The Environmental Protection Agency moved to assume authority over 14,000 coal burning plants, refineries and industrial complexes that emit more than 25,000 tons ( or emissions from burning 131 railcars) of of greenhouse gas emisssions, and are the source of 70% of the U.S.'s greenhouse gas emissions. The bill exempts the smaller facilities, "every cow and Dunkin Donuts," as Lisa Jackson EPA administrator put it. It exempts millions of other sources like bakeries, dry cleaners and hospitals, and focusses on the 400 largest facilities that do most of the environmental damage. These facilities will be required to obtain construction permits and prove that the best available technology has been applied. Lisa Jackson said we are not going to go ahead with business as usual, and it will give President Obama something to show at the Copenhagen talks. Senators Kerry and Boxer are introducing legislation that will be fought by the power plants, and this move by the EPA will be challenged by the power companies....

Tata Consultancy Services acquired Citigroup's India based outsourcig unit Citigroup Global Services for $505 millon in an all cash deal. With that deal TCS alo got a $2.5 billion contract to provide process outsourcing services, application development and infrastructure support to Citigroup and its affiliates over 9 and half years. This is notable because the Citi contract is the biggest ever for an Indian company, as previously Indian companies have operated with smaller scale deals lasting 2-3 years and worth $50 to $200 million. In October 2007 TCS signed a 10 year $1.2 billion contract with Dutch group Nielsen. What this does is enhance TCS capabilities and expertise to go head to head with companies like IBM and EDS. The Citi acquisistion adds 12,000 employees and $280 million in revenues to TCS. TCS had 111,000 employees before the Citi Global Services acquisition and this expansion will enable it to compete more effectively with IBM and EDS/Hewlett Packard.

Should 33,000 member Boeing machinists union approve a 25% wage increase over 4 years or ask for 40%?  It has been a long time since a CEO pleaded with union workers to not go on strike. Boeing has negotiated a 4 year 25% increase wage settlement, no non union plants in the South. “I ask you not to sacrifice the opportunity to secure our future together, because of the frustrations of the past. I also know there are employees considering another path—and it’s one where no one wins." We suggested Stephanie Pope coming from a family of machinists for CEO- her dad worked at the Boeing plant. Pope says Boeing has a $60 billion debt pile and the Alaska Airlines accident with a bolted door coming loose midair. Pope says- "In past negotiations, the thinking was we should hold something back. Let me be clear: We did not hold back with an eye on a second vote.” ...

The 4.7 billion euro loss at German steelmaker ThyssenKrupp for the fiscal year ending in Sept. 2012. The loss stems mainly from management's bet on a large project to make steel slabs in Brazil and ship it to a plant in the U.S. state of Alabama for finished product of high-grade sheets. The project suffered delays and by the time the Brazilian plant was running in 2010, the strength of the real Brazil's currency and higher wage costs had affected the economics of the plan. Steel demand also slowed in the U.S. The plants which required an investment of 12 billion euros now have a book value of 3.9 billion euros. Thyssen bet too much on one project and it failed. Three management board members who had oversight over the compliance, steel and building technology areas had their contracts terminated, and a new CEO was appointed in 2011. Heinrich Hiesinger, a manager from Siemens AG is the new CEO. ThyssenKrupp's image has been sullied by reports of price fixing of rail tracks and scandals involving the communications head for foreign railroad contracts. Hiesinger says "until recently there has been an understanding of leadership in which old-boy networks and blind loyalty were often more important than the success of the company." He faces a difficult challenge of changing the corporate culture and developing a new strategy. His plans are to turn ThyssenKrupp into a high-tech engineering business by selling the steel mills in Brazil and Alabama, and the stainless steel division to Finiish company Outokumpu Oyj. This will shrink steel from 41% of sales to 30%. To implement this strategy Hiesinger needs a capital increase. This runs into problems as the Krupps Foundation headed by Berthold Beitz, which controls 25% of the stock, does not want to see its influence diluted. Other problems include the role of Gerhard Cromme, head of the supervisory board, which failed in oversight over the failed project. Cromme is also the head of the supervisory board at Siemens AG. At Siemens he helped a company cleanup after a bribery scandal and brought in new management. He also headed the Cromme Commission on corporate governance code for German business, which makes the current corruption allegations embarrassing for Cromme....

