How Elizabeth Warren, a Professor at Harvard Law School, influenced economic advisor Summers and President Obama in their decision to form a Consumer Financial Protection Agency. She met with Summers recently and they have known each other for a long time at Harvard University. Warren has spoken up for consumers, and written several books and articles on the subject of protecting consumers, credit and economic stress. She was the chief advisor to the National Bankruptcy Review Commission and chairwoman of the Congressional Oversight Panel which acted as a watchdog over the TARP program. Ms. Warren says she first got the idea of a financial products agency while researching a 2003 book about middle class families who did well on one income, but now were having a difficult time coping with two incomes. She made the point that it wasn't overspending by many families that was to blame but poorly designed financial products. In 2007 she wrote an article in the journal Democracy about this idea of an agency to protect consumers of financial products. She says overhauling the regulation of financial products is necessary not only to help consumers make good decisions, but also help "make the market work." And she adds that the market "has been badly regulated" through a system of seven federal agencies, each of which has jurisdiction over some aspect of consumer financial products. Sunstein, and Thaler, a Professor of Economics at the University of Chicago, wrote a book "Nudge" which shows the impact of psychology and the behavioural element in decisions made by consumers. Sunstein and Thaler express the idea that there are advantages in having standard products that cannot lie to consumers, and are based on the "fair-dealing, openness and transparency" the President emphasized. If there is no good succession in Medvedev's view the economic and social development of Russia will slow down significantly, for this reason the First Deputy Prime Minister under Putin puts a lot of significance on getting a good leader in place to continue the development progress of recent years. It is interesting that the thought process behind the remarks shows that the person has reflected a lot on these things, on leadership and good succession and its role in development, on a government and the importance of a good constitution and getting the best out of it, on studying the experience of other countries and being aware of their historical development, the role of a national leader, the constitution and everybody abiding by it, on corruption and its presence in latent and other forms and its different character in different societies. He talks about the importance of a Presidential system for Russia with strong presidential power, and the complete unsuitability of a parliamentary republic for Russia because it appears that the government could end up being weak with a many party coalition, especially in Russia at this time where there are many parties and factions each would be jockeying for power. Coalition governments would not accomplish much leading to stalled economic and social development. Manufacturing is very important to Russia, and adding a high portion of the value added to products is very important,  that Medvedev understands. It appears he has reflected on a lot of things that matter to Russia's development, and would make a different kind of President than Putin. He just might carry forward Russia's development for the next 8 years in a proper manner. From the standpoint of oil prices and availability of supplies, a good environment for cooperation in the energy sector between foreign companies and Russian companies, it appears that Medvedev would offer good leadership for the next 8 years in a Medvedev- Putin combination as President and Prime Minister, a Medvedev-Putin administration. This would also be true in the manufacturing sector in the expanding industries like automobiles and others. ...

Compared to the situation in North Africa in 2016 with emigration to Europe and the migrant crisis happening without any preparation to prevent it in 2015-2016, Germany and France are acting in coordination with Russia and Turkey, Saudis, UAE, to provide stability to the region. Angela Merkel will host leaders Macron, U.S. Secretary of State  Pompeo, and representatives of foreign powers in Berlin to work out a deal for disengagement of foreign powers. Turkey and the United Nations support a government of National Accord in Tripoli which controls the west of Libya, and a Libyan-American Mr. Haftar has a militia that controls the south and east with the help of Egypt, UAE, and Russia. Earlier the U.S. under president Trump had distanced itself from the region, but Mr. Trump and his advisors now see the need to engage in the region to ensure stability, and support the Europeans in the effort to prevent the large scale emigration that threatens European unity. Europe following the 2015 Merkel migrant crisis is acting with the policy of heading off both wars, terrorism and economic dislocation that fuels emigration right at the points of origin, before it even starts. This shows that the French after action in Ivory Coast and Mali and the Germans with aid to Africa are remaining involved in development and stability programs in Africa, lessons learned from 2015. The goal of the Berlin meetings is to arrange high level agreement for foreign powers to withdraw from destabilizing the Arab regions in North Africa particularly Libya by supplying weapons and support to quarreling factions. ...

