Shiller, Kashyap, Mishkin, Slaughter, Stein, Stulz, Rajan and others are part of a 15 academic economists group called the Squam Lake Group. They first met at a conference in November 2008 at Squam Lake in New Hampshire. The group has come up with a report that they hope gets the prominence of the 9/11 report. It is called the Squam Lake Report. The book will be introduced in a conference at Columbia University by Fed chairman Ben Bernanke. Some of the economists have little faith in regulators and a new Financial Stability oversight Council led by Treasury Secretary Geithner. (Stulz, Kashyap). The group sees need for better disclosure of risks of financial products, especially retirement savings products.The editor Seth Itchik sees the book as today's version of the 1938 book by Harvard and Tufts economists called "An Economic Program for American Democracy." The motivation for this effort in a field where economists have different opinions, is to build a consensus for decisive action by Congress and the government of the U.S. Two new suggestions that are not in the Congressional bills for financial reform. One is issuance of contingent convertible bonds or CoCo bonds. Banks would be encouraged or required to issue such debt which would convert into equity in a crisis. These funds would help recapitalize a bank in a crisis with no taxpayer liability. Another new proposal is to have a fraction of each year's bonus pool for banking executives to be held separately- if the bank ran into trouble, that portion of pay would be withheld from senior managers. And the group sees political aspects and lobbying making sound plans less implementable in Congress. Congress lets regulators curb pay practices and coordinate other actions which has not worked in the past and during the crisis. Congress has even in its best effort acted on only some of the things needed in its bills- this includes higher capital requirements, and compulsory "living wills" for the largest financial institutions, and the Volcker Rule. The rules for derivatives are still being negotiated by Blance Lincoln who introduced this provision, with the result being more transparency. If it is watered down it would not ensure the strict separation of derivatives trading on the capital accounts of banks that Blanche Lincoln envisaged. ...

The Economist points out (in this cover issue on India-Pakistan relations) several fundamental facts. The first is that the current state of relations betweeen India and Pakistan hurts Pakistan the most. It makes a much smaller country and smaller economy bear the burden of defense against a large neighbor- defense takes up much needed allocation of funds for infrastructure and development, education and healthcare. It also weakens democratic institutions and their development by an overdependence on the military for governance. Poor India-Pakistan relations have significant adverse effects on the U.S. In fighting the Taliban U.S. forces are fighting a force that Pakistan's military helped create and support from its early beginnings as a way to counter Indian influence. With an Indian-Pakistani peace settlement of issues in Kashmir and other outstanding issues the U.S. would be in a significantly better position to disengage from the region, especially when the entire Middle East is moving in a new direction in 2011. Consider the difficulties in establishing peace in Northern Ireland, and between Turkey and Greece, and the difficulties of establishing peace between India and Pakistan cannot be considered even more difficult. Pakistan and India muddle along- neither side is doing much to take the initiative. For the U.S. disengagement from South Asia can be best achieved by pushing for a settlement between the two countries. Pakistan and India have much to gain from a settlement. Considering the progress made in Ireland, such places as Yugoslavia, and in Turkish-Greek relations, there is a lot more that can be done and should be done to bring India and Pakistan together. In Ireland diplomatic efforts were made by U.S. envoy George Mitchell, and in Yugoslavia U.S. envoy Holbrooke made diplomatic efforts towards the Dayton accords. Greek-Turkish relations have advanced to the point where Erdogan and Papandreou, the Greek and Turkish prime ministers, discuss solutions to the Greek debt crisis. This includes options to reduce Greece's defense expenditures in the light of Turkey's new foreign policies. The lack of such efforts to break the deadlock between India and Pakistan by the U.S,. the U.K. and other countries involved in the NATO mission in Afghanistan, the emphasis on a military solution supported first by Gen. McChrystal, and then by by Gen. Petraeus, all show a lack of understanding of the real issues that need to be tackled- issues relating to a peace settlement between India and Pakistan....

