In a 5 to 4 court runling the U.S. Supreme Court gives president Trump the authorization to use $2.5 billion in Pentagon funds for building a border wall with Mexico. This was a campaign promise and energized his election campaign after years of failure to reach agreement between Democrats and Republicans on how to tackle the migration issue. In the court's decision it overturned an appellate court decision.  The Supreme Court stated in its order that the groups challenging the administration did not appear to have the legal right to do so. This indicates that the Court's conservative majority is likely to support the Trump administration in the end.  The surge in migration from Central American countries such as Guatemala through Mexico has revived the issue of migration. President Trump also secured an agreement with Guatemala to cut down on the migration.  President Trump has cited the need to control flow of illegal drugs across U.S. southern border in addition to the migrants from Mexico and Central America. In bringing the case to the Supreme Court the solicitor general, Noel Francisco wrote that the Plaintiff (Sierra Club) "interests in hiking, bird watching and fishing in designated drug smuggling corridors do not outweigh the harm to the public from halting the government's efforts to construct barriers to stanch the flow of illegal narcotics across the southern border."  The dispute between the Trump administration and the Democrats controlled House of Representatives led to court decisions stopping the use of government funds to build the wall. This led to the declaration of a national emergency along the Mexican border by president Trump on Feb. 15, 2019, after a government shutdown during an impasse with Congress on this issue.  Now the Supreme Court has given president Trump access to Defense Department funds to proceed with the wall and meet a campaign promise.   ...

WIth China reluctant to make concessions on agricultural imports at a recent Shanghai meeting of Mr. Lighthizer with Chinese trade representatives, the trade dispute with China has escalated. China also said it was suspending all agricultural imports of U.S. farm products. The U.S. designating China as a currency manipulator.  The situation today is that there is a level of mistrust between president Xi and his advisers and Mr. Trump and his team. The situation has taken a new turn with China saying the U.S. is supporting protests in Hong Kong. President Trump has stated China is waiting it out to deal with a new administration in Washington. Both sides do not see any solutions till after the U.S. elections in 2020. For China there is also the upcoming 70th anniversary of the People's Republic. ...

The Ford Motor Company's effort to get president Trump to work on a compromise with California on fuel economy standards has failed. Leaving the industry split with Ford on one side and GM, Toyota on the other siding with president Trump on lower fuel economy standards than set by California and lower than the standards set by Mr. Obama. He worked in the Nassau County District Attorney's Office before becoming deputy assistant attorney general for Nassau County in 1999, and assistant attorney general for Nassau and Suffolk counties. He has served as a justice in the New York County Supreme Court since 2009. Merchan is described as a serious jurist, smart and even tempered, and a no-nonsense judge who is always in control of his courtroom.

Merchan has already handled a case against the Trump Organization and Mr. Weisselberg. In that courtroom he is reported to have said that he would not in any way allow anyone to bring up a selective prosecution claim, or claim that this is some sort of novel prosecution, that Weisselberg was somehow being targeted because of his association with Mr. Trump.

The US Supreme Court unanimously agrees that letting a state decide who is on the ballot and who is not based on an insurrectionist interpretation of the US Constitution would lead to chaos. The SC was considering a lawsuit filed by the state of Colorado asking that Trump be disqualified for insurrectionist behaviour related to events at the Capitol on January 6, 2021. Other states had filed similar lawsuits. With 51 states any state could do this leading to chaotic and unanticipated situations. Neil Irwin in the NYT why the U.S. China Phase 1 Trade Agreement is more than a hill of soyabeans as he puts it, more than about all the soyabeans that the U.S. farmers can sell to China. China's economy was seeing the effect of U.S. tariffs. Additional tariffs to cover all imports from China to the U.S. would have worsened this. China avoided this by agreeing to Phase 1. The U.S. had looked for some enforcement mechanism based on China putting this down in a written agreement particularly for avoiding subsidies to state enterprises and improper access to U.S. advanced technologies. China's reluctance to do this led to Mr. Trump saying that China had reversed its position and Trump expanding the tariffs stage by stage. These issues are now set aside for Phase 2 still to be negotiated. Both sides taking what they could get. China relief from the threat of tariffs on all exports. The U.S. under Mr. Lighthizer's negotiating leadership retaining the enforcement idea through the tariffs that are still in place of 25% on half of China's exports to the U.S. The bonus for Mr. Trump is the goodwill China generates by agreeing to buy all the U.S. farmers can produce, farmers having not only stood behind Mr. Trump but also forming a key part of his support base. China will continue to compete in technological areas with the U.S., and the state enterprise model which worked for China as Mr. Xi tells visitors will continue. Phase 2 is just that Phase 2, when and if it can be negotiated between Trump with his negotiator Lighthizer and Xi with his negotiator Liu He. On key points neither side is budging. A key goal for Mr. Trump is to put the trade surplus China enjoys of $300 plus billion a year with the U.S. on a serious downward path, and bring so many of the jobs and manufacturing back home. On this trade data for 2019 and the plan for 2020 of both countries is clear. It should be down each year by 10-20% for the next few years, a major achievement of Mr. Lighthizer, who did the same with  Japan under president Reagan. ...

