US Supreme Court hears arguments from D. John Sauer Solicitor General of the US on DJT Tariffs Wednesday, November 5, 2025. The Supreme Court will hear about a case brought by a small wine importing company with 19 employees. The US president used the 1977 International Emergency Economic Powers Act (IEEPA) that allows the president to impose tariffs. The IEEPA was introduced by president Jimmy Carter in 1977. It was used during the Iran hostage crisis. It has been used for the Venezuelan regime after elections were rigged with human rights violations, on Belarus as early as 2006, and on Mexico for drug cartels. This increases the responsibilities of the Justices of the Court as these sanctions have broad support of the American people. Tariffs were imposed on China for illicit fentanyl flows and a 25% tariff was imposed on Canada and Mexico under Executive Orders 14193, 14194, and 20% on China under Executive Order 14195 in 2025 for illicit drug traffic flows across their borders into the US. Illicit flows that has taken the lives in the case of fentanyl of more young people than were killed in the Vietnam, Korean and First World Wars combined.  For the reason that the economic aspect of tariffs now overlaps with trading partners abuse of basic rights of their largest trading partner the US in the case of Canada, Mexico and China not stopping such flows, the issue before the Supreme Court is basic to the US as a Nation to protect its citizens under these Executive Orders and IEEPA- not the kind of interpretation of the law the USC does for most or almost all of its cases. In 2025 a lot of the discourse is distorted and does not reflect the way citizens of the Nation should show concern for the welfare and safety of their fellow citizens in communities around them severely hurt by the scourge of fentanyl and other opioids making their way from other countries conducted by drug trafficking gangs outside the US.  Also relevant is that the tariffs are correcting trade deficits of $1 trillion of the world with China that threaten the economic security of the US, EU, India and other countries. Larger companies are moving their supply chains out of China to reduce concentration in China, impact on inflation is slight with 3.0 % inflation in September 2025. Smaller companies such as the wine company in this lawsuit are unable to do so. Most of the smaller businesses affected can be compensated with a fund from the tariffs revenue of $500 billion in 2025-2026. In this way the goals of the US as a Nation can be achieved of reducing the supply channels concentration in China, cutting supply chain concentration in China, for fair trade with trading partners EU/Japan, and for action on fentanyl and drug trafficking. Justice Roberts and his team have a lot to think about in this effort by the Nation to correct abuses that should never been allowed to happen. ...

He says the views in western media reflect an inadequate knowledge and understanding of Chinese history and China's perceptions of its role in the world. The three decades of policy progress as China urbanized and modernized its economy after the opening by Deng Xiaoping are now followed by a new phase under Jinping in which the Communist Party sees itself in a new and more important role. Lower prices have boosted unit sales for Microsoft and Autodesk for Chinese operations. Autodesk now sells its software for about half the price in the USA. Autodesk saw a doubling of licenses in China to 300,000 after slashing prices. Microsoft sells Windows 7 Home Basic for 399 yuan or $59, a third of the price in the USA. By reducing margins, Microsoft makes up for it in volumes, says Microsoft's China CEO. IDC and Business Software Alliance estimate that 79% of the PC software installed in China in 2009 was pirated, down from 86% in 2005. Lower prices make Chinese buyers more willing to invest, and education helps to increase the value of using legitimate copies. China's PC market is expected to be 67 million units in 2010, behind 78 million in the USA, but software sales in China are only $5.8 billion, behind the US sales of $143.6 billion. This makes the potential for software sales large at the right prices.

Audi is the second largest car company in the premium car category in China after BMW. Audi now plans to make 700,000 cars in China by 2015 instead of 2020 as planned earlier. Audi say executives say the premium car segment in China is growing rapidly in China. It expects sales to grow overall at a a more normal pace than the frenetic pace of recent years. The slower growth in the economy at 7-8%, which is reflected in slower sales in the overall market, is not the case with the premium cars. Because of rapid growth in 4-5 years the Chinese market for premium cars will look more like mature markets in the U.S. and Europe, says Audi sales chief Schwarzenbauer.

As steel making capacity appears to be increasingly out of control in China in 2012-2015, trade actions to limit steel imports from China in other countries is growing. Huge excess capacity in steel, cement, glass, wind turbines and solar panels, is leading to China becoming the targe of global trade sanctions for 75% of the trade sanctions cases since 2009, according to research group Global Trade Alert.

As Chancellor Scholz sets anew direction for Germany reminiscent of the days of Adenauer and Brandt following the Berlin Airlift in 1948, two previous chancellors offer a stark contrast. Policies of Gerhard Schroder of the SDP and Angela Merkel of the CDU created some aspects of the situation where China and Russia are able to act in the manner they are acting today. Schroder made CDU policies under Merkel look acceptable even as they actually strengthened the position of both Russia and China in relation to the US. Both Schroder by joining the boards of Russian oil companies and Merkel with her policy towards China integrating German economy with China's, have created a situation where the American and European, Indian and other Asian, Latin American, African views of the free world are being challenged.

The difficulties posed by the absence of Xi Jinping at New Delhi G20 Summit are discussed here in the WSJ. Today September 9 the G20 leaders from 20 nations meet, absent will be Mexico's Obrador, China's Xi, and Russia's Putin. China's premier will attend the meeting. China's Xi met with India's Modi at the BRICS meeting in Johannesburg, last month. China's premier is a close associate of Xi's and his chief of staff for decades, so that any suggestion that Xi is reducing contact with other world leaders in 2023 is incorrect. Xi will meet Biden at the APEC meeting US is hosting San Francisco Nov. 12-18 that will focus on Asia Pacific nations.