Judge Rakoff is interviewed by Adam Liptak as an essay by Rakoff appears in the December 22 issue of The New York Review of Books. Judge Rakoff is critical of the Justice Department for not prosecuting individuals responsible in the 2008-2009 financial crisis and merely offering excuses. He discounts the Justice Department argument that proving intent is difficult or that proving fraud is hard because of the sophisticated counterparties on both sides. He says assistant attorney general in the criminal division Bauer's assertion that you have to prove the individual involved made a false statement, intended to commit a crime, and that the other side depended on this for what they were doing, is misleading. The government is not required to prove that one party to a transaction relied on another party. On the difficulty to prove wilful criminal intent for individuals several layers above those who made and marketed the bad securities, Rakoff says the legal doctrine of wilfull blindness could have been used. Reflecting on why the Justice Department has not prosecuted individuals for wrongdoing the way Milken, Keating and Skilling were prosecuted in prior financial crises, Rakoff comes up with a explanation. He says the government's own role and the role of firms throughout the financial system is suspect in the 2008-2009 financial crisis unlike prior crises. Not only regulators are failing to to do their job. The financial system offers incentives for the packaging of bad debt securities. Fannie Mae has government backing and its management buys these securities to expand access to housing for low income people. The profits made on these securities brings U.S. and foreign banks into this business and leads to a proliferation of these securities around the globe to the point that small towns near the North Pole end up with these securities in their portfolio. This complicates things for prosecutors who in some situations have themselves worked for banks selling these securities. In its slow deliberative way the Obama administration, the Justice Department, and the S.E.C.'s new head, move to prosecute firms during the administration's second term, but not enough is done and tackling individual responsibility for deterring future wrongdoing in the interests of a safe and fair financial system seems a long way off....

Pearlstein argues that the US and the Obama administration achieved most of its goals, even though the Europeans took the credit. On regulatory reform, Geithner's regulatory reform proposal he says, could well have been written at the French Finance Ministry, as at the US Treasury. And it gives Obama ammunition to prepare, as private equity, hedge funds, and banks try to water down his proposals for regulatory reform. By having member countries commit to adding $850 billion to the resources at the IMF, and regional development banks to provide help to countries in serious difficulties- and giving instructions that the money can be used not only for debt rollover, bank recapitalization and balance of payments support, but also for stimulus spending, infrastructure investment, trade finance and social support- the Obama adminstration has accomplished a great deal. It has succeeded in putting in place the necessary financial resources to support not only the financial systems of countries in Eastern Europe, Asia and Latin America that need help, but put emphasis on the need for resources to go for helping reduce job losses, create jobs, and provide some forms of income or support to people in these countries. This is a major step as it means the countries of Eastern Europe and other developing countries can deal with their crises in confidence. Mexico is taking loans from the IMF. Dominique Strauss Kahn had begun the policy of shifting IMF's focus to these social goals as significant parts of the recovery process in countries, but he faced the old mindset among the IMF staff, as when its reported staff wanted to increase interest rates in Pakistan by 10% instead of the 3% that was finally agreed to. That would have caused serious difficulty to the people of Pakistan, created chaotic situation and disturbed the social fabric of that country. See the link to this for S. Korea and for Pakistan. And as Gordon Brown put it the old conditionality that lay behind the IMF loans, is phased out. This makes it the new policy at the IMF backed by the G20 mandate. The Washington consensus which prescribed open borders, floating exchange rates and fiscal prudence is now ended. And to support this change the developing countries will have a bigger say in IMF policy and decisions. ...

Now in March 2008 it appears that defaults on construction loans by smaller regional and local banks to single family home builders is spreading across the nation to the point where it may bring the credit squeeze for home, auto and credit card loans to local communities in smaller towns across America. This will be further slowdown not just housing but consumption at the local Walmart and retail stores. Loans to single family home builders went down from a peak about 2 years ago of $350 billion to about $250 billion in 2007. now the delinquencies on these loans is 8% in the 4th quarter 2007 according to Foresight Analytics. Its much higher at 14% in states like Ohio and Michigan. The Atlanta afffiliate of National Home Builders Association says that 20% of these builders are late in payments in that area. In states like Florida, Arizona and Arkansas, and Minnesota the delinquencies is at 10%. Note that the highly reputed ones like the Levitt and Sons that built Levittown in the post war period are also taking bankruptcy as banks are calling in their loans to be paid in full when they see builders losing money. What first appeared as signs of trouble in the Cleveland area is now spreading across the nation. Mr Whitlatch who studied planning at the University of Pennsylvania and went into building homes in the Clevelad area since 1969 is one of the home builders who is declaring bankruptcy after 9 million dollars in debt and using up $2 million of his own money and now selling off his family home. Fannie Mae and Freddie Mac have been authorized by the Bush Administration to put $200 billion into the mortgage market to keep things from getting worse in the housing market but much of the damage is already underway. How else will this affect local economies the local banks will be in trouble. Analysts estimate that about 150 local smaller and regional banks will go under in the next 3 years. Compared to this about 900 local banks went under in the S&L crisis over 5 years. It will put new stress on the local communities and their economy in coming months and years as the economic crisis goes from big cities to smaller towns and communities throughout America. ...