The firing of John Bolton as National Security Adviser opens up the possibility of a meeting of Trump with President Rouhani of Iran. There is a need for both sides to begin talks on a nuclear deal that would replace the one Iran signed with president Obama to address issues raised by Mr. Trump and Republicans. Iran and countries that buy oil from Iran such as India, China and Japan have an interest in relief from sanctions imposed by the Trump administration on imports of Iranian oil. The European Union is keen to preserve aspects of the nuclear deal. Relief from sanctions is critical for Iran to develop its economy. The last two decades have seen Iran struggle to develop its economy with the sanctions imposed by  different U.S. administrations.   President Trump expressed flexibility on sanctions saying "we will see what happens. I think Iran has potential. They are incredible people." President Rouhani urged Mr. Trump "to put warmongers aside." Mr. Trump told reporters that he had resisted Mr. Bolton's opinions on issues and realized he had moderate views when compared to someone like Bolton.  Trump told Iran "We are not looking for regime change. We hope we can make a deal and if we can't make a deal thats fine too. But I think they have to make a deal." Helping the U.S. and Iran come to talks is president Macron of France who hopes to setup a meeting at the UN General Assembly which meets next week following his efforts at the G-7 meeting in France last month. In the past when tensions were high in the Straits of Hormuz President Trump refrained from aggravating this by saying actions that are "disproportionate" should not be taken and respected Iranian intentions. The tone of the conversation between the two sides has moderated to the point where both sides realize the need for coming to some compromise. This is in sharp contrast to the period a few months ago with rising tensions in the Straits of Hormuz and the seizure of an Iranian ship. Bolton's opinions were not the only issue for president Trump. He was also seen as the source of leaks including one that said Mike Pence, the Vice President, had opposed Mr. Trump's plan to bring the Taliban to Camp David. Also contributing to the new climate for talks is Mike Pompeo the Secretary of State, who has promoted the idea of talks with Iran. He told the media about such a meeting at the UN General Assembly in New York- "Sure. The president has made it very clear that he is prepared to meet with no pre-conditions." The willingness to try new ideas even contrary ones to policy pursued only a short while ago as long as the desired goal is reached is a feature of this presidency and key advisers. From the beginning of the Trump administration there is a firm sense of the need to end the wars in Afghanistan and Iraq. and reduce foreign entanglements that have dragged on wasting resources and destroying priorities. With a willingness to try all sorts of approaches even ones that appear to be contradictory always keeping the end goal in sight. ...

Hilsenrath describes how the Federal Reserve missed the signs of the mortgage financial crisis of 2008, the bubble economy, and how low interest rates and other actions of the Fed to rescue the economy led to a situation which hurt savers. The lack of a serious plan for homeowner rescue as part of the actions by the government further hurt the working and middle class. The rescue also lacked credibility because the banks ended up becoming bigger than they were, and no action was taken in the U.S. which had been pushed by the U.S. in similiar situations overseas- for example on South Korean banks for overborrowing during the 1997 Asian financial crisis.  At the 2014 Boston Fed sponsored conference on Inequality, Fed chairman Janet Yellen described what she called the largest inequality in the U.S. not seen since the 19th century. The average net worth of the lower half of the distribution, said Yellen, of 62 million households, was $11,000, and a quarter of them had zero net worth. These were the shocking statistics that propelled two unlikely outsiders forward- Donald Trump to the Republican nomination for president, and Bernie Sanders who coming close to getting the Democratic nomination settled for a big part of setting the Democratic agenda supported by nominee Clinton in 2016. ...

