The Court of Appeals of the Fifth Circuit is based in New Orleans with 3 Judges making the decision. Bush appointee Southwick joined Biden appointee Ramirez against Trump appointee Oldham in a 2-1 decision. Oldham in a 131 page dissent says-“Today the majority holds that President Trump is just an ordinary civil litigant. His declaration of a predatory incursion is not conclusive. Far from it. Rather, President Trump must plead sufficient facts — as if he were some run-of-the-mill plaintiff in a breach-of-contract case — to convince a federal judge that he is entitled to relief.” Southwick does not appear to see this as an invasion ignoring the deaths from fentanyl and drug trafficking in the US, the strain on public resources and cities of uncontrolled flow of migrants in recent years, saying- “A country’s encouraging its residents and citizens to enter this country illegally is not the modern-day equivalent of sending an armed, organized force to occupy, to disrupt or to otherwise harm the United States.” Yet even an armed organized force was pushed back in the War of 1812, and has little chance where the current problems have led to the deaths of more young Americans from drug trafficking than three times the deaths in the Vietnam and Korean Wars combined, three times the deaths in World War I and about 75% of the deaths in World War II, something that needs reflection and action. With the changing public sentiment in the UK and Europe and in the US on law and order and on migrants the Supreme Court is faced with coming up with a decision in the best interests of the Nation and its People. ...

Denmark's Mette Frederiksen and policy of no asylum in EU for illegal migrants is becoming the norm in Europe- as Germany's Merz supports this policy- and the US. Britain under Starmer's Labour has struggled with it's justice system unable to deal with the situation of asylum because it was never designed for people of other countries entering the country in this way. A visit by president Biden to Canada to meet president Trudeau shows a unity of purpose of the two leaders who have a close Justin and Joe relationship, says this report in NYT. Before the trip an agreement had been reached by which the two countries can ease pressures of migration from the southern hemisphere. Migrants seeking asylum in Canada from the US will be turned back at Roxham Crossing. Canada will accept 15,000 refugees from persecution, violence or economic devastation, to ease pressures of illegal crossings into the US from Mexico. The trip comes after Trudeau's frosty relationship with former president Trump. It also comes as Canada and the US build a closer relationship to meet challenges of multipolar world from China.

Immigration declined in the 1920's so that when FDR became president it was easier to build a working class coalition. After 1965 when president Johnson signed into law a bill that allowed family unification it was seen as not adding significantly to legal immigration. Yet in the period after 1965 millions of immigrants entered the US. This writer says the Democrats have forgotten that FDR built the Democratic worker base when immigration was not an issue. Today the rise in immigration has muddled the Democrats efforts to build back the working class coalition of FDR, with loss of support from workers and non college educated people who see migrants crossing the border as a serious problem.

Tens of millions of migrant workers head back to their homes in poorest states in India as LPG cylinder prices quadruple and are in short supply April 13, 2026.It also affects China and Japan which are dependent on Hormuz,  not the US which exports oil and does not seek to gain from oil prices. Posturing by the media and European governments on this issue has created this delusion that this is about US actions, when the US is only acting in the interests of all nations to keep the planet safer from dangerous nuclear proliferation in the region most torn by repeated wars in the last 50 years. Some of the language used about attacks on power plants has become a reason to justify such reporting to present aggressive ballistic missile development and nuclear weapons development in Iran in a benign way, becoming oblivious of how it affects the lives of billions of people around the world, as the Middle Eastern region a small fraction of the world's population (less than 7%) and a small fraction of the planet's surface (less than 6%) continues to operate in a way that is destructive for the lives of people around the world.   ...

Canadian prime minister Trudeau met with DJT at Mar-a-Lago. DJT said Mexico and Canada are not doing enough to stop flow of drugs in particular fentanyl into the US, and undocumented migrants. There are about 2.4 million workers on American farms. 44% of them are undocumented workers says the Department of Labor.  They do jobs such as picking the fruits and vegetables that are part of the food supply. Deporting them all will increase prices of farm products as harvesting fruits and vegetables will be difficult. During the Eisenhower administration in 1953 deportation plan large growers in California and New Mexico used seasonal agricultural labor from Mexico, and the nation's food supply of vegetables and fruits depended on these workers. These companies lobbied hard for ways to keep these workers. On the other side were smaller farm owners who used fewer migrant workers. The complication this time 2024 is that unlike in 1953 under Eisenhower mass deportation when the border was otherwise peaceful, in 2024 the US has faced a decade unprecedented in its history of flows of fentanyl and drugs across the southern border. The deportation is about migrants who are not easily integrated culturally into the US, about the dangers of illegal entry in such large numbers that it disturbs the quiet life of the small towns and cities in the US. The US needs immigrants but in a planned way with legal entry, and no flows of drugs across the Border, that protects the American people and serves America's interests.    ...