Readers of the NYT reflect on the Syria-Iraq conflict and the experience in Vietnam. Stuart Gottlieb, who teaches American foreign policy and international security at Columbia University, describes Logevall and Goldstein's Vietnam analogy for Syria as a situation on how one can go wrong by relying on historical reference when new thinking is required based on existing challenges. Others point to the situation in Vietnam as Kennedy's war with 16,000 advisors already on the ground. Kennedy's words "let every country know whether it wishes us well or ill, that we will support any friend, oppose any foe...," were part of the Cold War in the early sixties that Kennedy inherited from Eisenhower and Truman starting with a Communist Iron Curtain falling over Eastern Europe and threatening Western Europe. The situation today is quite different in a Middle East with little to do with Russia and China, at the same time sectarian with Sunni and Shia, and aspirations of Arab people for freedom from dictatorships....

Because technology spending has been more disciplined and focused on productivity and efficiency gains, the investment has been lower but more effective than in the 3 years leading to the last recession in 2001. At that time it was increasing 12.9% a year leading into the recesson and faced sharp cutbacks leading to a drop of 11% over the next 2 years 2001-2003. By contrast this time the tech spending went up by about 2.8% a year in the last 3 years, according to Gartner, and has delivered solid results at places like American Airlines. Technology spending is likely to hold up and continue moderate increase this year and next as the US enters a recession. At American a fuel efficiency drive starting 2005 including software to come up with best routes, flight paths and baggage loading has saved 96 million gallons a year. Note that spending on computer hardware and software is about half of all capital spending by business.

Self-compassion as a useful trait. Being on good terms with oneself helps in improving motivation, self-discipline, and reducing anxiety.The result is a calmer, stronger person in the long run. Actually the research goes back to the 1930's and 1940's, with the books of Harry Emerson Fosdick. He called it self-acceptance and showed that by doing this people shouldered responsibility for themselves. This was for Fosdick a part of "being a real person," also the title of one of his books. The difficulty is that then as it is today, the prevailing notion was that if one engaged in self-acceptance we would take less responsibility for ourselves. In 1927 Fosdick was appointed radio minister for the National Vespers Hour. For 17 years his voice went out to the whole nation struggling with self-doubt during a depression and war, from a room in a church tower overlooking the Hudson River in New York city, each time building in people a faith in themselves.

Some features of the U.S. health care law are likely to be retained even if the Supreme Court overturns the health care law- the feature that lets parents carry a teenager on their polcy till age 26, and the feature that private insurers cover preventive services without copays. These are very popular and preventive services make sense for the insurance companies to reduce higher costs later on. Other features such as the discount pharmaceutical companies must give to seniors falling under the Medicare gap, and annual physicals without copays may not be retained. 3.6 million Medicare benificiaries saved $2.1 billion on prescription drugs, $604 per person, from the Medicare gap discount. And 32.5 million Americans took advantage of the annual physical without co-pays in 2011. About 50,000 Americans insured temporarily for people with a pre-existing condition also may lose their coverage. Another provision which prevents states from tightening eligibility rules for Medicaid before 2014, may be questioned also as states feel burdened by these rules during a period of budget cutting in areas such as education....