The Economist magazine says Mr. Trump's claim that he could fix things because he is an outsider is now quickly proving to be false. The lack of experience works against the Trump administration as it stumbles from one crisis to another. The tweets that were used to turn voter sentiment against opponents now work the other way. There are other problems that are noted here but not emphasized to the extent they need to be. Mr. Trump, as Peggy Noonan, a Reagan aide, has pointed out in the WSJ, risks alienating the very blue collar vote, and older voters whose interests he claimed to defend. This happened with the Ryan Republican House health care bill as millions of poor Americans approaching retirement were one of the worst affected groups. The Economist points out that the next project to tackle tax reform has the same possible consequences for the Trump blue collar base, as it says Republican plans for tax reform are seen as regressive. Tax reform has eluded previous administrations, and requires more experience in building coalitions which the Trump administration lacks in its confrontational attitude towards Congressmen on both sides of the aisle who disagree with him. Improving the U.S. trade position, infrastructure investment are other areas that the administration plans to tackle, yet the first 100 days show that the lack of experience and the lack of a calm composed mind is hurting the Trump administration, to the point of policies that hurt the very voters who put their faith in the Trump administration to improve things. A similar process is unfolding in Britain as it faces a Brexit negotiation that the Economist points out has been badly handled by prime minister Theresa May, and could lead to worsening the economy if no deal is reached because the European Union sees that it is not in its interest to do so, and Ms. May realizes only later that she has taken nationalist sentiment a bit too far for a European economic arrangement to work and provide mutual benefit. A continent wide economic arrangement that it was the wisdom of past leaders from Britain, France and Germany to support for over six decades is not easily undone by one vote, or one government. ...

On Immigration she makes a pledge to sign the Lankford Biden immigration law the first in four decades that closes the Border with Mexico and fixes asylum policy. "But Donald Trump believes a border deal would hurt his campaign. So he ordered his allies in Congress to kill the deal. Well, I refuse to play politics with our security. Here is my pledge to you: As President, I will bring back the bipartisan border security bill that he killed. And I will sign it into law." Trump blocked it for personal advantage at the elections to use this as an issue which has blocked a permanent solution. Confirming this is a month old interview in NYT by Republican Senator Lankford saying the legislation he drafted would have passed Congress in December 2023 and signed into law by Biden. It came up in Congress in February by this time Trump was made nominee of the party and he blocked it so that he could use the issue in an election. This says a lot about character and more than mere fact checks shifts focus on the characters of the two people running. Steve Kerr coach of the men's basketball Olympic team says decency humility, values and character, a clear authenticity are essential in a leader. People ask yourselves what you would have done in this situation, and what would Kamala have done, would she have blocked a bill that would permanently fix the Border and change US asylum policy?  Biden went on to do this by executive action bringing migrant flow numbers down to where they were under Trump and Obama, and more than that put together a bipartisan bill with Republican Senator Lankford that Kamala can now sign into law.    ...

The WSJ of August 24 has flaws in that no questions were asked on wages and benefits for workers and climate change. About 73% of voters see Mr. Biden's age as a factor. Voters have not grasped Biden's vision for America. A Trump 10% margin for vision and record of accomplishments is unusual considering it is Mr. Biden who is making the changes on climate change, wages and income, infrastructure building with trillions of dollars of funding. The poll itself has issues because it was done by a Republican poster who is working for the Trump campaign and does not have questions on climate change or wages and benefits of workers. President Biden does well on infrastructure, on jobs, and the effects of inflation are being tackled by increase in wages and benefits supported by Biden.

