The Opinion given by the US Supreme Court shows the thinking behind its decision to call Affirmative Action or race based admissions by colleges unconstitutional, as violating the Fourteenth Amendment Equal Protection Clause. Because the respondents (Harvard College) use of race involves stereotyping and negative criteria the Court declared it invalidated. "It unduly harms non-minority interests," not permissible when all citizens are equal regardless of race or color. Proposed by Congress and ratified by the States the Fourteenth Amendment provides that no State shall "deny to any person.... the equal protection of the laws." Proponents of that law describing as the "foundational principle" as "not permitting any distinctions of law based on race or color." As WSJ shows today there are three times as many White as Black or Hispanic families in California making below $50,000 a year.  "That the law shall be the same for the black as well as the white, that all persons shall stand equal before the laws of the States." It was a blot on the face of America that this allowed racially segregated schools till this was changed, says the Supreme Court. It calls the Bakke decision to allow race based admissions as a deeply splintered decision and Judge Powell writing for himself allowed it only to allow the educational benefits that flow from a diverse student body. The decisions in Grutter stated that in 25 years this race based admissions should end and in no way can it be used for stereotyping or as a negative- to discriminate against those racial groups that were not the beneficiaries of the preference. A university's use of race could not be used to "unduly harm non-minority interests." It also means engaging in stereotyping- "a demeaning assumption that students of a particular race think alike."  ...

Much of the inflation reduction actions were taken by the US Federal Reserve as the central bank of the Nation and by president Biden in passing the Inflation Reduction Act and investing in growing the economy. All this may be jeopardized by the action of a Trump administration limiting the independence of the central bank. The support for crypto currency by Trump creates more risks to the economy. Additional risks are posed by the views expressed in Project 2025 on the US central bank. It is stated that the financial stability mandate be removed, that employment stability be removed and its regulatory role be effectively taken out. A commission to be appointed to look at alternatives to the central banking role of the US Fed. There are inflationary episodes and banking crises yet they stem from poor behaviour of banks as private players (2009 financial crisis) and price gouging by companies and firms and are not because of the central bank. There are also episodes of poor management  which reflected the culture of that period such as Libertarian culture under Greenspan. As in management in private industry firms good or poor managers make adifference. The institution created of the central bank around 1910 comes from the crises that happened in the period before that  and how it evolved into its postwar role. This includes the Great Depression when it did not have its regulatory, financial stability and employment role. Tampering with the basic structure that has evolved over 100 years of experience would cause lasting damage to the US economy and expose it to hidden risks. This would put a severe burden on the Nation after the loss of one million lives in the pandemic that just happened, the cost of living crisis, and the severe impact that decades of loss of local manufacturing have placed on communities across America- which both the US Federal Reserve under Jerome Powell and president Biden have fought so hard to tackle. ...

US Business has considerable apprehension about the former president in 2024 compared to its willingness to consider Trump in 2016. At the time executives from investment bank Goldman Sachs and heads of oil companies joined the Trump administration. This time US business and corporate interests are apprehensive about becoming the target of a tweet they might find the next morning under a Trump administration. They are not supportive of student loan forgiveness, but when it comes to the CHIPS and Science Act they see president Biden as effective and helping industry. Business leaders have a negative view on the Trump effort through appointment of 3 Supreme Court Justices of overturning decades old rights of women on abortion, and on this issue alone many will support Harris-Walz, overriding other concerns they might have. The visions of Harris and Trump are so vastly different with one calling climate change a hoax and hyping up social issues and infrastructure needs without any record of delivery when in office, and the other a strong position on climate change, wages and income, delivering on infrastructure and CHIPS that US Business. The result is that it leaves US Business with no better option in 2024 than to support the vision  that takes America forward. There are different sections of the business community which have different priorities.  Silicon Valley, and oil, pharmaceuticals because it profits most from light regulation which brings with it social costs is a special issue not addressed here. Other business, banking, automobiles, and a range of other industries have other priorities yet also see the need for the economy and the US to move forward with a different vision than one that simply ignores climate change, and fails to address child care, child poverty, wide disparities in wealth, and other issues facing of wages, cost of living facing most Americans.  ...