Fortd's sales drop 18% in September but it does not say over Sept 2006 or over August 2007, appears to be Sept 2006. Overall sales increased 1% Sept 2007 over Sept 2006. GM increased sales by 4.5% and Toyota sees a very slight drop. Only Ford's Edge makes good progress but only from prior Ford customers who traded in other Ford models for the Edge, the new Taurus does poorly with sales 30% less than the Ford Five Hundred which was renamed Taurus. Honda and Nissan saw sales increases of 13.8 and 11%. Chryslers sales declined slightly by 1.6%. Ford's market share fell from 16.5% to 13.3%, whereas GM's market share went from 24.4% to 25.3%, comparing year over year. Toyota sold about 35,000 more cars than Ford in September in the US market. Takata struggled with a faulty airbag recall crisis and failures in quality control that go back to 2004, with a crisis in 2015-2017 as a result of about 14 deaths. Takata's liabilities now run to over $15 billion according to Tokyo Shoko Research because of claims against it from banks, automakers and others. Takata declared bankruptcy on June 25, 2017. Takata was sold to a Chinese owned manufacturer based in Michigan, Key Safety Systems, for $1.6 billion. Takata had hoped for a white knight investor or some of the automakers such as Honda to save it. But the liabilities were too great and automakers in Japan resisted the idea because it might upset shareholders and it made no sense to assume growing liabilities. As a result the Takata company name will go out of business- for a company that started in 1933. The Chinese company taking on the business, a quarter of the market share for the airbag market, is Ningbo Joyson Electronic Corporation. A related article in the NYT in 2014 by Tabuchi shows how management at Takata failed to act responsibly when the early beginnings of the crisis happened in 2004. See the link. [article-54918]  At that time testing of an exploding airbag in Alabama was kept secret and later closed down without informing safety regulators, according to former employees. The pandemic and the lockdowns resulted in a sudden surge in demand in 2020 and 2021 for home delivery of goods by Amazon. Amazon expanded rapidly during this period. Now in 2022 Andy Jassy the new Amazon CEO is cutting back warehouse capacity and finding ways to reduce Amazon's size as buyers are cutting back now that the economy is getting back to some normalcy. Inventories are piling up for retailers Target and Walmart. During the pandemic Bezos set up hundreds of new warehouses and sorting centers, and employees doubled to 1.6 million from March 2020 to March of 2022. As instore buying came back and Amazon projections of long term demand turned to be too high Andy Jassy the new CEO is working on cutting back. Amazon says this extra capacity will mean $10 billion in extra costs in the first 6 months of 2022. Its stock lost about one third of its value under Andy Jassy's first year as CEO. Jassy and his team are working to sublease about 10 million square feet of excess warehouse space and renegotiate warehouse contracts. Dana Mattiolo looks at how Mr. Jassy tackled the new job of online retail with his obsession for detail, learning the new business from scratch. He was previously head of the cloud business at Amazon which generated three fourths of the profit of Amazon. Jassy says Amazon always chose the higher end of the numbers generated by its forecasting tool SCOT that showed how much warehouse and handling capacity was needed. SCOT tool generated high medium and low figures of what the demand would be and what resources were needed to tackle it. The policy of Bezos who ran the operations and delved into details during the pandemic was to not constrain sellers and buyers during the pandemic. Though not mentioned here this was a decision of Bezos that helped America tackle the pandemic in an effective way. And could be seen as a courageous move by Bezos of ignoring the risks and doing the right thing for America and the American people. It is now left to Jassy to figure out how to take corrective action but the basic policy of Bezos was done with the right intentions towards America during a period of serious danger of the pandemic when over a million lives have already been lost. ...

Under UN Convention on the Law of the Sea, natural islands or rocks are given territorial sovereignty going out 12 nautical miles, but no such sovereignty exists for reefs that are submerged in high tide. Two U.S. B-52's fly within 2 nautical miles of the Cuarteron Reef in the Spratly Islands in late Dec. 2015, about 600 miles south of Hainan Island in the South China Sea. China claims control over the South China sea navigation routes through its reclamation work in the seven rocks and reefs in the Spratly Islands. The U.S., Japan, India, Vietnam, Philippines and other countries say these are international waters and form key navigation routes from the Indian Ocean to the Pacific Ocean for global shipping. In late October 2015, a U.S. Navy destroyer sailed within 12 nautical miles of another island built by China in the Spratly Islands.

The Tokyo National Stadium design approved by a 2012 panel headed by architect Tadao Ando, is scrapped by prime minister Abe of Japan. The design was by the firm Hadid Architects in Britain. Public criticism over the cost of the project for the Tokyo Olympics led to its cancellation. The original project cost estimate was 130 billion yen, with the new cost almost double that of 252 billion yen. Surprisingly Tadao Ando says it was not the panel's job to figure out the cost and he did not have any idea what the cost would be when the design was selected. The debt problems in Greece began with the Athens Olympics. And it is widely thought that president Putin spent too much ($47 billion) on the 2014 Sochi Winter Olympics, especially now that Russia's economy is contracting and there is a need for stimulus spending on useful infrastructure.

David Cameron's standing with the British public is hurt by the phone hacking scandal and his close ties with News International's Coulson and Rebecca Brooks. This has boosted the standing of Labor party leader Ed Miliband. Miliband said in an intervew with the Observer newspaper: "I think that we've got to look at the situation whereby one person can own more than 20% of the newspaper market, the Sky platform and Sky News. I think it's unhealthy because that amount of power in one person's hands has clearly led to abuses of power within his organization." Miliband has called for the breakup of Rupert Murdoch's media holdings, saying News Corporation "has too much power over British public life." He told the Observer he would work to get a cross-party agreement on new rules governing media ownership that would reduce market share of News Corporation.