With Ukraine unwilling to give up the Donbass and Germany/France/UK wanting to prevent Russian favored deal adverse for Europe, US focus on Monroe Doctrine and western hemisphere, Ukraine Russia war is likely to drag on. This is what one sees in Merz, Zelensky, Rubio speeches at the Munich Security conference. In 2026 Germany+ (that includes France and the UK) does not see it in the interests of Europe to allow a Ukraine capitulation to Russian attacks and Germany has already allocated funds to rebuild its military to prevent this from affecting Germany+ interests in Europe. Even though the winter attacks on Ukraine grid and electricity infrastructure leaves Kviv and other cities in a dire situation it appears that without the 20 year security guarantee or something solid Ukraine is not willing to sign an agreement which it fears Russia could turn around and start the war again. Germany+ which is the position of the major parties in Germany 60-70 % of voters for the SDP, CDU, Greens and others except AfD with 20-30% of voters. (AfD may have reached a ceiling as CDU under Merz is tough on migrants). Which means about 70% of Germans will support a policy of joining UK and France in resisting Russian attacks. Russia may have lost so much in manpower may see the war as a vindication only if it can hold onto the Donbass which may make it harder to reach a deal. Zelensky says Ukrainians live there and is unwilling to leave the Donbas region. The net result is that Germany+ and Ukraine are not likely to concede ground, the US reluctant to commit to 20 year security condition for Ukraine as it focuses energy on the western hemisphere and the fentanyl, drug traffickers in Mexico, Venezuela and Colombia, and their support structures in Cuba, in addition to Iran and China's plan on Taiwan sees limits to what it can do beyond limiting oil's funding the Russian attacks. It is amisrepresentation to say that the US is the cause, as everything changed the moment China became an industrial power with the help of US business interests and returned to its own story of being subject to British and Japanese incursions in the 19th and 20th centuries, and sensing that it is an industrial power in its own right by 2020 and insisting on framing its own policy in the world. Europe always had its own narrative since 1600 long before the US became an industrial power under Teddy Roosevelt in 1904. In that narrative which now plays out again different European powers band together to prevent any dominant power in Europe (Russia in 2026) from gaining dominance. ...

Nine sociologists at Peking and Tsinghua universities signed an open letter calling national and local governments to implement actions that let migrant workers integrate into the city environment and share in the country's progress that they are creating. The government's security system has prevented the creation of a worker's movement in the past. But this time the government may be thinking of the need to develop China's domestic market, as the reliability of markets in the USA and European countries is uncertain as economic conditions change. For this to happen China's workers need higher wages to buy the goods China produces. ...

History will see the lack of working on a bipartisan basis from the beginning of the Trump and Biden terms to stop illegal migrants and fight CMC (Canada, Mexico and China) on fentanyl flows as a blot on both parties. A remarkable change has happened in a matter of 100 days in Canada's stance on immigration and fentanyl flows. Trudeau now calling for eradication of fentanyl, his deputy prime minister saying Canada has more fentanyl deaths per capita than the US because of smaller population, and the need to wipe it out off the face of North America. The Canada Conservatives generally support DJT. The Trudeau Liberals have shifted policy to support DJT policies on immigration and fentanyl flows. In general Canada is making a pronounced shift towards support of the US position on immigration.  It is not just DJT policy as closing the border was part of the agreement agreed by Biden in 2024 with Republicans in Congress led by Lankford-Graham-McConnell which was not passed because it was too close to the election. One can only say the Covid pandemic, vaccination shortfalls, failures of supply chain distracted Biden from acting early and similar to DJT on the first phase of immigration action on illegal migrants committing offenses. The release of illegal migrants across the US is something that Democrats will years from now see as a major error in its policies. History will see the lack of working on a bipartisan basis from the beginning of the Trump and Biden terms to stop illegal migrants and fight CMC (Canada, Mexico and China) on fentanyl flows as a blot on both parties. ...