This report in ProPublica on October 13, 2020, by Lydia DePillis was written near the end of Robert Lighhizer's term as US Trade Representative.  Bottom Line: It is human behaviour that no country, no kingdom or group will give up its money advantages secured when the opposition was weak or disorganized till the last fight is fought. The British were not giving up India, a source of financing the war against Napoleon in 1800's and then the Industrial Revolution in 1850's, the Dutch were not giving up the financial advantages of their Spices Empire in Batavia (Indonesia). History has shown this. Once gained under a state capitalism Japan was not going to give up its financial advantages gained by the 1980's when the US was weak or disorganized, till the last battle was fought.  Lighthizer who for the relentless Japanese was equally relentless till the goal of fair and level playing field for America was secured. This is true for China today on Liberation Day. This entire report by De Pillis in 2020 shows the Chinese would be relentless in 2020 like the Japanese in the 1980's, the Dutch in Indonesia  in the 18th and 19th century and the British in India in the 19th century and 20th century. China turned Mexico and Vietnam into supply routes into the US market. It continued its efforts to gain US technology in other ways. USTR older officials from the Bush Obama years of failed negotiations with China and endless hours putting together minute details of agreements including the TransPacific Agreement of Obama were not going to like the new approach of Lighthizer so stuck were they with the old approach of no clear goal and not getting an even playing field from China. ...

India US relations are critical, and the human element with 4.4 million Indians living in the US is a critical part of this, Jaishankar and Blinken, foreign ministers of India and the US, told a gathering of students in Cambridge, Massachusetts today. This has completely transformed the relations between the 2 countries. "Students, researchers, academics and professionals who have contributed to America's progress even as they remain a bridge between our two societies," Jaishankar told the students. Yet this is not enough as a close understanding between the young Americans young Indians has to be built. "Your appreciation of a civilizational state and a democratic and fellow polity that is overcoming enormous odds is essential. After all we are natural partners when our people have a strong sense of connect," Jaishankar told the students. How many young people in America understand the enormous odds in a democratic country to vaccinate over 1 billion people or meet the basic needs for food and essential medicines for every person in the country of 1 billion. Yet this has been achieved in 2020 to 2022. America has a strong inward sense and insular attitude, and for this reason India needs to take the initiative to reach out to America. India's new education policy puts great emphasis on collaboration with America and European Union in education which has huge potential to build close understanding. To do this Jaishankar and Blinken together launched the Working Group for Education and Skill Development for the US and India. ...

Bernanke's speech at the annual Fed Jackson Hole meeting put any future policy action off for the September meeting of the Fed's Open Market Committee, which will meet for 2 days to allow lengthy discussion of issues. He repeated his focus made in earlier statements that other actions are needed to reduce the headwinds facing the U.S., actions other than the Fed's monetary policy. He called for "good, proactive housing policy," which has been a major missing piece in the jigsaw puzzle of the American economy. Specifically, "families with mortgage debt bigger than the value of their homes facing unusual financial hardship which is also hurting the banks." Martin Feldstein and other experts have repeatedly called for action to help homeowners under water since the mortgage financial crisis hit in 2008. And the government's response has been tepid at best. Most evaluations of the Home Affordable Modification program and other programs to help prevent foreclosures consider them a serious failure of the Obama administration. Higher unemployment has only increased the urgency for government action in this area and good proposals were made by Feldstein and other experts. On the deficit and debt issues Bernanke would like to see debt to GDP ratios "at least stable, or preferably, declining over time." He also cautions that this be done bearing in mind "the fragility of the current economic recovery." He says his estimate for the U.S. economy's growth rate is 0.7% annual rate for the second half, and 'looks likely to improve." His prediction is for inflation to settle at around 2%. His main concern is that the there will be "an erosion of skills and loss of attachment to the labor force" for the long term unemployed....

David Malpass is the choice of the Trump administration to head the World Bank. He has worked with Latin American countries at the State Department, was the Treasury official responsible for the World Bank in the Reagan administration, and worked on Argentine currency, China trade matters in the Trump administration.

Malpass negotiated a $13 billion replenishment for the World Bank in 2017, with U.S. share of $1.2 billion. This capped the bank's lending at $25 billion.

Last year the World Bank provided China with $60.5 billion in loans for 400 projects, which this WSJ editorial says is loans China does not need with its $3.07 trillion in foreign reserves. This editorial is critical of the current World Bank head Dr. Kim for taking a job with a World Bank partner the private equity fund GIP.

The World Bank has played a significant role in development for South Asia and China in the early years after World War II.

Automakers will have to ensure that 40 to 45% of a car's content is made by workers in the U.S. earning at least $16 per hour. If this is not met automakers pay a 2.5% tariff for cars brought in from Mexico. Mexico makes 2.3 million cars and Canada 1.8 million. Automakers invested tens of billions of dollars in Mexico turning it into a lower cost export hub. This has led to job loss in the U.S. Mr. Trump's efforts in the new trade deal with Mexico are designed to increase investment in the U.S. auto industry.

No mention is made that Biden was faced with a once in a century pandemic, winning the fight for vaccines over skepticism, and on Feb. 22 2022 Putin launching an attack on Kiev, Ukraine, and negotiating to get the crumbling infrastructure of the US rebuilt, funds for CHIPS and Science. On top of this the Venezuelan economy completely collapsed leading to an unanticipated migrant surge. Only FDR and Lincoln faced so many huge challenges and tackled them one by one. Without these facts the result can be to stall the biggest boom in manufacturing under president Biden/Harris that America has experienced since the space race in the 1960's. ...

