US Supreme Court hears arguments from D. John Sauer Solicitor General of the US on DJT Tariffs Wednesday, November 5, 2025. The Supreme Court will hear about a case brought by a small wine importing company with 19 employees. The US president used the 1977 International Emergency Economic Powers Act (IEEPA) that allows the president to impose tariffs. The IEEPA was introduced by president Jimmy Carter in 1977. It was used during the Iran hostage crisis. It has been used for the Venezuelan regime after elections were rigged with human rights violations, on Belarus as early as 2006, and on Mexico for drug cartels. This increases the responsibilities of the Justices of the Court as these sanctions have broad support of the American people. Tariffs were imposed on China for illicit fentanyl flows and a 25% tariff was imposed on Canada and Mexico under Executive Orders 14193, 14194, and 20% on China under Executive Order 14195 in 2025 for illicit drug traffic flows across their borders into the US. Illicit flows that has taken the lives in the case of fentanyl of more young people than were killed in the Vietnam, Korean and First World Wars combined.  For the reason that the economic aspect of tariffs now overlaps with trading partners abuse of basic rights of their largest trading partner the US in the case of Canada, Mexico and China not stopping such flows, the issue before the Supreme Court is basic to the US as a Nation to protect its citizens under these Executive Orders and IEEPA- not the kind of interpretation of the law the USC does for most or almost all of its cases. In 2025 a lot of the discourse is distorted and does not reflect the way citizens of the Nation should show concern for the welfare and safety of their fellow citizens in communities around them severely hurt by the scourge of fentanyl and other opioids making their way from other countries conducted by drug trafficking gangs outside the US.  Also relevant is that the tariffs are correcting trade deficits of $1 trillion of the world with China that threaten the economic security of the US, EU, India and other countries. Larger companies are moving their supply chains out of China to reduce concentration in China, impact on inflation is slight with 3.0 % inflation in September 2025. Smaller companies such as the wine company in this lawsuit are unable to do so. Most of the smaller businesses affected can be compensated with a fund from the tariffs revenue of $500 billion in 2025-2026. In this way the goals of the US as a Nation can be achieved of reducing the supply channels concentration in China, cutting supply chain concentration in China, for fair trade with trading partners EU/Japan, and for action on fentanyl and drug trafficking. Justice Roberts and his team have a lot to think about in this effort by the Nation to correct abuses that should never been allowed to happen. ...

Xi Jinping's effort to shift the economy of China more towards serving the interests of Chinese who were left behind in the boom years includes a shift away from coal, away from real estate for speculation, and away from reliance on trade with the US and Europe as a driver for growth. This is proving to be difficult as the pandemic has increased demand for Chinese exports making trade a bigger driver for growth than before the pandemic. Introduction of a property tax to cut into real estate speculation has been scaled down to trials in 10 cities.  China did not put stimulus checks in the accounts of its people the way the US did which has led to Chinese domestic consumption not rebounding the way it has done in the US. Figures for consumer spending in China for September show an increase of 4.4% from the year earlier far below the pace of 8% set for 2019. The lack of social security and other safety nets in China makes people to save even more today. Chinese savings rate was 40% in 2019, today it is 45.2% for May 2021, according to one survey. Personal consumption makes up 38% of China's GDP in 2020, it was 39% in 2019. In the US it went up in 2021 June to 69% compared to 67% by the end of 2020. Infrastructure and construction deepened debt problems in China, and expanding exports created trade tensions. Both these problems have deepened with the pandemic. As this report says Chinese exports have gone gangbusters. Problems in production in Vietnam and Malaysia have added to export surge from China. China's trade surplus with the world is now at $535 billion in 2020, and surplus with US increased by 7% to $317 billion in 2020 from 2019.  Chinese government policy is now for "common prosperity" to reduce inequality and spread wealth and income more evenly for all the Chinese people. This is taking time and Chinese government policy is now set for the long run with these short run problems. ...