As Keith Bradsher of the NYT points out in this report too much may be made of the tariffs of 25% imposed by president Trump on steel imports. The effect Bradsher says on China is trivial because China imports make up a fraction of 1% or 0.1% of China's production, and only 2% of American steel imports. Most of China's aluminium is made into products such as auto parts and solar panel frames, and little of it is imported as raw metal. On the day the tariffs were announced, China's top economic official Liu He met with economic officials of the Trump administration and China's reaction was cautious and reflected the fact mentioned b.y Trump about its huge trade surplus with the U.S. of $375 billion in 2017. China's officials stated "that its dialogue with the U.S. was very useful, constructive, and helpful."  China's principal goals are first to preserve its broader trading relationship with the U.S. which gives it th $375 billion trade surplus for 2017 and creates millions of jobs in China, and to preserve its ability to invest in the U.S.  This has given China access to American technology and manufacturing expertise that would be difficult to develop independently. The Trump administration is meanwhile working with senior members of Congress to come up with new rules for tighter scrutiny of Chinese investments in the U.S. as a new phase of competition in technology takes place between China and the U.S.  ...

John Hills, a law professor at Indiana University and author of "The Political Centrist," says tough political exchanges are endemic to the American political system. Others say putting crosshairs on representatives in Congress like Giffords on websites or its equivalent wasn't the practice since the times of Jefferson and Adams. We looked at the letters of George Washington during the long struggle with the British and it showed composure and civility even in dire circumstances and difficulties. Criticism by Washington of the lack of help and risks he was exposed to throughout the war was worded carefully, with civility and yet conveys the great urgency. What about the letters of Jefferson and Adams who were on opposite sides of the debates of that time, a time more infused with momentous issues because of the French revolutionary tide in those years? A letter to Abigail Adams, from Washington, June 13, 1804, gives a glimpse of that relationship: "The friendship with which you honored me has ever been valued, and fully reciprocated, and altho' events have been passing which may be trying to some minds, I never believed yours to be of that kind, nor felt that my own was. Neither my estimate of your character, nor the esteem founded on that, have ever been lessened for a single moment, although doubts whether it would be acceptable may have forbidden manifestations of it. Mr Adams friendship and mine began at an earlier date. It accompanied us thro' long and important scenes. The different conclusions that we had drawn from our political reading and reflections were not permitted to lessen mutual esteem, each party being conscious they were the result of an honest conviction in the other. Like differences of opinion existing among our fellow citizens attached them to the one or the other of us, and produced a rivalship in their minds which did not exist in ours." Jefferson in this letter says that one act of Adam's gave him a moment of personal displeasure, the last appointments by Adams as President "from among my most ardent political enemies." This says Jefferson "laid me under the embarrassment of acting thro' men whose views were to defeat mine, or to encounter the odium of putting others in their places...If my respect for him did not permit me to ascribe the whole blame on the influence of others, it left something for friendship to forgive, and after brooding over it for some little time, and not alwasys resisting the expression of it, I forgave it cordially, and returned to the same state of esteem and respect for him which had long subsisted...I maintain for him and shall carry into private life an unform and high measure of respect and goodwill, and for yourself a sincere attachment."...

Five rules the editors of the WSJ say should be followed when working on cleaning up the banking system. A clear no, as Krugman and other experts point out is for the government to make the rather imprudent move to take on all the debts of the banks as in Ireland. A second rule is not to underestimate the size of the problem and delay action till the problem gets much worse, when its harder to deal with. ECB president, Mario Draghi, pointed out the problem at Spain's handling of Bankia bank as a clear example, telling the European parliament recently: "There is a first assessment, then a second, a third, a fourth. This is the worst possible wayof doing things. Everyone ends up doing the right thing, but at the highest cost." A third rule is to set clear rules about banks, who gets rescued and who gets closed and why- so that its not left upto the discretion of officials. On this rule Spain's outgoing Zapatero administration gets good marks from WSJ for settting clear rules to the cajas svings banks. A fourth rule applicable to Europe is to first setup the expertise and conditions for a European banking regulator before setting up a banking union and direct injection of funds by the EFSF into banks of individual countries. A fifth rule is to avoid creating even larger mega banks by consolidating failing banks with large banks, and continuing the government's implicit guarantee of the bank because it is "too big to fail" and creates systemic risk- this is the situation after action by the U.S. Federal Reserve, regulators and the U.S. Treasury....