Vegetable prices in China went up by 22% in July 2010, from a year earlier, and grain prices went up by 12%, eggs by 8%. About a third of household budgets go to food in the budgets of people in India and China. Wheat prices are climbing on world markets after the ban on Russian exports, and rice prices are also climbing with the floods in Pakistan ruining the rice crop- Pakistan being the No.3 world's rice exporter. Personal spending accounts for 36% of overall GDP in China and 57% in India. Food prices in China were up 6.8% in July, 2010. Industrialization in China, and agricultural land freely taken over for factory sites with the consent of local authorites, may be a complicating factor. As China shifts away from construction to support the economy no government support is given to real estate company Evergrande to reorganize it operations. Evergrande has $300 billion in debt and its sprawling operations all over China will now be dismantled. The decision is made in an Hong Kong courtroom on the 12th floor of the Hong Kong Court Building as reported by Alexandra Stevenson of the NYT. China is now moving away from the economic support of internet companies such as Tencent and Alibaba and construction firms such as Evergrande. More investment is going into renewable energy and companies that are leading in technologies such as BYD in electric cars worldwide. Investment is also being made in funding improvement in standards of living in the rural interior of the country that was neglected during the boom years and in tackling climate change. This is a very different China as president Jinping looks for other ways for economic development that fulfill the Sustainable Development Goals of the UN and the goals of building a better China for all its people in less developed rural areas and in urban areas.  ...

Without the patience and skills of S. Jaishankar peace at the Indian border with China could not have been restored in 2022. Here he describes the challenge of border incursions when he still called on his counterpart Wang Yi and maintained friendly communications, asking Yi not to let China complicate matters so that solutions could be found and things did not deteriorate further. At the time of tense Ukraine dispute in Europe, Jaishankar who was earlier the Indian ambassador to China, navigated this period of tension with China using his knowledge of China and how best to continue the diplomatic communications.  Less well known is the work put in by Jaishakar to bring citizen to citizen contact between Indians and Chinese by setting up such intercultural and educational programs in several Chinese cities as Ambassador to India. Jaishankar had the foresight to know that this would be important for the future. Yet these contacts are only a small fraction of the potential contacts between India and China on a citizen to citizen direct basis that are needed. Never is that more true than today with the wars in Europe, and the need for peaceful development in Asia. China is still a middle income country and India modernizing to become a middle income country. Both Europe and the US are far ahead in development than China and India. Jaishankar was appointed the Foreign Secretary of India in 2015 and in 2019 Foreign Minister of India in the Modi administration. He was the longest serving Ambassador to China for about 5 years in 2009-2013. He is unique because of his having been a senior diplomat to China, Japan, Singapore and the US, and speaks Japanese and Chinese. ...

Security is at the heart of India's foreign policy. S. Jaishankar points this out at Thiruvanathapuram. He says this was true of the effort at Balakot and even in the midst of Covid at the Line of Actual Control with China when India sent up enormous numbers of troops to defend the border. This is also behind the stand with China that security and LAC comes first in all relations with China. Trade and exchanges all come in the context of LAC, settle the LAC issues first then we can proceed with better bilateral relations, this is what India is telling China.  There are good reasons for this. India has a large border in the most formidable terrain of the Himalayas which is also close to the plains of India in the LAC with China. Any difficulties at the border would weaken India's secuerity and weaken development efforts in the same way that Japan sought to weaken Chinese development through invasion in the 1930's. Tibet looms out of the past. When China invaded Tibet Nehru's couple of pages in Discovery of India on China show that he had no idea of the China that had emerged with Mao and the CCP in its historical struggle against Japanese nationalists and imperialists. He had an idea of China that came from the Buddhist period and India's links from the past. The ruthless Japanese invasion that China confronted on its soil, and British colonial incursions before that, had already transformed the China of the past, which now under Mao in 1948 may have sought more defensible borders by extending them to Tibet as a buffer state. Historically the British had never tolerated Russian or other European or Japanese interference in the border states such as Tibet. There was also the question of capacity. By the time of the invasion of Tibet in the early 1950's China had already fought the Korean War with the US. India's army and defense forces were just coming out of partition and ill equipped for the task of defending the borders in Tibet region. Current governments in a more normal setting cannot change this part of history, yet can take full recognition of the facts that this has created. A strong defense has to be created for defending a border that extends for thousand of miles now that China has unlawfully occupied Tibet. On it also depends a strong and vigorous development effort that helps build the kind of modern defenses as the economy grows and absorbs new technologies rapidly. Both defense and development go together, one cannot have defense without rapid modernization and development, and one cannot have rapid modernization and development without defense. A weak defense would lead to distractions in development leading to the lack of rapid modernization and development as the intruding power interferes in insidious ways in the internal and external links of the country. This is the lesson of colonial interference of western powers in Asia. As Brendan Simms shows in his new book, Europe - Struggle for Supremacy 1500 to the Present, it is also the lesson of a different kind of colonialism inside Europe since 1500, where weaker states inside Europe fell behind with interference in turns by the imperial powers of France, UK, Austria-Hungary, Prussia and Russia. Poland, Finland, Czech Republic in the past and even Ukraine today are just some examples of what can happen when one loses sight of this principle. Poland and the Polish Commonwealth in the 19th century, Hungary right down to 1956, and China in the 1910-1930, India in the 18th and 19th century were weakened internally even after recognizing the problem, so that recognition of the problem is not an adequate condition to prevent countries from facing such foreign interference. ...