This report on Bangladesh politics and economy is from The Guardian July 14, 2019. In 2009 the Awami League party under Sheikh Hasina contested the election in a Grand Alliance with Gen. Ershad's Jatiya Party winning an absolute majority of the seats. Since then Sheikha Hasina has been prime minister through 4 elections maintaining economic growth through the garment industry till the pandemic and disrupted supply chains hit Bangladesh hard leading to its debt burden doubling in 3 years. This led to turning to the IMF in 2022  with reserves down to $23 billion and student protests over lack of jobs. A second wave of protests led to her ouster in August 2024. This report by Derek Brown in The Guardian shows the changing situation in Bangladesh in the 1980's and 1990's after independence in 1971 following the India-Pakistan 1971 war. Zia Khaled of the BNP and Sheikh Hasina of the Awami League were alternately in power with periods of rule by the Army under Ershad contesting elections as the Jatiya party when the two parties failed to govern effectively. This went on from 1996 till 2009 when Sheikh Hasina began what would be four terms in office for 15 years. The economy was improving by 2019. And then Covid hit - the pandemic had serious effects on the foreign exchange reserves of Bangladesh, Sri Lankan and Pakistan economies. Only in India with the efforts of prime minister Modi was the economy put on a sustained growth path, corruption prevented by the personal example of Modi's leadership, and a state led development focus achieved using the example Modi had set in Gujarat as its chief minister for 15 years. The rest of South Asia lacked such firm and decisive leadership that is similar in its focus to the transformation of first Japan and China into leading industrialized nations.  In 2022 Bangladesh followed Sri Lanka and Pakistan in going to the IMF. By 2023 the foreign exchange reserves had declined to $23 billion. In 2024 to $19 billion. Garment economy dependent Bangladesh was seeing the effects of supply chain disruption and decrease in earnings from exports. In 2024 student protests on joblessness and frustration at economic prospects led to the ouster of the Hasina government.  ...

"Made in China 2025" has caused consternation and alarm in Washington about China's effort to dominate key industries of the future with state subsidies. This report in WSJ shows the European response to China's effort. A survey by the EU Chamber of Commerce in China shows 58% of companies have not been able to participate in Made In China initiatives. There is concern that global supply chains are not being utilized in robotics, aerospace, and electric vehicles, three areas under China's program.  62% of companies say they didn't know whether this was leading to increased discrimination against foreign companies.

China generates 53% of its emissions from coal in May 2024. All the remaining from non fossil sources. Two factors are evident, yet both do not indicate a big fall off in fossil emissions from this point just a plateauing effect with it flattening out. The first is that China is putting in solar and wind at 8 times the level of the US, taking up two thirds of world solar and wind installations. The second is that the one third of emissions from construction and real estate is falling off because that industrial sector has collapsed. Overall the future points to slowing of emissions as China comes only gradually down from that 53%. What happens in China makes a huge impact on climate change. India has also committed to climate change action and meeting targets early under PM Modi so that India as it industrializes will not follow the path of jumping fossil emissions China had. This is useful to know as the US and EU, UK, expand solar and wind. It is important that the US stay committed to climate change action something missing from the Republican platform for 2024. Delaying climate change action will impose huge costs on the US that could be about 1 trillion dollars if it is stalled now and is taken up in 2028. ...

US foreign direct investment to China goes down 40% in 2020 to 2022 compared to the period 2015 to 2020, for India this was up by 20%, according to IMF. India was the only G-20 country that received this level of foreign direct investment. Prashant Jha of the Hindustan Times correctly points out that the IMF paper and the model on which this paper is based are flawed. The paper sees countries based on alignment and India as a so called non aligned country not part of friendshoring, even though Treasury Secretary Janet Yellen has openly called for friendshoring in India alongside finance minister Nirmala Sitharaman. IMF experts have not caught up to Mr. Biden's remarks about the US- India relationship that it would be "the closest on earth." Closer even than America's relationship with Britain or Europe. On oil imports Biden and Jake Sullivan believe that after the pandemic India should import oil at the lowest possible cost to meet the long time denied aspirations of 1.2 billion people, and build the infrastructure that will make it a critical part of America's new supply chain. Every time there are military drills and blockade of Taiwan by China the people of America are moving a step further away from American companies that have overconcentration of manufacturing in China and closer to calling for a new supply chain that reduces concentration in China and builds new manufacturing in India.  ...