This report in WSJ looks at the unanimous vote in the House of Representatives delisting hundreds of Chinese companies trading on U.S. stock exchanges. The Holding Foreign Companies Accountable Act passed by unanimous voice vote in the House of Representatives after a similar vote in the Senate in May, and will be signed into law by president Trump. The law says foreign companies should be delisted if they fail to comply with U.S. Public Accounting Oversight Board regulatory agency's financial audits for 3 years in a row. The basis of the law is that all companies should be equally treated and required to meet U.S. regulatory standards to be listed. It also ensures safety for investors who may be defrauded of their money investing in companies that have not met such audit requirements. Wirecard in Germany and some Chinese companies have failed in the past because of lax overseas standards. This gives three years for the Chinese companies to prepare. This report also points out that the MSCI Index has 43% Chinese companies even more than before. American investors can still buy these stocks on the Hong Kong exchanges so that if fairness and investor protection should prevail American investors have to think and act along the same lines. China is also decoupling from the U.S. to some extent and pushing to have its companies listed on the Hong Kong Shanghai and  Shenzen stock exchanges. For these reasons the access to global capital is not likely to be affected by this law particularly with the behaviour of major American institutional investors. China is providing incentives to these investors even though it did not do so in the past creating another hurdle to the goal of creating a level playing field in regulatory requirements stock for all companies listed on American exchanges and safety for investors.  ...

U.S. added 245,000 jobs in November. Unemployment rate drops from 6.9% to 6.7% as some Americans give up looking for work. The concern now is not the rate of job creation which is healthy but the drop outs from the workforce.  Concern arises from the long drawn out effects of the 2009 financial crisis and its effects which were seen over a decade. This report in NYT says the share of prime age Americans who were employed returned to the January 2008 level in 2019. And then the pandemic hits putting everything back again. This time if the lesson is learned about the long term damage to working families it is that this be tackled as a priority for the central bank, the U.S. Federal Reserve, an the Treasury, and Council of Economic Advisors, under the leadership of president Biden. Fortunately both Yellen and the new proposed head of the Council are students of labor markets and have stated this is one of the lessons they have learned and will act on. As this report says the opiate crisis, the risks of addiction increased, and there were links to the long period people were without jobs. The longer a person is without a job the more likely he will become permanently unemployed. The hope now is that the vaccination effort could bring people back to work quickly as business and life resumes in 2021, with workers being hired back. The share of prime age Americans working in November is 76.5% compared to 80.5% in February, which means this has to go up by about 4 percentage points. The people who are not in the labor force today but still want a job are 2.2 million. It is this that needs to be the focus of the new administration, central bank, and Congress. ...

Two law school professors at Fordham University, Kysar and Sugin, say the Republican tax bill is extreme because it was not based on working with Democrats. As a result not a single Democrat supported this tax legislation. The problem- when the Republicans lose their majority in Congress- a serious possibility after the loss in a Senate race in deep red state Alabama- the whole issue of tax legislation would come up again. This is not without precedent as the Democrats won the presidential election in 2008 and Republicans made a sweeping victory in Congress in 2010.This is why Senators Casey and Wyden (Democrats) and Orrin Hatch (Republican) head of the Finance Committee stated on the floor of the Senate on Dec. 19, 2017, that the next time and in future both parties need to engage in real discussion on taxes. The lack of serious discussion on the health care bill passed by Obama in 2008 has created some of the same problems today that this tax bill passed in a similar way without discussion with the other party is likely to face by 2019. No one needs to look further to realize that the political system is failing in its job of grappling and solving the nation's problems. Kysar and Sugin say this bill is like the 1981 tax cuts skewed towards high income Americans which failed to generate economic growth as intended an led to a swift reversal with tax increases in 1982 and years that followed in 1983, 1984. President Obama failed to address tax reform after appointing the Bowles Commission and not taking up its recommendations to reduce deductions. Another effort at changing the system was made without serious debate, a kind of Republican response to the way Democrats passed the Affordable Care healthcare bill in 2008. Real changes to update the tax laws may be put off till both parties can wrap their hands around the problem together. ...

Connors and Magalhaes provide an exceptional account of the work of nine young prosecutors in Brazil, including Deltan Dallagnol, a Harvard trained law graduate, Carlos Santos Lima, a Cornell law graduate, and Paulo de Carvalho, in looking into the corruption and money laundering at Petrobras. Contracts for work given out by Petrobras to construction firms were inflated in value, and 3% of the inflated value was given to executives at Petrobras, or to the fund of the ruling Workers Party of Brazil. Dallagnol is a prosecutor in Curitiba, a small provincial city. He detected unusual movement of money, where a local car wash showed a new Land Rover being gifted to a Petrobras executive, in an apparent money laundering effort. Appointments at high levels are made by the government, and the current president who has not been implicated, was at one time chairman of Petrobras. In Brazil, as in India, Nigeria, and other developing countries, politicians were known to have misused public funds, but were able to act with impunity because the legal system made it difficult to impose strict penalties. The effort by the young prosecutors in Brazil is an effort to bring changes to the legal system so that this type of near impunity no longer exists. It is the first step to bringing serious changes and increasing public awareness for change. The result in Nigeria is a huge loss in Africa, with the electricity system for the entire country the size of what it would take to light up one medium sized American city. In India with the lack of roads and electricity in rural areas of many states, the misuse of public funds is a similiar burden on the people. Brazil is coming out of a borrowing binge in the last ten years which is leading to a credit crunch in the country and near junk bond status for Petrobras, Brazil's largest company, which experts predict will lead to a contraction in the economy in 2015-2016. ...