Refugees in Germany are 3.48 million in 2024 at 4 percent of the population, government data shows. This is 60,000 more than in 2023. One third of them are from Ukraine and many of them seek a return to their home country. Clara Bunger a member of the German parliament requested the information from the government. Bunger says- "It's in clear contradiction to the misleading portrayal of an alleged 'national emergency. Such scaremongering deliberately distracts from actual social problems and uses fear to make refugees a scapegoat." This distraction from the problems of cost of living is why immigration hurts workers and families, why PM Mette Frederiksen, Denmark, PM Michel Barnier, France, US president Biden/Harris who negotiated the legislation with Republicans in Congress to close the Border are taking this important step to refocus on the future of America and Europe, and the world at large. ...

Its impact is huge coming at the time of Covid pandemic and at a turning point in rebuilding America's infrastructure. What Biden missed was that migration needed to be brought under control taking immediate action as a top priority in 2021, not getting blindsided by the fact that Republicans were using strong language and the issue had become politicized. Biden did this for tariffs with China in 2020 keeping most of the DJT tariffs, he could have done the same keeping the basic border policies of the DJT administration and negotiating with Republicans in 2021 when he was in a good position to have legislation passed. The US has 1 trillion in trade deficits each year and it is completing the destruction of manufacturing in the US. Half of this is with China as China exports through Vietnam and Mexico, third countries, in addition to 295 billion dollars of trade imbalance the US has with China. China, Mexico, Canada and Vietnam are the largest offenders. No country can long endure with such a loss of its manufacturing base. The US Navy itself is in danger without the manufacturing to compete with China in shipbuilding. China has taken up over 50% of shipbuilding, and soon the US Navy will not be able to protect the free world if these types of economists and self serving German or other foreign interests drive a false narrative and the US acts on such false narratives.  Without the US Navy in the Pacific, Atlantic and Indian Oceans no one is safe, not Germany, not the EU, not India, not Latin America or the rest of Asia and the world.

This report in the NYT by Halbfinger and Kershner shows a Israel that is divided in its views about prime minister Netanyahu. In early 2018 with the police report on the investigation into Mr. Netanyahu on campaign finances, half of Israelis support Netanyahu, with the other half thinking that Netanyahu should resign. Mr. Netanyahu has dismissed the investigation as full of holes like Swiss cheese. His supporters see it as part of a left wing conspiracy including state prosecutors and police. Supporters of Netanyahu see him as having improved Israel's security in its region, people who oppose him see him as being too divisive, using divisive rhetoric to improve his own position.  Younger voters in particular have a distaste for divisive politics practiced under Netanyahu, which extends to the supporters of Israel in America, and the policies leading to delaying of the peace project.  That peace project is also seen as part of the nation's mission to seek peace with its immediate neighbors, an unfinished project for Israel as a nation. After many years in office Netanyahu's party lacks the dynamic vision needed and it now appears only to see remaining in office as its goal, according to this NYT report. Climate policy changes lead to $1.3 trillion savings according to analysis from DJT administration and EPA's Zeldin, with $1.1 trillion in savings from lower vehicle prices which addresses unaffordability of cars. Using the average price of a new basic Toyota Corolla the price in 2020 was $19,000 which has gone up to $23,000 a price increase of 21% by 2025 over a 5 year period. The cost in 2026 of operating a Gas powered vehicle is on average about $2500, for EV car about $1000 with $1500 in savings per year for EV's that need to be figured into the equation at gas prices that prevailed in 2024 of $4-$5 per gallon . At prices of $3 per gallon the gas costs come down to $1200 when driven 12,000 miles at 30 mpg for 400 gallons of gasoline consumed. This makes the difference between gas and EV yearly savings on gasoline costs down to about $200 from $1500. This makes gasoline powered cars attractive as car companies can reduce EV investments and pass on some of these savings in lower car prices in 2027 in exchange for favorable rules on emissions and EV transition dates.  Are there losses through the emissions and climate change? The DJT/Zeldin EPA analysis points to global climate emissions from China and India (the coal powered plants) continuing at a pace that would determine the overall change in climate for 2026-2027. In this kind of approach the goal is to make cars affordable over a 2-3 year period for US and European carmakers who would be expected to cut prices. It is about flexibility in fighting the Cost of Cars a big component in the Cost of living with housing as the next large component. It is not a long term strategy, simply one that offers a flexible approach. Will the US, Europe and Japan fall behind in EV's technology? Hybrids a focus of Japanese cars will continue to advance that technology which is becoming a preference where it is affordable for customers. Toyota for instance will have a wide lead in hybrids technology by 2030. Much of the Chinese market will have EV's and the EV's technology will advance in China in 2026-2027, and tariffs will be needed to protect European and American carmakers for 2026-2028. It is a strategy tradeoff to deal with the cost of living crisis in US, Europe and Japan answering call for a flexible approach that was also heeded by the Biden administration in relaxing carbon emissions rule changes. It will require automakers to step up and cut prices for gasoline models for buyers at the entry and lower range for affordability by 2026-2027. What about climate action? The strategy is based on the idea that climate action requires India and China (coal powered plants) on board to make a real difference so that over 2-3 years to 2027 the US, Europe and Japan need to address affordability for the lower end entry cars. There is an element of denial of climate change in parts of the DJT administration in the US but not in Europe and Japan. It is also true that leading DJT administration officials Secretary Bessent see the problem of climate as real and one that needs to be addressed yet leaving room for flexibility to tackle affordability crisis for ordinary workers with low incomes struggling to make a living. Bessent and others in the DJT administration are calling for using all of the resources to address needs of people struggling to make a living, and for a strategy for the US to get back its manufacturing capacity from China and for rebuilding the US economy after deindustrialization (caused by Clinton's huge US economy shattering failure to provide safeguards for abuse of the trading system by China in signing a poorly drafted agreement for China's entry into WTO at the end of his term in 1999-2000 just when he had fought impeachment.  ...