Greg Ip says in WSJ that China turned to lender after 2010 and financed loans for development, for roads, highways and infrastructure in Asia and Africa. Between 1970 and 1990 the World Bank was extensively involved in infrastructure projects, by 1990 it retreated from this role and China after 2010 was lending at double the rate of the World Bank for it Belt and Road Initiative programs. At G20 New Delhi, India, Biden and Modi, leaders of Brazil, and South Africa, agreed on advancing the World Bank's loan capacity by $100 billion for next decade under leadership of Ajay Banga. Thjis is happening at the meeting of finance leaders in Marrakech, Morrocco in 2023. The IMF and the World Bank were set up after World War II under the agreements signed at Bretton Woods, New Hampshire, as postwar finance system. The IMF was to serve as lender to countries facing short term finance crises, and the World Bank to finance development in poor countries such as India, Indonesia and after 1990 China. The largest borrowers from the World Bank were India, China and Indonesia. India is at $37 billion loans outstanding in 2021, China at about $21 billion after repaying much of its loans. China's BYD started in electric batteries and expanded into electric cars. It has emerged as the dominant electric car company in the world as China now has half of the electric cars on the road in the world. 35% of exports of electric cars are from China. Keith Bradsher of NYT reports from Shenzen that its first car was made in 2007 of poor quality, similar to Toyota in the 1930's as it tried car manufacturing for the first time. It has surpassed Tesla in making electric cars. In each of the last 2 years it has increased electric car sales by one million to reach electric car sales on 3 million. EV sales in China were up in 2023 to 9.49 million cars giving BYD the largest share of 31%., by comparison US electric car sales were 1.2 million. New assembly lines are being built in Brazil, Hungary and Thailand. And new lines are planned for Mexico and Indonesia. This kind of growth was seen only by General Motors in 1946 after the end of the war. It also shows the progress China is making. In solar panels something like the addition of 900 million solar panels meeting the entire increase in electricity demand for each year, so that emissions targets can be met earlier than planned to tackle climate change.  The same changes are happening in electric cars. China now has 40% of electric cars or gasoline/electric plug in cars going up to 50%. For export China is building large carrier ships, the first that will take 5000 cars for export to the Netherlands. The lowest priced electric car model the Seagull was priced at $11,000. BYD's lowering of manufacturing costs have given it the ability to price the cars to attract new car buyers.  Wang Chuanfu who studied at Central Southern University in Changsha known for its battery research, was an engineer who started the company in the 1990's to make batteris for Motorola. Between 2003-2006 he experimented with making cars in the hope of making electric cars. Stalled efforts in 2009 and 2011 were met with arenewed effort in 2016 trying a new approach to cut costs by developing a battery where supplies of lithium or cobalt would not be a constraint. He developed a new battery using iron and phospate to replace lithium cobalt batteries. A big break came in 2020 with the Blade battery that increased range to the level of cobalt lithium batteries at a much smaller cost. BYD hired German Audi designers for new model design. This time BYD was in the right position to build a car company matching all others with costs lower by about 35% than VW for some models. This comes from- lower costs to make in China, making its own parts inside the company for 75% of parts compared to VW only about 35%, and by the savings from its battery research.  BYD has shown ability to shift with market needs and opportunities. In 2022 assisted driving was facing hurdles, BYD had second thoughts about the new technology, by 2023 as it was increasing in use BYD committed $14 billion in autonomous driving technology. Driving range is a problem for people in urban areas going back to their villages in China. BYD has an advantage here compared to Tesla- it makes hybrid plug ins that account for half its sales. Toyota has also had emphasis on hybrid plug ins where it missed the opportunity was that it moved very slowly on all electric cars not realizing how fast things were moving outside it's world. This is the situation America also faces in 2024 and beyond who can deliver on the infrastructure capabilities, new research ,and tap American potential to compete in this new world where one innovation will follow another. ...

A sign of the growing people to people relationship of the US and India is the number of Indians in US graduate schools which went up from 68,000 to 102,000 in the 2021-2022 academic year, up 48%. There almost as many Indians taking the GRE exam for entry into US graduate schools in 2023 as Americans taking GRE in the US. Another sign of the expanding people to people relationship is the decision of the Biden administration to give 1 million visitor visas to Indians in the coming year. In India physical sciences and humanities for GRE exceed engineering by a wide margin, showing the shift in subjects. Under India's new education policy NEP the shift is to a more multidisciplinary approach and allowing students to mix science subjects, math with humanities. This approach is seen as best for India to produce a new generation that can think for itself better than the purely engineering science or medical track graduates of the past who had limited knowledge of the humanities. This overly engineering focus has prevailed in the educational approaches of Japan and China during their rapid growth period. India under the Modi administration is betting on a wider knowedge of different and contrasting subjects and disciplines for its future. ...

This is showing up in U.S. oil making up 7% of China's imports by mid September 2020 from 0.4% in January. By the endo of October forecasts show U.S. exporting 700,000 barrels a day to China. The U.S. is displacing Saudi and Middle East oil as Saudi exports now make up 15% of China's oil imports from 19%. This also shows that president Trump's trade deals are working to help balance trade with China and remove the disadvantageous position the U.S. was placed in by three previous administrations.