Richard Fisher, president of the Dallas Federal Reserve Bank, has a three part proposal for tackling the "too big to fail" problem and concentration of 70% of the U.S. banking assets in a few banks. It calls for Market Discipline to be exercized in a way that the Dodd-Frank legislation fails to do. This is to be accomplished by having deposit insurance and the Fed's discount window apply only to traditional commercial banks, not the nonbank affiliates and parent holding companies. Customers, creditors and counterparties of all nonbank affiliates and the parent holding companies would be asked to sign a disclosure accepting that there is no government guarantee. In addition the largest financial holding companies would be restructured so that all their corporate entities would fall under a speedy bankruptcy process. Fisher does not clarify how he would do this restructuring. The Fisher idea come after changes in the banking industry through internal management restructuring following trading losses, legal settlements and the passage of a Swiss referendum called the Minder Initiative on compensation. Fisher suggests the U.S. Fed and regulatory authorites in other countries should push for further restructuring and calls for action beyond the limited results from 2010 Dodd-Frank Wall Street Reform and Consumer Protection Act. He is critical of Dodd-Frank's often ambiguous and lengthy worded legislation- 849 pages for the law and 9000 pages for the regulations written to implement the law. Fisher emphasizes the point that its hard to implement a law and enforce rules when its not clear and is difficult to understand....

Melloan says President Bush is rightly offering Eisenhower's proposal for peaceful use of electrical energy as a friendly gesture to India. Ike made the "atoms-for-peace" proposal to the United Nations in Dec 1953, saying: "A special purpose would be to provide abundant electrical energy to power-starved areas of the world." This also helps in other ways- 1. Takes pressure off gas prices with rising demand in India met by nuclear energy. 2. Gives American exporters a big market for nuclear energy equipment (companies like GE). 3. Improves prospects for other American exporters and businesses in India as the economic relationship grows larger. India is not receiving anywhere near the foreign investment China is receiving, actually minscule in comparison. This gets the whole relationship rolling. 4. Nuclear energy is an attractive option for India as it has few oil resources, and reduces dependence on coal from the standpoint of global warming and greenhouse gas emissions.

Solomon and Lee of the WSJ describe the role played by Ayatollah Ali Khamanei in the talks, down to the final days- as late as July 14, U.S. Secretary of State Kerry is described as asking his Iranian counterpart Javad Zarif, "do you have the mandate of the Supreme Leader?" Zarif replying that he was confident that he did. The media announcement of a deal came that same day July 14, 2015. The last weeks of the negotiations were conducted under the tension that if a deal was not reached quickly the Iranian military or some other factions could upset the deal. Even after the announcement of the deal in the media, Kerry was not certain, saying he never indicated he was confident, and it would all depend on its implementation. U.S. president Obama who initiated the contacts with Khamanei and his close advisors early in his presidency, said that the deal offered the U.S. and the world an opportunity to move in a new direction.

This is one of the strongest worded statements on Syria made on the editorial pages of the Washington Post, as editorial page editor Fred Hiatt talks about the situation in Syria created by the policies of president Obama and his closest advisors. He calls the failure of these policies Obama's achievement, failing to find any other word to describe the years of deliberate inaction and appearing to act in crisis when simply stalling, during 2011-2015, that reversed all the gains and opportunity presented by the Arab Spring. Instead it has put that part of the world back into a dark period similiar to 17th century Europe with the religious and sectarian conflicts that lasted for the better part of that century, compounding the serious errors under Republican administrations since Reagan, with new errors by taking the opposite extreme in policies- without giving a place for thoughtful courageous policies and making difficult choices.

A former president of the Bank of China International's U.S. office describes the rampant shadow bank lending that is happening in China. The People's Bank of China (PBOC) and the China Bank Regulatory Authority (CBRC) is aware of this activity and regulations are in place to prevent such lending. Yet much of this lending continues as property developers and local governments devise new ways to get around these rules. The PBOC and the CBRC have no precise handle on nonbank sources of lending such as money from state owned enterprises and are not able to control the huge increase in credit and speculative uses of capital. And they have to struggle with local governments and the National Development and Reform Commission which support higher spending and credit levels. As a result there is a sense of a financial system that is out of control and building up risks whose precise nature and size are hard to calculate, even for China's senior leadership.