Micheline Maynard gets diverse views on bankruptcy filing and bailout for General Motors and Ford. Out of hundreds of comments, (looking at the comments based on reader recommends from 70 to 15 readers recommend range), with over 90% of comments favoring no bailout money for automakers without coming to grips with problems and replacing management and the board, it is clear that readers cite in order of importance the following against the automakers. Complicity with Congress and lobbyists in keeping fuel efficiency low. This sent billions of dollars to mideast nations for oil, which in turn bloated liquidity here at home, helping fuel the cheap credit era in the US and building consumer and mortgage debt. This lack of conservation in gasoline use burdened economies around the world with high oil prices, and then hit the car companies in Detroit hard as sales of large vehicles collapsed. Its entirely the Detroit carmakers own shortsightedness they say. Second most mentioned is bad management, and bad decisions and arrogance. Third the unions bloated contracts, and bankruptcy as the only way to get rid of them. Fourth failure to make green cars. Fifth the lack of any idea what $25 or $50 billion given to GM and Chrysler would get the taxpayer, because if the market has collapsed then more money will be needed each year to pay salaries and contiinue operations in 2009, followed by 2010. The market has gone from 16 milllion to a 10 million rate in October 2008, if it drops to 8 million in 2009, it would require the companies to shrink by 50% as a rough guess, and the union contracts just negotiated would be totally inappropriate for the new market and financial conditions. Getting rid of those union contracts could only be done in a bankruptcy filing, as in bankruptcy everything would have to be done from scratch. Whereas in a bailout the unions would simply refuse to cooperate as they have done in the past. This is also what readers are saying when they say let the market economy work. A look at the reader comments on similar articles in the Washington Post and the WSJ also show an overwhelming number of readers not favoring taxpayer money for automakers without serious changes, and bringing a completely new management and board to get things off to a fresh start, with no legacy from the past. ...

The documentary "Last Train Home," directed by Lixin Fan, shows the life of migrant workers and their families in China. Fan sporadically spent 3 years with one family, Zhang Changhua and Cheng Suqin, to capture glimpses of this family's life as one of China's 130 million migrant workers. The family left a village in Sichuan province, to work in a factory in Guangzhou, which manufactures denim jeans. For 7 days a week -once working 15 hours a day for 29 days straight- the Zhang family works continuously, just to send money back home to the grandmother who raises 17 year old Qin and another child. The daughter is rebellious as she is resentful of the parent's absence. This is the story of migrant families throughout China, the quiet hidden ordeal, that is behind the cheap products available in western countries. And Fan documents this well with scenes at the railway station, as the family catches the last trains back to Sichuan, for the yearly trip back to the village. There is a whole society in transition, and there are many sides to this story, this is the human one of families caught up in this transition. Lack of farm subsidies and taking over of farmland for building and construction has hurt life in agricultural areas. The Communist party has made dissent difficult. And the imposition of a decades old registration system that denies education and social services to migrant workers from the villages, creates huge strains on family life. Fan says- before the showing of this film at the IFC Center in Greenwich Village- that he hopes to raise questions in the minds of viewers. Does the blame for this go to the government, the factory owners and companies, or the West, something Fan says he is not able to answer. That there is little official opposition to the film- in the same manner that the suicides at Hon Hai, and the factory conditions there and in other factories across China, are being freely reported- suggests that China is coming to terms with the different angles from which to view the economic transition that has taken place over the last two decades. It is also a belated recogniton of the whole range of questions raised by a singleminded policy of manufacturing for western markets, especially when these markets with debt-laden consumers may present huge uncertainty in the future....