This report in the NYT says family members felt Lewandoski lacked the experience needed for a presidential campaign, was slow to hire new staff, and was at odds with Trump's GOP advisor Paul Manafort. This article in the New York Times makes an extraordinary report about Rod Rosenstein, U.S. Deputy Attorney General and his views on president Trump following Trump's firing of FBI Director Comey. New York Times says it has based its report on meetings in which Rosenstein participated with Justice Department and FBI officials. Mr. Rosenstein and Mr. Sessions, the Attorney General, attended a meeting at the White House last year with Mr. Trump in which he agreed to write the memo cited by Mr. Trump for firing Mr. Comey. Rod Rosenstein had no idea at the time that Mr. Trump would cite his memo, and felt afterwards that he had been used by Mr. Trump, according to this report in the NYT. Leading Democrats were very critical of Mr. Rosenstein for providing the memo that served as the basis for firing Mr. Comey. Mr. McCabe who succeeded Mr. Comey and others also left the Justice Department and the FBI, and the events of that time has created dissension in the FBI and the Justice Department, leading to the release of this information to the New York Times.  Mr. Rosenstein according to this report based on internal meetings with Justice Department officials, was concerned about the chaotic situation in the White House following the firing of Mr. Comey of the FBI. During this time it is reported here Mr. Rosenstein suggested recording of the president and invoking of the 25th Amendment. The 25th Amendment of the U.S. Constitution provides for removal of the President by the Vice President and cabinet officials on certain grounds such as when the president "is unable to discharge the powers and duties of his office." Mr. Andrew McCabe, who was head of FBI following Mr. Comey's firing was also fired, and he has memorialized his interactions with Mr. Rosenstein in memos that are now with the Mueller investigation.  Not everyone thinks this is a constructive step as a letter in the New York Times questions the wisdom of such a report leading to the departure of Mr. Rosenstein. Mr. Rosenstein is seen by some as defending the Mueller investigation into Russian interference in the U.S. presidential election. But even this may be overstated or in doubt as the criticism of Democrats leading to the the release of the report by the NYT on Rosenstein shows. Mr. Rosenstein says in response to the NYT report that he sees no need for invoking the 25th Amendment. ...

The is WSJ report points out that there were differences between the president and his defense secretary Mr. Esper, over the issue whether active duty military should be sent in to control protests in Washington D.C., Minneapolis and other cities in America. On May 25 president Trump considered firing Mr. Esper who said at a Pentagon press conference that he opposed bringing in the military to cities to quell domestic protests. Mr. Esper stated "The option to use active duty forces in a law enforcement role should only be used as a matter of last resort. And only in the most urgent and dire of situations. We are not in one of those situations now."  Military and defense officials were very much opposed to this as fundamentally contrary to military values.  Mr. Trump consulted several advisers who told the president that this was not the right thing to do. Mr. Esper for his part also was making his own preparations to resign and here again his advisers persuaded him to not do this, says this report in WSJ.  The incidents happened as protesters crowded Lafayette Square, the park across from the White House, and the president believed that violent protesters were making it difficult for National Guard troops to maintain control. Mr. Esper is a West Point graduate and former Army officer. The president's advisers from the military included Chairman of the Joint Chiefs of Staff Army Gen. Mark Milley. Milley and Esper discouraged the president from invoking the Insurrection Act of 1807 and calling in army troops to the cities. Mr.Trump later visited the area around the church near Lafayette Park. The advisers consulted by the president on May 25 were Mark Meadows, White House chief of staff, Secretary of State Mike Pompeo, David Urban, and two senators Tom Cotton of Arkansas and James Inhofe of Oklahoma. Mr. Cotton, a first term senator from Arkansas, later wrote a article in the NYT opinion pages on June 3 supporting use of the military. That article had the title "Send in the Troops- Tom Cotton" which NYT says was placed by editors, and appears baffling, considering the importance that this matter presents for the military and the nation. The NYT later stated with the article that it did not reflect "a thoughtful approach"  and lacked the "additional context" that would let readers be informed and think carefully. The essay also had a reference to the constitutional duty to the states from the federal government that could be misinterpreted, and without context. Mike Pompeo, one of the president's close advisers is Secretary of State. He is a West Point graduate, standing first in his class from the U.S. military academy in 1986, served 5 years in Germany in the 4th Infantry Division, before being elected to Congress from Kansas. The other key adviser in the decision Mr. David Urban headed the Trump campaign effort in a key state Pennsylvania. Both appear to be sensitive to public opinion and the thinking in the military.  By June 6 the White House press secretary said that Mr. Esper was instrumental in bringing calm to American cities after a week of protests following the death of Mr. Floyd in Minneapolis.