The number of people working lesss than 35 hours per week is approaching 7 million according to the Bureau of Labor Statistics. Many of these families are seeing furloughs of afew days amonth, pay cuts and shorter working hours. All this means buying at the discount store, like this family which keeps careful track of account balances while shopping, and keeping a meticulous track of purchases tossed into the shopping cart with a calculator so as not to go over the budget. This may be the reason companies like P&G have introduced affordable lower end brands, so as not to permanently lose these customers to store brands. See the link to P&G's discount brand strategy, which couples with its developing super premium brands at the same time, yet barely eking out a 1-2 % revenue gain in 2009 and 2010 by its estimates.

Unknowingly many people have ownership in gun manufacturers through their pension funds. Pension funds for public employees in Florida, Texas Wisconsin and Ohio have stakes of less than 1% in American Outdoor Brands, formerly Smith & Wesson, the manufacturer of AR-15 semiautomatic rifles used in mass shootings at schools and other locations. Even a reputed fund such as TIAA representing teachers has small stakes in this company, this report in the NYT shows. New Jersey is one of the states cutting out investments of state pension funds in gunmaker companies. New York state still has small positions in its teacher pension funds in these companies. AS this NYT report shows it is through the use of  broad stock indexes that pension funds end up owning these stocks even when they have not specifically picked out such stocks. Equally or more alarming as reported here is that funds such as Fidelity and Vanguard own large stakes in the gunmaker companies. Fidelity is reported as the top shareholder of Vista Outdoor, with 15% of the company, through actively managed funds.  Vanguard has a 9.5% stake in Sturm Roger, and a 8% stake in American Outdoor Brands. Black Rock and Capital Group also have stakes in gunmaker companies. This points to a larger culture problem in the U.S. as financial companies see this as " a social issue" whatever that is supposed to mean in the minds of investment managers, when it is really an everyday issue for parents and children. In a culture prevalent in parts of the country and American society that sees something as basic as guns in schools and other public areas as "social change" a spokesman for Vanguard can quietly say that "mutual funds are not optimal agents of social change," without arousing a response. ...

The breakup fee of $4 billion and the $1 billion in "book value" of spectrum AT&T is giving to T-Mobile as part of the fee are part of the cost of the failed acquisition of T-Mobile. Other costs are that this puts AT&T at a significant disadvantage in relation to competitor Verizon, because Verizon is at least one year ahead in bringing out its next generation LTE network. By the end of 2011 Verizon's LTE network will reach 200 million Americans compared to AT&T LTE coverage of 70 million. Apple's next iPhone in 2012 will be an LTE model. AT&T's network congestion will mean it will have to do more capital spending than Verizon in the years ahead. Verizon has early mover advantages from its early investments in LTE network. From 2008 through the first 3 quarters of 2011, Verizon invested $29.3 billion in its wireless network compared to AT&T's $28.1 billion.

Speaking at the annual meeting of Italy's banking association on July 11, 2012, prime minister Mario Monti calls the struggle he is leading to change the economic performance of Italy, and especially against structural vices in the economy, "a very tough war." He added that the plan to reduce Italy's borrowing rates with the agreement to use the ESM or EFSF, the EU's rescue fund, "must be consolidated both in its substance and the way it is communicated." Bank of Italy governor, Ignazio Visco, said the spread between Italian and German bonds and the borrowing rates approaching 7% for Italy compared to about zero for Germany and France, were "far above what would be justified by the fundamentals of our economy." Deputy finance minister, Vittorio Grilli, is taking over the role of finance minister which Monti had assumed earlier. Monti will lead a new economic and financial policy committee which includes Mr. Grilli and development minister Corrado Passera.

The present grid was conceived 100 years ago so it cannot accomodate the transmission demands of wind energy turbines. First the location of these wind farms is in places like upstate New York or in places in the prairies like Kansas and possibly in places like Wyoming where the wind blows relentlessly and the major population areas are farther away, the transmission capacity of lines in these sparsely populated areas is small and so getting the wind energy out to where its needed is a problem. Building bigger transmission lines runs into getting support from different states and property owners as the states have jurisdiction and not the federal government over transmission lines and this requires a lot of people giving approvals thus holding up a rapid improvement except in Texas where Pickens is trying to get energy from the western parts to the Dallas area and has the full support of the state apparatus.