When the BBC talks about "fish" in a novel way as identity it fails to look at the important issues of unemployment, failures in industrialization and modernization, failures in infrastructure building, entrenched corruption that are the main issues in the West Bengal election in 2026, as they were in the elections earlier in Bihar and Orissa states of northeastern India. That the BBC is silent or says nothing about the massive amount of poor quality and unstable unemployment in West Bengal where youth are leaving the state to find employment in the western states of Gujarat, Maharashtra and other states. BBC is silent about the "cut culture" which means a percentage of every financial transaction goes from the public or business to corrupt politicians in government and their associates, destroying any chance of economic progress. BBC along with other media say little about the lack of business investment in the state, and an environment that is not investment friendly, which means industrialization and modernization is falling behind in West Bengal, Bihar, Orissa region with a population of close to 300 million people, about half the size of the European Union, located in northeastern India. In this attitude by the media including the BBC in the US and European Union one finds a feeling that is similar to that shown during the evolution of China into a modern state from the conditions of the 1930 with Japanese occupation, corrupt leadership and roadblocks to modernization and industrialization that mattered little to the world outside China and India. ...

French colonial rule and suppression of independence protests at Setif, Algeria, 1945, which led to much of the Arab liberation writings that were to lead to 5 decades of wars in the region. Many of the coups in Iraq and Syria and in Egypt by military men were a result of this period of colonial rule in the Arab world in Iraq, Syria, and other Middle Eastern countries of the French and the British. The anti-colonial writings of this period had one bad aspect the fervor led to an uncritical acceptance of the idea that achieving political independence would be enough for better standards of living, education healthcare and infrastructure. Economic freedoms would require a very different approach from the political aspect. These wars destroyed much of the resources, wealth and human other potential in the Middle East leading to economic stagnation by 2026. Gulf kingdoms with small populations pursued grandiose schemes, with the rest of the Middle East stuck in poverty and lack of industrialization, lack of infrastructure development, sience and technological education, that happened in China and South Korea, and is happening now in India. Iraq and Syria, Lebanon are artificial states by the French and British colonial rulers out of the collapsed Arab part of the Ottoman Empire which with their mix of peoples from different Islamic sects are impossible to manage to this day, and the world (China, US, EU, India, Brazil, other nations) has other priorities of their own than getting sucked into these wars. ...

Americans by large margins in Pew Research believe AI will help in day to day tasks from weather forecasting to inventing new medicines. And by large margins of 40% Americans think AI will hurt ability to think creatively and form meaningful relationships and by 20% will hurt for making difficult decisions. The US is on track to bring back 350,000 jobs in 2022 that were taken overseas during the two decades of hyper growth in China, according to the Reshoring Initiative. A false idea was created mostly by economists and business that shifted jobs to China during two Democratic and one Republican administration, the Clinton, Obama and the Bush administrations, that this would benefit the American workers and families through lower prices at the retail level. It ignored the severe damage this would do to jobs, incomes and whole communities when factories on which they depended for a living were shipped overseas. It damaged labor in ways that destroyed much of the American working class and the families built during the years of FDR, Truman, Eisenhower, Kennedy and Johnson. Business failed during this period to meet the challenge of higher American wages and productivity issues by using innovation and other steps to keep manufacturing at home.  This led to the hyper growth that did not benefit China, because a moderate pace of growth would have helped China control the rampant contamination of its air, water and soil. It also was leading China to a dead end reached during the 2016 election campaign with the election of president Trump with deep discontent from workers in midwestern states. The pandemic simply underscored the need for supply chains that were close to home and reliable in crises. By 2020 president  Biden was committing to a restructuring of the supply chains and pushing forward with it with legislation in the $369 billion Climate bill, and SCIENCE and Chips Act, to make solar panels, semiconductors and other products in the US. Reports from China showed that growth was slight or flat during 2022 and youth unemployment at 20%. The policy was to shift people back from the cities to the rural areas and support the informal economy, a sense of nationalist sentiment, and preparing for a future where the supply chain for the US and the European Union had moved away from China. In the long run the policies now look as ones that benefitted neither the US, the European Union, India or China.  ...

The difference between US imports and exports is down from $418 billion in 2018 to $280 billion in last 12 months (August 2024 to July 2025) showing the impact of tariffs and policies of the DJT administration to level the playing field and for getting out of the trade deficits that hurt American jobs, workers, and communities. Tariffs of 20% for fentanyl issue and 125% made it 145% for import tariff on China after Liberation Day. These were lowered to 30% after trade talks. This where it stands today.

The figure of $280 billion is higher because of transshipping by China through Vietnam- for transshipping the 20% tariff on Vietnam goes up to 40%. Another aspect of the figure of $280 billion is that it is last 12 months which reflects 5 months of the Biden administration, and the surge in imports before deadlines when DJT tariffs would come into place. Battery imports are up, smartphones, toys and apparel is down.