S.E.C. Inspector General David Kotz says his office will put out a report on the destruction of probe related records at the S.E.C.. Darrell Flynn, an S.E.C. attorney alleged that the S.E.C. destroyed about 9000 files in clear violation of laws that probe records cannot be destroyed. He sought and obtained whistleblower protection. Senator Charles Grassley disclosed the accusations and asked the S.E.C. to explain the effect of this on investigations.

The leaders of Republicans and Democrats, Senate Majority Leader Mitch McConnell, Speaker Boehner, Minority Leader Nancy Pelosi, and Minority leader Harry Reid, reached a budget compromise with the White House in October 2015 after long closed door negotiations, following years of deadlock in previous years. The compromise lifts sequester spending caps agreed to previously in a previous settlement of differences, and lifts the budget ceiling till March 2017. Speaker Boehner said it was time to "clean out the barn," as he did this over the opposition of Senators Rand Paul and Ted Cruz from the right wing of his party who opposed his efforts to compromise with Democrats. On October 28, 2015, the House of Representatives passed the two year budget agreement 266-167, and the following day Speaker Boehner passed on the Speaker's position to Rep. Paul Ryan of Wisconsin. On Oct. 29, 2015, the Senate voted 64-35 to pass the budget compromise agreement. The agreement increases discretionary spending by $80 billion over 2 years, giving half to defense spending with the increase in military threats overseas, and the other half to domestic spending programs. The domestic spending goes to limit premium increases for some Medicare Part B beneficiaries, and a prevents a 20% across the board cut to Social Security Disability Insurance benefits, set for 2016. This removes the uncertainty posed by threats of a showdown on the budget ceiling and threat of defunding Planned Parenthood posed by right wing Republicans in Congress, which were bad for the economy at a time when the U.S. and Europe faces increasing threats overseas. Without a budget agreement the U.S. Treasury Department would have seen its borrrowing authority expire on Nov. 3, 2015....

The trading volume on the New York Stock Exchange has seen a jump in the last week from an average of 4.26 billion shares traded daily in 2011, to an average daily volume of 7.31 billion shares in the first ten days of August 2011. Analysts say this reflects market anxiety, trading on conviction now compared to the light trading and a rising market in the earlier part of the year. The jump in volume also looks ominous as individual investors pull back say analysts.

The Greek government received 25 billion euros from the European Financial Stability Facility. This money will go to recapitalize Greece's banks. The four largest banks, Piraeus Bank, Alpha Bank, National Bank of Greece, and Eurobank EFG, will get the money by May 25, 2012. About 16% of loans made by Greece's banks in 2011 have soured, compared to 7.7% in 2009, according to the chief economist at Alpha Bank. There is a vicious cycle in effect with depositors withdrawing money and less money availble from bank financing for midsize business leading to businesses closing. The effect is little demand for loans and banking coming to a standstill. For the 8 months to March 2012, an estimated 23 billion euros have been withdrawn by depositors, of this 700 million euros in the period May 6- May 22, after the May 6 elections.

The NYT editorial says sharks circle in Congress to kill the Obama plan for a new consumer protection agency with the necessary powers to protect consumers. Campaign contributions to members of Congress by the banking industry is having anegative effect. But says the NYT the federal regulators who put the interests of banks first are also having the negative effect. It cites the example of a Fed governor, Elizabeth Duke, who says the Fed has all the powers to protect consumers, in a Congressional hearing. Says NYT the Fed was given sweeping powers to prevent predatory lending in 1994, but did not issue new rules till July 2008, till the damage had alredy been done. And not just to consumers, but to the American and global economy. It goes on to say that consumer protection is the unwanted stepchild in the regulatory community as protecting consumer s is spread across 20 statutes and seven different agencies. Considering the damage to the economy that has already been done its amazing that the same tired old arguments can be repeated without severely straining credibility. The close relations between Geithner, Rahm Emmanuel Obama's chief of staff, and others in the administration with the banking industry do not bode well for coming up with the strong legislation to protect consumers. And the close connections which helped the banking industry kill legislation that would have helped homeowners, by allowing bankruptcy judges to modify mortgages to prevent foreclosures....