The contrast between modernizing, developing East and South Asia ( from Mumbai to Shanghai) with war torn desolate West Asia (from Tehran and Baghdad to Kabul and Islamabad) is so striking today that it is something to reflect upon for wisdom and understanding. UAE support for Sudan's RSF Rapid Strike Force and Saudi support for the military - fracturing of Sudan, errors piled on errors led to the civil war in Sudan. A civil war in a country neighboring Saudi Arabia just across the Red Sea. Saudis and UAE were on opposite sides briefly after UAE pulled out of Sudan, UAE acting in this way to object against Saudis requesting US sanctions on UAE.  Once close partners have moved apart as they spread their influence in different conflicts in the Middle East.  This has not created a region that can grow economically without the disruptions of conflict in the way other parts of Asia have emerged to modernize the countries as in Taiwan, Korea, China and India. In neighboring Pakistan another conflict has emerged as partners split, with looming conflict between Afghanistan and Pakistan. Yemeni Houthis are in conflict with the US and affect the Persian Gulf shipping lanes.  Iran with it's pursuit of weapons programs and nuclear weapons is using capital that is badly needed to improve the economic situation on arms buildup for the regime and for allies in Lebanon and Yemen, leading to protests and crisis. In this way the Middle East has failed to use oil wealth to modernize the entire region. Much of it was wasted in Iraq and now in Iran by policies that led to war and regional conflicts not modernization and technological transformation that has happened in Asia. The US has inadvertently becoming a partner to this as when the Obama administration helped fund Iran's economic rebuilding which was instead used to fund the military, and before that the Reagan administration support for Iraqi socialist ideology regime. The challenge for China was how to modernize after the Japanese invasion and civil war. In Korea it was how to modernize after the civil war. In India it is how to modernize with a smaller neighboring country Pakistan promoting terrorism and wars now with China's support. In Asia all these challenges were and are being met to steadily and persistently modernize to European standards with a singleminded focus and determination to meet the aspirations of the people with the US business working alongside Taiwanese, Korean, Chinese, and Indian governments and private industry. In West Asia various ideological (Iraq), military (Pakistan), religious Shiite (Iran), religious + modernizing (Saudi +UAE) with erratic leaders and little representation of the people, has destroyed the tranquillity of the region and destroyed democratic forms of government, destroyed bottom up education and health of the population except for priviliged groups in countries in the region of West Asia. Involvement of US and Europe or Russia in West Asia has led to distintegration of Soviet Union (Boris Yeltsin) and deindustrialization of US and Europe (Reagan, Bush, Clinton, Bush, Obama administrations) with business shipping out manufacturing to China while wars engaged the attention of American and European elites in Iraq, Iran, Pakistan, Afghanistan. The entire west Asian scene for 1950-2030 has been a disaster, one massive disaster for all involved. The contrast with East Asia and South Asia reminds one of the words from Robert Frost of New England in Mowing- that reflects on the enduring value of honest labour. "My long scythe whispered to the ground. What was it it whispered? It was no dream of the gift of idle hours, or easy gold at the hand of fay or elf: anything less would have seemed too weak to the earnest love that laid the swale in rows. The fact is the sweetest dream that labour knows. My long scythe whispered and left the hay to make." ...
