to keep writing checks, and when government help is not there as you are way under water. Martin Feldstein had warned abut this as a major cause of rising foreclosures from early last year. Now without government help this looks like a rising tide for many homeowners under water. This financial planner says its feasible, and may make sense. He talks to the Mortgage Bankers Association, and a spokesman there tells him that its cost prohibitive for a bank to chase down a borrower in financial difficulty. And some states have laws that prohibit banks from going after borrowers for the remainder after foreclosure, including California and Arizona, two of the worst affected. And a lawyer arranging the foreclosure, can put in writing a waiver for this. For the tax impact, he says recent laws eliminate a federal tax through 2012 on most primary resident debt that a lender has reduced through loan restructuring, or forgiven through foreclosure. And states like California and Arizona have passed laws echoing these federal rules. Then there is the question of credit. Yes, its impaired for about 7 years. But with so many in foreclosure there may be an effort by credit unions and financial institutions to destigmatize borrowers who have foreclosed. A law Professor at George Mason University says credit scores will have to be adjusted to lessen the impact of a foreclosure, as this does not carry the information value in 2009 that it would say in 2005. And with so many people in foreclosure there is an emerging market here, according to credit union lender BECU in Washington state. If other than foreclosure you have good credit, its not going to be a big issue, says the director of the Rental Property Owners of Michigan, especially as good tenants are not that easy to find in this difficult economic environment anyway. What this suggests is that many will take this option and foreclosures will rise for the rest of 2009, especially if the job losses go on for longer in the range of 400,000 to 600,000 that we have seen for the last 4 months. Changes in the bankruptcy laws and restructuring the loans on that basis, or government help to those under water in some future plan that lowers payments to something in the range of 30-40%, are ways in which this can be averted. But with job losses of this magnitude a lot of people would end up in serious difficulty, and consider the foreclosure option....

The IMF extends $100 billion in loans to countries that have healthy economies but need temporary help, such as S.Korea, Brazil, Mexco and Singapore. Some of these countries have borrowed heavily in other currencies and the drop in the value of their own currencies makes repayment difficult. No strings such as requirements to raise interest rates and to cut public spending are attached to this program. Under this program countries could borrow five times the amount they are normally entitled to, $25 billion in Brazil's case, without the strict conditions that normally accompany such loans. Nobel Prize winner Stiglitz was chief economist at the World Bank. He said the funds use of the words restore confidence itself could make a lot of countries nervous. That is because in the Asian and Latin American crises in the past, the IMF set strict conditions to increase interest rates and cut public spending and food subsidies at a time when the poor especially and the rest of the people, all needed help, thereby increasing public distress. In the developed countries stimulus packages and infrastructure spending goes up to support employment and incomes, but the IMF has advocated quite the reverse in the case of the developing countries, with the US Treasury a key factor in IMF support and ideology. Which is why countries in Asia like South Korea see a stigma attached to the IMF and are refusing IMF help. In Pakistan also the IMF support is a last resort or Plan C. Iceland for instance raised rates in return for IMF help from 6% to 18% to try to stabilize the currency. The IMF was created as part of the Bretton Woods agreement of 1944 when the Allied Powers USA and Britain and other countries that sent representatives met in New Hampshire for a postwar economic system. Japan, S. Korea, India and China and many other countries were not part of it because of the war or colonial empires....

A report by the Bank of England suggests a more prudent approach for British banks by setting aside more reserves for losses on bad loans from past decisions. Mervyn King, Governor of the Bank of England, says the Financial Services Authority should talk to banks and tell them to look "more prudently" at their credit levels. King says current capital ratios do not provide a correct picture of the health of the banks. The report says capital ratios of Barclay's, RBS, Lloyds, and HSBC could be overstated by between 5 billion or 8 billion and 35 billion pounds. The goal King says is to restore confidence in Britain's banking system with a prudent approach.

Living wills of BNP Paribas SA, HSBC Holdings PLC and Royal Bank of Scotland Group PLC come under increased scrutiny from the U.S. Fed. These banks were added to 11 U.S. banks required to submit new drafts of "living wills" by the end of 2015, which ensure no damage to the U.S. economic system from a bank collapse. Only Wells Fargo & Co.'s "living will" was accepted by regulators as not causing economic damage. In making the decision the Fed and the FDIC agreed that the "living wills" were "not credible."

This editorial in the Economist magazine says the banks have paid large fines for wrongdoing but individual accountability has not been achieved. Only one individual conviction has been achieved related to market rigging in Britain. The penalties paid by banks between 2009 to 2014 worldwide add up to $245 billion, according to CCP, a research group. The problem says the editorial is that without individual accountability this is likely to be seen just as a cost of doing business. For the culture at banks to change individual acountability has to be established, and only now are banking regulators realizing that the public's disillusionment with the political parties in power during the last decade in Europe and the U.S. has its roots also in the way accountability has been tackled. Editorials in the WSJ and the NYT have addressed the same theme and expressed the same concern. The May 21, 2014 editorial on the U.S. Justice Department's legal settlement with Credit Suisse. "Holder convicts Switzerland," was critical of the Justice Department because this settlement did not bring accountability or justice. Columnists Eavis and Reilly in the WSJ, Protess and Greenberg in the NYT, were also critical of the settlement. Other legal settlements followed the same pattern throughout 2012-2015. Another aspect of this and a larger problem is that the same management has remained in place in some places. Shareholders expressed their feelings at the recent Deutsche Bank meeting in June 2015 when one shareholder association asked the question: "Mr. Jain are you the solution to the problem or part of it?" questioning how the same management that created the problems was going to fix the problems. A week later the two co-CEO's departure was announced and a new CEO appointed. BaFin, Germany's regulatory authority was described as not providing effective oversight on management at Deutsche Bank, by Eyk Henning in the WSJ March 28, 2014. It is too early to say if the public's frustration with the slow pace of establishing accountability and generating culture change is at long last registering with regulators and the political parties running the government. Prime minister Cameron and chancellor George Osborne's decision to put $1 billion into communities throughout Britain from the fines, described in the WSJ May 31, 2015, and an additional $227 million pounds from a legal settlement with Deutsche Bank in April 2015 for creating 50,000 apprenticeships, is the first sign of a conviction developing in political parties that instincts of fairness and the compact between the people and their government handed down over many, many years and generations, need to be respected. In the U.S. communities devastated by the recession and foreclosure crisis, especially inner cities, could benefit from Cameron and Osborne's exceptional idea. For the political parties and the political elites in Europe and the U.S. it is a way to restore some of the trust lost in the last decade. For banks a change of management, cultural change, will benefit the employees and shareholders, and improve relationships with customers, restoring trust over the next decade....

Even as huge losses continued at RBS bank bonuses remained high. After $15 billion in losses at RBS in 2013, banker bonuses were $960 million for the year. Banker bonuses declined from 679 million pounds in 2012 to 576 billion pounds in 2013. New CEO Ross McEwan, says "I need to keep people engaged." He announced another reorganization. He says RBS "is the least trusted company in the least trusted sector of the economy." This follows public criticism of RBS for not lending enough to small business and unfair treatment of customers. The new plan is for cost cuts to save 2.2 billion pounds by closing 16 corporate call centers and 11 offices in London. Sales and restructuring cuts are planned for 3.1 billion pounds in savings.
